04-22-1976 VC REG-MMINUTES OF REGULAR MEETING OF THE VILIAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, APRIL 22, 1976 Present •_ Ronald L. Heraty, Mayor Mervin H. McIntyre, Vice Mayor V. A. Walker, Village Clerk- Mayor Heraty called the Regular Meeting to order at ROLL CALL 7:32 p.m. All members of the Council were present. Councilman Marks gave the invocation and Councilman INVOCATION & Love led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. ALLEGIANCE On motion of Vice Mayor McIntyre, seconded by Councilman APPROVAL OF Marks, all present voting aye, the minutes of Regular MINUTES Meeting held Thursday, April 8,_1976 were approved as written. Mayor Heraty read a proclamation proclaiming May 1, PROCLAMATION - 1976 as Law Day U.S.A. in the Village of North Palm LAW DAY U.S.A. Beach. ' Four young gentlemen - David Shepherd, Scott Nangle, _ DONATION Donald Rose and Bi11 Kilpatrick, all of North Palm TO NORTH SHORE Beach - are members of the North Shore High School HIGH SCHOOL Chess Team. These four young men will be accompanying CHESS TE&M two other young men from North Shore to .the National Scholastic Chess Tournament for High Schools in Cleveland, Ohio this May. This great honor was achieved by winning the State Chess Tournament and the Southeast Regional Tournament. These _._ young men approached the Council requesting a donation to assist them in getting to Cleveland. Councilman Marks moved that we donate $300 to the North Shore-High School Chess Team to make the trip to Cleve- land for the National High School Chess Tournament, the funds to be expended from Account No. OS-500. The motion was seconded by Councilman Moore and all present voted aye. On motion of Vice Mayor McIntyre, seconded by Councilman ACCEPTANCE OF Moore, all present voting aye, the following minutes were MINUTES accepted by the Council: Minutes of Regular Meeting of Community Appearance Board held April 6, 1976 Minutes of North Palm Beach Tennis Advisory Board meeting held April fi, 1976 Minutes of Regular Meeting Held Thursday, April 22, 1976 Page 2 1 [~ 1 Vice Mayor McIntyre moved that the recommendation con- tained in the Minutes of the Country Club Advisory Board Meeting of March 24, 1976 that the Village Manager and Country Club Director make a study of a year-round minimum to cover all classes of memberships at the North Palm Beach Country Club be approved.- The motion was seconded by Councilman Love and all present voted aye. RECOMMENDATION APPROVED Councilman Moore moved that we accept the recommendation MOTION TO contained in the Minutes of the Planning and Zoning ACCEPT P & Z Advisory Board Meeting of March 19, 1976 that the Council AD..- BD. RECOM- adopt the proposed Live Aboard Marina Ordinance as re- MENDATION vise d. The motion was seconded by Councilman Marks PASSED and all present voted aye. Vice Mayor McIntyre moved that we place this proposed MOTION TO PLACE ordinance on the agenda at this time and read it by PROPOSED ORD. title alone. The motion was seconded by Councilman ON 1ST READING Moore. Councilman Love moved to amend the motion to send MOTION TO this back to the Planning and Zoning Advisory Board AMEND for their re-evaluation. The motion was seconded by Councilman Moore and passed 4 to 1, with Councilman Marks opposed. Thereafter Council voted on the main motion as amended MAIN MOTION AS and it passed 4 to 1, with Councilman Marks opposed. AMENDED PASSED Therefore, this proposed ordinance will be sent back to the Planning and Zoning Advisory Board. On motion of Councilman Love, seconded by Councilman BILL 243 Moore, all present voting aye, Bill No. 243 entitled: PLACED ON -- 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, MAKING TRANSFERS AND ADJUSTMENTS TO VARIOUS APPROPRIATIONS OF FEDERAL REVENUE SHARING MONIES; APPROPRIATING FEDERAL REVENUE SHARING MONIES FOR CERTAIN TRAFFIC SIGNALS, CARDIAC ARREST UNIT, TENNIS COURTS, RECREATION, FORMS AND SUPPLIES FOR NCR MINI-COMPUTER AND PURCHASE OF NCR MINI-COMPUTER; AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL --- YEAR 1975-76 BY APPROPRIATING MONEY FOR PENALTIES AND INTEREST AT THE NORTH PALM BEACH COUNTRY CLUB; AND AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL YEAR 1975-76 BY TRANSFERRING FUNDS FROM THE COUNCIL CONTINGENCY ACCOUNT TO THE PROFESSIONAL AND IN- VESTIGATIVE SERVICES ACCOUNT FOR AUDITING EXPENSES was placed on second reading and read by title alone. Vice Mayor McIntyre moved that Bill No. 243 be adopted B1LL 243 as Ordinance No. 7-76. The motion was seconded by ADOPTED AS Councilman Marks and all present voted aye. ORD.- 7-76 Councilman Moore moved that Bill No. 244 entitled: BILL 244 PLACED ON 2ND READING AN ORDINANCE OF fiHE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH BUDGET FOR THE FISCAL YEAR 1975-76 BY TRANSFERRING FUNDS FROM THE COUNCIL CONTINGENCY ACCOUNT TO WORKMEN'S COM- PENSATION, GENERAL LIABILITY AND FALSE ARREST INSURANCE ACCOUNTS, AND BY TRANSFERRING FUNDS FROM THE COUNTRY CLUB RESERVE ACCOUNT TO THE GENERAL LIABILITY INSURANCE ACCOUNT be placed on second reading and read by title alone. ORD. 8-76 Councilman Love moved that Bill No. 246 entitled: BILL 246 PLACED ON AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, 1ST READING FLORIDA, DESIGNATING THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AS THE GOVERN- MENTAL ENTITY TO ACT AS THE "LOCAL PLANNING AGENCY" IN ACCORDANCE WITH SECTION 6, CHAPTER 75-257, LAWS OF FLORIDA be placed on first reading and read by title .alone. The motion was seconded by Councilman Marks and all present voted aye. Vice Mayor McIntyre moved to place the names of NAMES PLACED Ruth Brown, Ray Parker and Dr. William Mcllvaine ON PROPOSED on proposed Resolution No. 27-76. On motion of Councilman Marks, seconded by Councilman RES. 27-76 Love, all present voting aye, proposed-Resolution No. ADOPTED 27-76 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE NORTH PALM BEACH COUNTRY CLUB ADVISORY BOARD was read in full and adopted as read as Resolution No. 27-76. Vice Mayor McIntyre moved to place the name of George F. Cornelius on proposed Resolution No. 28-76.. The motion was seconded by Councilman Moore and all present voted aye. NAME PLACED ON PROPOSED RES. 28-76 RES. 28-76 ADOPTED Councilman Moore moved to place the names of Don Murphy NAMES PLACED ON and Ed Skarin on proposed Resolution No. 29-76. The PROPOSED RES. motion was seconded by Councilman Love and all present 29-76 voted aye. Councilman Marks moved to place-the names of Thomas McCarthy and Neal Neff on proposed Resolution No. 30-76. The motion was seconded by Vice Mayor McIntyre and all present voted aye. On motion of Councilman Love, seconded by Councilman Moore, all present voting aye, proposed Resolution No. 30-76 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE CONTRACTORS BOARD OF THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as read as Resolution No. 30-76. Vice Mayor McIntyre moved that the names of Donald Mattson-and Norman Robson be placed on proposed ' Resolution No. 31-76 as regular members, and the name of Walter Hoffman as first alternate and Ben Rose as second alternate be placed on this proposed Resolution. The motion was seconded by Councilman Marks and all present voted aye.. On motion of Councilman•Moore, seconded by Councilman Marks, all present voting aye, proposed Resolution No. 31-76 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE COMMUNITY APPEARANCE BOARD OF THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as-read as Resolution No. 31-76. Councilman Moore moved that the names of H. Norman Bott and McLin "Max" Nowlin be placed on proposed Resolution No. 32-76 as regular members, and the name of John Dunnuck as first alternate and Sally Venzara as second alternate be placed on this proposed Resolu- tion. Vice Mayor McIntyre moved that we place Item 6 b of ITEM 6 B OF the workshop agenda on the regular agenda at this time. WORKSHOP PLACED This concerns the acceptance of a petition for'street ON REGULAR improvements from the residents of Paradise Harbour AGENDA - PETITION ' Condominiums and Apartments. The motion was seconded FOR STREET IM- by Councilman Moore and all present voted aye. PROVEMENTS FROM RESIDENTS OF Mr. Arthur Loreto, 105 Paradise Harbour Boulevard, PARADISE HARBOUR spoke on behalf of these residents. The petition. CONDOMINIUMS was accepted by Mayor Heraty, on behalf of the & APARTMENTS Village Council. This petition contained 377 sig- natures. r_ .- : , 4 1 1 Minutes of Regular Meeting' Held Thursday, April 22, 1976 Page 6 The Council informed these residents that if and when they get us good legal title to the roadway that the Village could then entertain assessment proceedings to have the road paid for under special assessment, whereby the entire cost of the road, drainage, lights and all improvements would be paid by the property owners where the road is located over a ten year period of time at low municipal interest by special assessment. Councilman Love moved that we take a five minute recess The motion was seconded by Councilman Marks and all present voted aye. The meeting was recessed at 9:00 p.m. and was reconvened at 9:05 p.m. RECESS Councilman Marks moved that we accept the offer to construct ALAMANDA DR. the extension of Alamanda Drive by Omega Court Subdivision EXTENSION - and, upon it being constructed to Village specifications, OMEGA CT. SUB- that we accept it for maintenance.- The motion was seconded ..DIVISION by Vice Mayor McIntyre and passed 3 to 2, with Councilman Love and Councilman Moore opposed. Councilman Marks moved that Council appoint Howard L. Searcy to the West Palm Beams Urban Area Transportation Study Technical Coordinating Committee. .The motion_was seconded by Councilman Moore and all present voted aye. Councilman Moore moved that Council revoke. the occupation- al license of the Electric Circus as provided in Section 20-11 of the Village Code. The motion was seconded by Councilman Marks and all present voted aye. Councilman Love moved that Mervin H. McIntyre and Lawrence Dallin be designated as the. municipal representatives to the Areawide Advisory Group of the Palm Beach. County Areawide Waste Treatment Management Program. The motion was seconded by Councilman Moore and all present voted aye. Councilman Moore moved that we transfer $9,000 from Account No. 12-110, Police Salaries and Wages, to Account No. 12-300, Animal Control. The motion was seconded by Councilman Marks and all present voted aye. Vice Mayor McIntyre moved that the Village Manager has the discretion to either open or close the North Palm Beach Country Club on Mondays depending upon the re- quirements for golf course maintenance. The motion was seconded by Councilman Moore and all present voted aye.
