09-25-1975 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 25, 1975 Present: M. C. Love, Jr., Mayor Ronald L. Heraty, Vice Mayor William A. Greeley, Councilman Dr. V. A. Marks, Councilman Mervin H. McIntyre, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Mayor Love called the Regular Meeting to order at ROIL CALL 8:06 p.m. All members of the Council were present. Mayor Love gave the invocation and Vice Mayor Heraty INVOCATION & led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. ALLEGIANCE On motion of Vice Mayor Heraty, seconded by Councilman APPROVAL OF Greeley, all present voting aye, the minutes of Public MIN[JTES Hearing on Bill No. 231 held Thursday, September ll, 1975; and the minutes of Regular Meeting held Thursday, September 11, 1975 were approved as written. Mr. Boles of Team Plan, Inc. gave a presentation. to the PRESENTATION OF Council on the Comprehensive Community Plan. It is CGMPREHENSIVE mandatory by state law that every community have such COiMC1UNITY PLAN a plan. On motion of Councilman Marks, seconded by Councilman COMPREHENSIVE McIntyre, all present voting aye, that we adopt the COMM[JNITY PLAN Comprehensive Community Plan as amended. ADOPTED AS AMENDED On motion of Councilman Greeley, seconded by Councilman ACCEPTANCE OF Marks, all present voting aye, the following minutes MINUTES- were accepted by the Council: Minutes of Zoning Board of Adjustment Meeting held August 19, 1975 Minutes of Recreation Advisory Board Meeting held September 9, 1975 Minutes of Country Club Advisory Board Meeting held September 17, 1975 On motion of Councilman Greeley, seconded by Councilman COUNCIL ACCEPTS Marks, all present voting aye, that we accept the oppor- __-OPPORTUNITY TO tunny to be part of 'Open House U.S.A." The motion was seconded by Vice Mayor Heraty. TO RENYOVE FOOT- INGS AND RODS AT WATERWAY CONDOMINIUM Minutes of Regular Meeting Held September 25, 1975 Page 2 1 Councilman McIntyre amended the motion as follows: MOTION AMENDED That the Village-Manager do whatever is necessary to see that this situation is corrected. The motion was seconded by Councilman Marks and all present voted aye. Councilman Marks amended the motion as follows: That MOTION AMENDED we have a report back to the Council by the next regular meeting on the conclusions and the schedule. The motion was seconded by Vice Mayor Heraty and all present voted aye. Thereafter Council voted on the main motion which passed -MAIN MOTION unanimously. PASSED UNAN- IMOUSLY On motion of Councilman Marks, seconded by Councilman ADDITIONAL McIntyre, all present voting aye, that we extend six CREDIT FOR months additional credit for users of the hoist located USERS OF HOIST at our marina. AT MARINA On motion of Councilman Greeley, seconded by Vice Mayor BILL 232 PLACED Heraty, all present voting aye, Bill No. 232 entitled: ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE BUILDING CODE FOR THE VILLAGE, BY REQUIRING THE INSTALLATION OF FIRE DETECTION SYSTEMS IN EXISTING HOTELS AND MOTELS was placed on second reading and read by title alone. On motion of Councilman Greeley, seconded by Councilman B1ZL 232- Marks, all present voting aye, that Bill No. 232 be ADOPTED AS adopted as Ordinance No. 13-75. ORD. 13-75 On motion of Councilman McIntyre, seconded~by Vice BILL 233 PLACED Mayor Heraty, all present voting aye, Bill No. 233 ON 2ND READING entitled: _ -- AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, BY REQUIRING ALL BUILDINGS TO HAVE STREET NUMBER SO LOCATED ON THE PREMISES AS TO BE CLEARLY VISIBLE AND LEGIBLE FROM THE PUBLIC STREET 1 was placed on second reading and read by title alone. On motion of Councilman Marks, seconded by Councilman BILL-233 ADOPTED McIntyre, all present voting aye, Bill No. 233 was AS. ORD. 14-75 adopted as Ordinance No. 14-75. - On motion of Vice Mayor Heraty, seconded by Councilman BILL-234 PLACED Greeley, all present voting aye, Bill No. 234 entitled: ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, LEVYING A TAX ON REAL AND PERSONAL PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF NORTH PALM BEACH FOR THE YEAR ENDING DECEMBER 31, 1975, FIXING THE TOTAL VALUATION THEREON AND THE TAX MILEAGE RATE THEREON FOR SAID YEAR; ADOPTING A FISCAL BUDGET FOR THE FISCAL YEAR OCTOBER 1, 1975 TO SEPTEMBER 30, 1976, BOTH INCLUSIVE, FOR THE GENERAL GOVERNMENT AND DEBT SERVICE OF THE VILLAGE OF NORTH PALM BEACH AND FOR THE PARTICULAR USE OF THE NORTH PALM BEACH COUNTRY CLUB; APPROPRIATING FUNDS FOR EXPENDITURES AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE was placed on second reading and read by title alone. Minutes of Regular Meeting Held September 25, 1975 Page 3 Councilman Marks moved that Bill No. 234 be adopted as Ordinance-No. 15-75. -The motion was seconded by Council- man McIntyre. Councilman Marks moved that Bill No. 234 be amended as follows: In Section 2 insert the words 7 mills in line 1 and line 9. The motion was seconded by Councilman McIntyre, and all present voted aye. Vice Mayor Heraty moved that Bill 234 be amended as follows: That we increase the number of police officers from 20 to 21 and decrease the number of dispatchers by _ 1. The motion was seconded by Councilman Greeley and all present voted aye. Thereafter Council voted on the main motion which passed unanimously. Therefore, Bill No. 234 was adopted as amended as Ordinance No. 15-75. On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, proposed Resolution No. 52-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO A CONTRACT WITH GULF OIL COMPANY FOR THE PURCHASE OF PETROLEUM PRODUCTS was read in full and adopted as read as Resolution No. 52-75. Councilman Marks moved that proposed Resolution No. 53-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO A CONTRACT WITH PINKER, INC., A FLORIDA CORPORATION, FOR THE PURCHASE OF THAT CERTAIN PARCEL OF LAND IN THE VILLAGE OF NORTH PALM BEACH KNOWN AS "ANCHORAGE PARK" be adopted as read. The motion was seconded by Council- man Greeley. Councilman McIntyre moved that we table proposed Resolu- tion No. 53-75 until Monday, September 29, 1975.- The motion died for lack of a second. Thereafter Council voted on the main motion which passed 3 to 2, with Mayor Love and Councilman McIntyre opposed. Therefore proposed Resolution No. 53-75 was adopted as read as Resolution No. 53-75. Councilman Marks moved that proposed Resolution No. ' S~F-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF ROSS PRODUCTS, INC, FOR 60 3-WHEEL ELECTRIC GOLF CARTS IN THE AMOUNT OF $61,740 be adopted as read. The motion was seconded by Council- man Greeley. The 54-75 TABLED motion was seconded by Councilman McIntyre and all UNTIL 10/9/75 present voted aye. ' Thereafter Council voted on the main motion which failed ,-MAIN MOTION 5-0. Therefore, proposed Resolution No. 54-75 was not FAILED 5-0 adopted. On motion of Councilman Marks, seconded by Councilman RES. 54-75 Greeley, all present voting aye, proposed Resolution ADOPTED No. 54-75 entitled: A RESOLUTION AUTHORIZING THE ACQUISITION OF -.- RECREATIONAL EQUIPMENT FOR THE GOLF COURSE OF THE VILIAG€ OF NORTH PALM BEACH, FLORIDA; PRO- VIDING FOR THE ISSUANCE OF NOT EXCEEDING $210,000 IMPROVEMENT REVENUE BONDS, SERIES 1975 OF SUCH VILLAGE TO PAY THE COST OF SUCH PROJECT; PROVIDING FOR THE RIGHTS OF THE HOLDERS OF SUCH BONDS; PRO- VIDING FOR THE PAYMENT THEROF; AND MAKING CERTAIN -- OTHER COVENANTS AND AGREEMENTS IN CONNECTION WITH THE ISSUANCE OF SUCH BONDS was read in full and adopted as read Resolution No. 54-75. Vice Mayor Heraty moved that we award the bid to Simgo BrD FOR 4 Corporation, as the lowest and best bidder, for:-four TENNIS COURTS tennis courts in the amount of $17,995.00. The motion AWARDED TO ' was seconded by Councilman McIntyre and passed 4 to 1, SIMGO CORP. with Councilman Greeley opposed. On motion of Vice Mayor Heraty, seconded by Councilman TRANSFER OF Marks, all present voting aye, that we authorize the FUNDS FROM CC transfer of $1,341.86 from the Country Club Revenue REV. FUND TO Fund to the Reserve Operation Fund. R.O.F. On motion of Councilman McIntyre, seconded by Councilman Marks, all present voting aye, that we instruct Mr. Gildan to take the message back that North Palm Beach would like to loin the petition for setting a time schedule to complete the water and sewer improvements.
