Walker, Village Clerk Mayor Love called the Regular Meeting to order at 8:00 ROLL CALL p.m. All members of the Council were present. Councilman Marks gave the invocation and Councilman INVOCATION Greeley led the Council and the public in the Pledge of & PLEDGE OF Allegiance to the Flag. ALLEGIANCE On motion of Vice Mayor Heraty, seconded by Councilman APPROVAL OF McIntyre, all present voting aye, the minutes of Regular MINUTES Meeting held Thursday, May 22, 1975 were approved as. written. Mayor Love, on behalf of the Village Council, presented PRESENTATION Certificates of Appreciation to past members of various OF CERTIFICATES Village .Advisory Boards. The Certificates will be mailed OF APPRECIATION to those. persons who were not present at-this meeting to receive them. On motion of Vice Mayor Heraty, seconded by Councilman Marks, all present voting aye, the following minutes were accepted by the Council: Minutes of Regular Meeting of Planning and Zoning Advisory Board held May 14, 1975 Minutes of Special Meeting of Planning and Zoning Advisory Board held May 21, 1975 Minutes of Beautification Committee Meeting held May 27, 1975 Minutes of Regular Meeting of Community Appearance Board held June 3, 1975 Minutes of Tennis Advisory Board Meeting held June 3, 1975 On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, Council approved the recommendation of the Tennis Advisory Board, made in their meeting of June 3, 1975, to redefine family membership of the tennis club t_o be the same as family membership of the country club; and that junior member- ship be changed from 16 to 17 years old, to be effective immediately upon approval of the Council. Bill No. 223 was advertised in the Palm Beach Post on May 15, 1975. On motion of Councilman Marks, seconded by Councilman McIntyre, all present voting aye, Bill, No. 223 entitled: AN ORDINANCE OF THE VILLPG E OF NORTH PALM BEACH, FLORIDA, CREATING CHAPTER 22 (NOISE CONTROL) OF THE VILLAGE OF NORTH PALM BEACH CODE; PROVIDING FOR NOISE CONTROL AND ABATEMENT; ESTABLISHING A NOISE CONTROL POLICY; PROVIDING DEFINITIONS; MAKING IT UNLAWFUL TO MAKE EXCESSIVE NOISE FROM HORNS; RESTRICTING NOISE FROM RADIO, ELECTRONIC EQUIPMENT; RESTRICTING LOUDSPEAKERS FOR USE IN ADVERTISING DECLARING NOISE AND BOISTEROUS CONDUCT UNLAWFUL; RESTRICTING ANIMAL NOISES; REQUIRING MUFFLERS ON ENGINES; DECLARING NOISY VEHICLES UNLAWFUL; DECLARING LOADING AND UNLOADING NOISES TO BE UN- LAWFUL; RESTRICTING THE TIME FOR CONSTRUCTION ACTIVITY; RELATING FANS AND AIR CONDITIONERS WITH REGARD TO NOISE, PLACEMENT ON THE BUILDING SITE AND SOUND CERTIFICATION RATINGS; PROVIDING PROCEDURES FOR MEASURING SOUND LEVELS; ESTABLISHING AN ENFORCE- MENT PROGRAM AND THE REQUISITES FOR VIOLATIONS HEREOF; ESTABLISHING NOISE CONTROL MEASUREMENT STANDARDS; PROVIDING FOR A PENALTY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PRO- VIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES was placed on second reading and read by title alone. Vice. Mayor Heraty moved to adopt Bill No. 223 as Ordinance No. 5-75. The motion was seconded by Councilman Marks. Councilman Marks moved to amend Bill No.-223 as follows: To change the time on Sundays from 12 Noon to 8:00 p.m. rather than 12 Noon to 6:00 p.m. The motion was seconded by Vice Mayor Heraty and passed 4 to 1, with Councilman McIntyre opposed. Thereafter Council voted on the main motion which passed unanimously. Therefore, Bill No. 223 was adopt- ed as amended as Ordinance No. 5-75. Bill No. 224 was advertised in the Palm Beach Post on May 15, 1975. On motion of Councilman Greeley, seconded by Vice Mayor Heraty, all present voting aye, Bill No. 224 entitled: KIMLEY-HORN SYNCHRONIZATION STUDY TABLED BILL 223 PLACED ON 2ND READING MOTION TO ADOPT BILL 223 AS ORD. 5-75: BILL N0. 223 AMENDED BILL-223 ADOPTED AS AMENDED AS ORD. 5-75 BILL 224 PLACED ON 2ND READING Minutes of Regular Meeting Held Thursday, June 12, 1975 Page 3 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REgUIRING GARBAGE CONTAINERS AT MULTI- --- FAMILY RESIDENTIAL UNIT LOCATIONS TO BE DUMPSTER- TYPE CONTAINERS WHICH CAN BE UTILIZED BY THE VILLAGE GARBAGE COLLECTION UNITS; MAKING EXCEPTIONS THERETO FOR EXISTING NON-CONFORMING MULTI-FAMILY UNITS was placed on second reading and read by title alone. ORD. 6-75 On motion of Councilman Greeley, seconded by Vice Mayor BILL 226 Heraty, all present voting aye, Bill No. 226 entitled= PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING THE SOUTHERN STANDARD HOUSING CODE AS THE HOUSING CODE FOR THE VILLAGE OF NORTH PALM -- BEACH AND SETTING FORTH AMENDMENTS THERETO was placed on first reading and read by title alone. On motion of Vice Mayor Heraty, seconded by Councilman BILL 227 Marks, all present voting aye, Bill No. 227 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 28 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE PLUMBING CODE FOR THE ' VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD PLUMBING CODE, 1975 EDITION AND APPENDIX A AND APPENDIX B THERETO, AND SETTING FORTH AMEND- MENTS TO SAID STANDARD PLUMBING CODE was placed on first reading and read by title alone. Colbath, Jr. be placed on proposed Resolution No. RES. 33-75 33-75. On motion of Councilman Greeley, seconded by Councilman Marks, all present voting aye, that the name of Rett _ Miller be placed on proposed Resolution No. 33-75. On motion of Councilman McIntyre, seconded by Vice Mayor Heraty - 4 to 1, with Councilman Greeley opposed - - that the name of George Finney be placed on proposed Resolution No. 33-75. On motion of Vice Mayor Heraty, seconded by Councilman Marks - 3 to 2, with Mayor Love and Councilman Greeley opposed - that the name of Ray Parker be placed on proposed Resolution No. 33-75. On motion of Councilman Greeley, seconded by Councilman McIntyre - 3 to 2, with Vice Mayor Heraty and Councilman Marks opposed - that the name of Ruth Brown be placed on proposed Resolution No. 33-75. On motion of Councilman Marks, seconded by Councilman McIntyre, all present voting aye, that the name of William Mcllvaine be placed on proposed Resolution No. 33-75. On motion of Councilman Marks, seconded by Councilman McIntyre - 4 to 1, with Councilman Greeley opposed - proposed Resolution No. 33-75 entitled: RES. 33-75 _ ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE NORTH PALM BEACH COUNTRY CLUB ADVISORY BOARD u was read in full and adopted as_read as Resolution No. 33-75. On motion of Councilman Greeley, seconded by Vice Mayor Heraty, all present voting aye, proposed Resolution No. 34-75 entitled: RES. 34-75 ADOPTED A RESOLUTION OF-THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF ZAMBELLI FIREWORKS MANUFACTURING COMPANY, INC. FOR FIREWORKS IN THE AMOUNT OF $2,500.00 1 was read in full and adopted as-read as Resolution No. 34-75. Councilman Marks moved to table the pedestrian bridge across the Earman River. The motion was seconded by Councilman McIntyre. The motion failed 3 to 2, with Mayor Love, Vice Mayor Heraty and Councilman Greeley opposed. On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, that we reject the bids for the pedestrian bridge across the Earman River. On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, proposed Resolution No. 35-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF SIMGO CORPORATI FOR RECREATIONAL FACILITIES - TENNIS COURTS - IN THE AMOUNT OF $21,312.00- was read in full and adopted as read as Resolution No. 35-75. On motion of Councilman Greeley, seconded by Vice Mayor Heraty, all present voting aye, that we reject Items 5 through 8 of the bid for recreational facilities at Anchorage Park_ MOTION TO TABLE PEDES- TRIAN BRIDGE FAILED BIDS FOR PEDES- TRIAN BRIDGE REJECTED RES. 35-75 ADOPTED ITEMS 5 THROUGH 8 OF BID RE- JECTED 1 i i Minutes of Regular Meeting Held Thursday, June 12, 1975 Page 5 On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, that we authorize the Village Manager to call for bids on_two International Cab and Chassis units for garbage trucks. On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, that we authorize the Village Manager to give a pay increase of 5% to sworn police and fire personnel, to be- effective July 1, 1975. On motion of Councilman Greeley, seconded by Vice Mayor Heraty, all present voting aye, that we immediately go to bid on golf carts and finance them from other funds. Councilman Marks was out of the room when this motion was voted on. On motion of Vice Mayor Heraty, seconded by Councilman McIntyre, all present voting aye, that we authorize the Village Manager to go to bid on specifications for the Emergency Medical Rescue Unit vehicle.
