Walker, Village Clerk Mayor Love called the Regular Meeting to order at 8:00 ROLL CALL p.m. All members of the Council were present. Mayor Love gave the invocation and Councilman Marks INVOCATION & led the Council and the public in the Pledge o£ Allegiance PLEDGE OF to the Flag. - ALLEGIANCE On motion of Councilman Marks, seconded by Councilman APPROVAL OF McIntyre, all present voting aye, the minutes of Regular MINUTES Meeting held Thursday, June 12, 1975; and the minutes of Regular Meeting held Thursday, June 26, 1975 were approved as written. ' Mayor Love read the Proclamation on "Walk Against Muscular PROCLAMATION Dystrophy DayT~ relative to a Walk-A-Thon against dystrophy ON "WALK-AGAINST to benefit the Muscular Dystrophy Association, Inc. which - MUSCULAR DYS- will take place on Sunday, July 13, 1975. TROPHY' DAY" Mr John McFadden gave a presention to the Village Council on fire detection units and their benefits. On motion of Councilman McIntyre, seconded by Councilman Greeley, all present voting aye, the following minutes were accepted by the Council: Minutes of Recreation Advisory Board meeting held June 10, 1975 Minutes of Regular Meeting of Planning and Zoning Advisory Board held June 11, 1975 Minutes of Special Meeting of Tennis Advisory Board held June 17, 1975 Minutes of North Palm Beach Library Board meeting held June 17, 1975 Minutes of North Palm Beach Country Club Advisory Board meeting held June 18, 1975 Minutes of Beautification Committee meeting held June 24, 1975 PRESENTATION ON FIRE DETEC- TION UNITS ACCEPTANCE OF MINUTES Minutes of Regular Meeting o_f Community Appearance Board held July 1, 1975 Minutes of Regular Meeting Held Thursday, July 10, 1975 Page 2 1 1 1 On motion of Councilman McIntyre, seconded by Councilman P & Z AD. BD. Marks - 3 to 2, with Vice Mayor Heraty and Councilman RECOMMENDATION Greeley opposed - that the Council direct the Village APPROVED Attorney to prepare_an ordinance in accordance with the ' recommendation of the Planning and Zoning Advisory Board contained in the minutes of their Special Meeting held May 21, 1975. Vice Mayor Heraty moved to amend the previous motion MOTION DIED as follows: That all land in the Village have a height FO_R LACK OF limitation of six stories except that area which lies North A SECOND and East of the Intracoastal Waterway and West of the Western Bulkhead Line of Lake Worth. The motion died for lack of a second. Concerning the recommendations contained in the minutes of the Recreation Advisory Board meeting held June 10,- 1975, Vice Mayor Heraty moved that the Recreation De- partment put these items in their budget for capital improvements for the next fiscal year. The motion was seconded by Councilman Greeley and all present voted aye. On motion of Vice Mayor Heraty, seconded by Councilman Marks, all present voting aye, Council approved the recommendation of the Tennis Advisory Board that the giving of tennis lessons at the tennis club be re- stricted to the Tennis Pro or his assistant, and that any other instruction must have the approval of the Tennis Pro. Concerning the recommendation of the Tennis Advisory Board that the Council consider relocating the budgeted tennis and paddle ball courts to the property now under lease at Anchorage Park, Councilman McIntyre moved that we proceed with the feasibility of relocating all budgeted items from their previous drawings within the Anchorage_Park leased area: The motion was seconded by Vice Mayor Heraty and all present voted aye. Concerning the recommendation of the Tennis Advisory Board that the Council consider resurfacing the ex- isting six tennis courts at the North Palm Beach Country Club, Councilman Marks moved that we author- ize the Village Manager to go out to bid on re- surfacing-the two northernmost courts at the Club. The motion was seconded by Vice Mayor Heraty and all present voted aye. REC. AD. BD. RECOMMENDATION TO BE PLACED IN RECREATION BUDGET FOR -NEXT FISCAL YEAR TENNIS AD. BD. RECOMMENDATION APPROVED COUNCIL TO E'RO- CEED WITH FEAS- IBILITY OF RE- LOCATING TENNIS & PADDLE BALL COURTS AT AN- CHORAGE -PARK MANAGER AUTHOR- ---- IZED TO GO TO BID ON RESUR- FACING 2 NORTH- - ERNMOST TEI~INIS COURTS AT NPBCC Concerning the recommendation of the North Palm Beach Country Club Advisory-Board that a $10 minimum a month, paid quarterly, for club memberships, excluding social, be levied in the food and beverage area, Councilman Greeley moved that this recommendation be tabled until budget sessions. The motion was seconded by Vice Mayor Heraty and all present voted aye. Concerning the recommendation of the Community Appear- ance Board that funds be appropriated in the fiscal 1975-76 Village budget to provide for a landscape consultant to be retained by the Village Manager to assist various Department Heads, Vice Mayor Heraty moved that this recommendation be denied. The. motion was seconded by Councilman Greeley and passed 4 to 1, Councilman McIntyre opposed. NPBCC AD. BD. RECOMMENDATION TABLED UNTIL BUDGET SESSIONS C~IUNITY APPEARANCE BD. RECOMMENDA- TION DENIED with Minutes of Regular Meeting Held Thursday, July 10, 1975 Page 3 1 The meeting was recessed at 9:30 p.m. and was reconvened at 9:35 p.m. Bill No. 225 was advertised in the Palm Beach Post on June ~F, 1975. On motion of Councilman Greeley, seconded by Councilman McIntyre, all present voting aye, Bill No.-225 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SETTING FORTH THE PLANNED USE OF FUNDS RECEIVED UNDER THE STATE AND LOCAL FISCAL ASSISTANCE ACT OF 1972, INCLUDING AN ESTIMATE OF INCOME TO BE RECEIVED AND THE SPECIFIC AMOUNTS AND PURPOSES FOR WHICH THE VILLAGE INTENDS TO SPEND THE FUNDS WHICH IT EXPECTS TO RECEIVE FOR THE SIXTH ENTITLEMENT PERIOD ENDING JUNE 30, 1976 was placed on second reading and read by title alone. On motion of Councilman Greeley, seconded by Councilman McIntyre, all present voting aye, Bill No. 225 was adopted as Ordinance No. 7-75. Bill No. 226 was advertised in the Palm Beach Post on June 20, 1975. On motion of Councilman Greeley, seconded by Councilman Marks, all present voting aye, Bill No. 226 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING THE SOUTHERN STANDARD HOUSING CODE AS THE HOUSING CODE FOR THE VILLAGE OF NORTH PALM BEACH AND SETTING FORTH AMENDMENTS THERETO was placed on second reading and read by title alone. On motion of Councilman Greeley, seconded by Vice Mayor Heraty, all present voting aye, Bill No. 226 was adopted as Ordinance No. 8-75. Bill No. 227 was advertised in the Palm Beach Post on June 20, 1975. On motion of Councilman Marks, seconded by Councilman McIntyre, all present voting aye, Bill No. 227 entitled RECESS BILL 225 PLACED QN 2ND READING BILL 225 ADOPTED AS ORD. 7-75 BILL 226-- PLACED ON 2ND READING -BILL 226 ADOPTED AS ORD. 8-75 BILL 227 PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 28 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE PLUMBING CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD PLUMBING CODE, 1975 EDITION AND APPENDIX A AND APPENDIX B THERETO, AND SETTING FORTH AMENDMENTS TO SAID STANDARD PLUMBING _ CODE 1 was placed on second reading and read by title alone. ORD. 9-75 Minutes of Regular Meeting Held Thursday, July 10, 1975 __ Page 4 Bill No. 228 was advertised in the Palm Beach Post on June 20, 1975 On motion of Councilman Marks, seconded by Councilman BILL'228 Greeley, all present voting aye, Bill No. 228 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE BUILDING CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD BUILDING CODE, 1975 EDITION, INCLUDING APPENDICES A, B, C, E, F, H AND J THERETO, AND SETTING FORTH AMENDMENTS TO SAID STANDARD BUILDING CODE was placed on second reading and read by title alone. Councilman McIntyre moved that Bill No. 228 be adopted as MOTION TO Ordinance No. 10-75. The motion was seconded by Councilman ADOPT BILL 228 Marks. AS ORD. 10-75 Vice Mayor Heraty moved to amend Bill No. 228 as follows: AMENDMENT TO To delete Section 1127 of the proposed Village of North BILL 228 Palm Beach amendments to the Standard Building Code. -- The motion was seconded by Councilman Greeley and passed 3 to 2, with Councilman Marks and Councilman McIntyre _ opposed. Councilman Marks moved to amend Bill No. 228 as follows: AMENDMENT TO That Section 1127 of the Standard Building Code be amended- BILL 228 ' to read: Every new dwelling and every new dwelling unit within a hotel, apartment house, condominium and townhouse and every basement or cellar within such building shall be provided with an approved listed detector, sensing visible or invisible particles or combustion, installed in accordance with the manufacturer's recommendation and listing. when actuated the detector shall provide an audible alarm. The motion was seconded by Vice Mayor Heraty and all present voted aye. Councilman McIntyre moved to amend Bill No. 228 as follows: AMENDMENT TO To delete paragraphs one and two of Section 518 (a) of the BILL 228 Standard Building Code and substituse the following: These requirements shall apply to all apartment houses, hotels, and office buildings having floors used for human occupancy located more than 50 feet above the average grade. Such buildings more than 50 feet in height shall__be pro- vided with a complete automatic sprinkler system con- forming to the requirements of this section. The motion was seconded by Councilman Marks and all present voted aye. Mr. C. R. O'Meilia, Building Official, recommended that BUILDING Section 106.3 of the Standard Building Code be adopted OI`I"ICIAL~S as proposed. A SECOND Minutes of Regular Meeting Held Thursday, July 10, 1975 Page 5 1 fl Vice Mayor Heraty moved to amend Bill No. 22S as follows: AMENDMENT TO In Section 106.3, Conditions of the Permit, delete exist- BILL 228 ing paragraph and rewrite as follows: (a) Every permit issued by the Director of Public Services under the provisions of this Section shall expire by limitation and become null and void if the work authorized by such permit is not commenced within 90 days from the date of such permit, or if work authorized by such permit is suspended or abandoned at any time after the work is commenced, for a period of 60 days. Work shall not be deemed to have started or shall be deemed to have been suspended when such work is being done intermittently. The motion was seconded by Councilman Greeley and all present voted aye. Thereafter Council voted on the main motion which passed unanimously. Therefore, Bill No. 228 was adopted as amended as Ordinance No_ 10-75. On motion of Vice Mayor Heraty, seconded by Councilman Marks - 3 to 2, with Mayor Love and Councilman Greeley opposed - proposed Resolution No._ 36-75 entitled:, A RESOLUTION OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE VILLAGE OF NORTH PALM BEACH PERSONNEL MANUAL was read in full and adopted as read as Resolution No. 36-75. On motion of Vice Mayor Heraty, seconded by Councilman Greeley, all present voting aye, proposed Resolution No. 37-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF RICH MOTORS, INC. FOR TWO TRUCK CAB AND CHASSIS FOR PACKER TRUCKS IN THE AMOUNT OF $32,600.00 1 was read in-full and adopted as read as Resolution No. 37-75. On motion of Councilman Marks, seconded by Vice Mayor Heraty - 4 to 1, with Mayor Love opposed - proposed Resolution No. 38-75 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING THE BID OF CUSTOM AM- BULANCES OF FLORIDA, INC. FOR EMERGENCY MEDICAL RESCUE UNIT VEHICLE IN THE AMOUNT OF $19,969.95 was read in full and adopted as read as Resolution No. 38-75. Mayor Love instructed the Village Clerk to include the following statement for the record in the minutes of this meeting: BILL 228 ADOPTED AS AMENDED AS ORD. 10-75 RES. 36-75 ADOPTED RES. 37-75 _.I ADOPTED RES. 38-75 ADOFTED MAi'OR LOVE'S .STATEMENT FOR THE RECORD Minutes of Regular Meeting Held Thursday, July 10, 1975 Page 6 ~__ I cannot support continuation of this project at_the present time because: 1. During a period of declining economy and inflation, ' a new expensive service for the Village can place extreme hardships upon fixed income, low income or unemployed residents. 2. The proposed vehicle is not the one recommended by our Director of Public Safety and the committee appointed to determine the needs of the Village and recommend a program to the Council. 3. The County Commission is in favor of providing this type service for the County in the near future. We could pay double taxes for this service if the Village and the County both provide rescue vehicle service. 4. The possible liability due to negligence or judgment of operating personnel has not been defined. 5. I have heard nothing but praise for the emergency assistance given by our Department of Public Safety and the Inter-City First Aid Squad. I have heard no complaints for lack of service. 1 1 6. I realize that all life is priceless and would like to prohibit all deaths in the Village due to non- natural causes. We know .this is not possible and we are charged to provide services within the means of all residents.
