09-14-1972 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 14, 1972 Present: H. Mallory Privett, Jr., Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Robert F. Slater, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Absent: Thomas B_ Rhodes, Councilman Mayor Privett called the Regular Meeting to order at 9:05 ROLL CALL p.m, and asked_ the-Clerk to call the roll, all members being present=except Councilman Rhodes. Councilman Martin gave the invocation and Vice Mayor Cadby INVOCATION led the Council and_-the public in the Pledge o£ Allegiance & PLEDGE OF to the Flag. ALLEGIANCE On motion of Vice Mayor Cadby, seconded by Councilman APPROVAL OF Martin, all present voting aye, the minutes of Regular MINUTES Meeting held Thursday, August 24, 1972 were approved. _ as written. On motion of Vice Mayor Cadby, seconded by Councilman ACCEPTANCE Martin, all present voting aye, the following minutes OF MINUTES were accepted by the Council: Minutes of Board of Governors Meeting held August 23, 1972 Minutes of Special Meeting of Board of. Governors-held August 30, 1972 Minutes of Special Meeting of Board of Governors held September 6, 1972 Minutes of Beautification Committee Meeting held August 23, 1972 Minutes of Community Appearance Board Meeting held August 29, 1972 Minutes of Recreation Advisory Board Meeting held September 5, 1972 On motion of Vice Mayor Cadby, seconded by Councilman PAYD4ENT OF Martin, all present voting aye, that the payment o£ the P.B. CTY. Palm Beach County Municipal League dues in the amount of MUN. LEAGUE $200.00 for the 1972-73 fiscal year be authorized. DUES AUTHOR- I ZED ' On motion of Vice Mayor Cadby, seconded by Councilman BILL 165 Martin, all present voting aye, Bill No. 165 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING BY REFERENCE THERETO. THE SOUTHERN STANDARD PLUMBING CODE, 1971 EDITION WITH THE 1972 REVISION THERETO, INCLUDING APPENDIX A THERETO, TOGETHER WITH AMENIkMENTS, CORRECTIONS AND ADDITIONS THERETO was placed on second reading and read by title alone. The motion was seconded by ADOPT BILL Councilman Martin. 165 AS ORD. Vice Mayor Cadby moved that Bill 165 be amended-by 18-72 BILL 165 adding subsection (2) a s follows: AMENDED Section 506.7 of Appendix A is amended to read as follows: For plumbing drainage, waste and vents, both above and below ground, indirect waste and storm drains in all buildings up to and including three stories and/or thirty-,six (36) __ feet in height. The motion was seconded by Councilman Martin, and all presented voted aye. Thereafter Council voted on the main motion which passed BILL 165 4-0. Therefore, Bill No. 165 was adopted as amended as ADOPTED AS Ordinance No. 18-72. AMENDED AS ORD. 18-72 On motion of Vice Mayor Cadby, seconded by Councilman BILL 166 Slater, all present voting aye, Bill No. 166 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING SECTION 45-31(I)(1 ,2 ,3) OF THE VILLAGE OF NORTH PALM BEACH CODE, BY REPEALING LANDSCAPING REQUIREMENTS UNDER THE C-A ZONE FROM THE ZONING CODE AND PLACING C-A ZONE LANDSCAPING REQUIREMENTS UNDER THE GENERAL LANDSCAPING .SECTIONS OF THE CODE was placed on second reading and read by title alone. On motion of Vice Mayor Cadby, seconded by Councilman BILL 166 Slater, all present voting aye, Bi]1 No. 166 was adopted ADOPTED AS as Ordinance No. 19-72. ORD. 19-72 On motion of Vice Mayor Cadby, seconded by Councilman CONSIDERATION Martin, all present voting aye, that we postpone OF BILL 167 consideration of Bill No. 167 for two weeks. POSTPONED On motion of Vice Mayor Cadby, seconded by Councilman BILL 168 Martin, all present voting aye, Bill No. 168 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REQUIRING BUILDINGS TO BE SET BACK A MINIMUM OF FIFTY FEET FROM THE DUNE LINE OR A MINIMUM OF ONE HUNDRED FEET FROM THE HIGHWATER MARK, WHICHEVER DISTANCE IS GREATER, FOR ALL PROPERTY BORDERING ON THE ATLANTIC OCEAN was placed on first reading and read in full. On motion of Vice Mayor Cadby, seconded by Councilman BILL 169 Martin, all present voting aye, Bill No. 169 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 10 OF THE VILLAGE OF NORTH PALM BEACH CODE, BY AMENDING REQUIREMENTS FOR CON- TRACTORS TO MAINTAIN SURETY BOND, PUBLIC LIABILITY INSURANCE AND PUBLIC PROPERTY DAMAGE INSURANCE was placed on first reading and read in fu_11. On motion of Vice Mayor Cadby, seconded by Councilman RES. 34-72 Slater, all present voting aye, proposed Resolution ADOPTED No. 34-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF. NORTH PALM BEACH, FLORIDA, ACCEPTING THE DEDICATION OF AN ALLEY IN THE REAR OF LOTS 24, 25 AND 26, RE PLAT OF A PORTION OF THE MARINA ADDITION TO THE VILLAGE OF NORTH PALM BEACH, AND SETTING FORTH RESERVATIONS THERETO was read in full and adopted as read as Resolution No. 34-72. On motion of Vice Mayor Cadby, seconded by Councilman RES. 35-72 Martin, all present voting aye, proposed Resolution No. ADOPTED 35-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF. NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN ABANDONMENT OF EASEMENT IN ' LOT 5, BLOCK 38, PLAT N0. 3 OF THE VILLAGE OF NORTH PALM BEACH, PLAT BOOK 25, PAGE 176 was read in full and adopted as read as Resolution No. 35-72. On motion of Vice Mayor Cadby, seconded by Councilman- -RES. 36-72 Martin, all present voting aye, proposed Resolution ADOPTED No. 36-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF: NORTH PAIM BEACH, FLORIDA, ACCEPTING PLAT IMPROVEMENTS AT CROMWELL ESTATES ADDITION TO THE VILLAGE OF NORTH PALM BEACH FOR MAINTENANCE BY THE VILLAGE OF NORTH PALM BEACH Minutes of Regular Meeting Held Thursday, September 14, 1972 Page tE u was read in full and adopted as read as Resolution No. 36-72. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, proposed Resolution No. 37-72 entitled: RES. 37-72 ADOPTED u A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBER TO THE NORTH PALM BEACH COUNTRY CLUB BOARD OF GOVERNORS TO FILL THE UNEXPIRED TERM OF WILLIAM GREELEY, WHO RESIGNED . was read in full and adopted as read as Resolution No. 37-72. Vice Mayor Cadby moved that a contract be awarded to MOTION TO Service Specialty Company,-Juno, Florida, in the amount AWARD PAINTING of $7,138.00 to paint the exteriors of the Village Hall, CONTRACT the Library and the Old Country Club Building in accordance with the bid specifications. The motion was seconded by Councilman Slater. Vice Mayor Cadby moved that the motion be amended as follows: which includes $238.00 over the total budget- ed amount. The motion was seconded by Councilman Slater and all present voted aye. Thereafter Council voted on the main motion. which passed 4-0. There being no further business to come before the Council, on motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the meeting was adjourned at 10:30 p.m. Minutes recorded by: Dolores R.
