07-13-1972 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JULY 13, 1972 Present: H. Mallory Privett, Jr., Mayor ' Ronald B. Cadby, Vice Mayor _ Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman Herbert L. Gildan, Village Attorney Lawrence :J. Robbins, Village Manager Dolores R. Walker, Village Clerk Mayor Privett called the Regular Meeting to order at 9:05 p.m. and asked-the Clerk to call-the roll, all members being present. Mayor Privett gave-the invocation and Councilman Martin led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the minutes of Regular Meeting held Thursiiay; June 22,-1972 were approved as -~ written. On motion of Vice. Mayor Cadby, seconded by Councilman ' Rhodes, all present voting aye, that we drop all items listed on the agenda under Petitions and Communications until the end of the agenda. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 160 entitled: AN ORDINANCE OF THE VILLAGE OP NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE, IT BEING THE ZONING CODE OF THE VILLAGE, BY REPEALING SECTION 45-31(K), WHICH REGULATED SIGNS IN THE C-A CONll"IERCTAr, DISTRICT was placed on second reading and read in full. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 160 was adopted as Ordinance No. 13-72. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 158. entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 34 OF THE VILLAGE OF NORTH PALM BEACH CODE BY AMENDING COMPLETELY THE ' CODE PROVISIONS CONCERNING SIGNS IN THE VILLAGE OF NORTH PALM BEACH was placed on second reading and read by title alone. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, Bill No. 158 was adopted as Ordinance No. 14-72. ROLL CALL INVOCATION & PLEDGE OF ALLEGL?~NCE 6/22/72 - MINUTES APPROVED - AGENDA MODIFIED BILL 160 PLACED ON 2ND READING BILL 160 ADOPTED AS ORD. 13-72 B 1Z,L 15 8 PLACED ON 2ND READING BILL 158 ADOPTED AS ORD. 14-72 Minutes of Regular Meeting Held Thursday, July 13, 1972 Page 2 Vice Mayor Cadby moved that Bill No. 159 entitled: MOTION TO PLACE AN ORDINANCE OF SHE VILLAGE OF NORTH PALM BEACH, BILL 159 FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF ON 2ND ' NORTH PALM BEACH CODE, BY AMENDING THE REAR AND READING SIDE YARD SETBACK REGULATIONS IN ZONING DISTRICT C-1 TO REQUIRE SINGLE FAMILY AND MULTIPLE FAMILY RESIDENTIAL DWELLING STRUCTURES TO HAVE fiHEE SAME YARD SPACE REGULATIONS AS IS REQUIRED IN ZONING DISTRICT R-1 AND R-3, RESPECTIVELY be placed on second reading and read in full. POSTPONED On motion of Vice Mayor Cadby, seconded by Councilman BILL 161 Martin - 4 to 1, Councilman Slater opposed --Bill No. PLACED ON 161 entitled: 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH-CODE, IT BEING THE ZONING CODE, BY PROHIBITING THE LOCATION OF RESTAURANTS WITHIN 650 FEET OF ANOTHER RESTAURANT IN THE VILLAGE ' was placed on first reading and read in full. The following attorneys, representing various present OPPOSITION restaurant owners and owners of vacant property where TO BILL 161 restaurants are planned, spoke in opposition,to Bill No. 161: Mr. Luther Taylor Mr. Wade Byrd Mr. Francis T. Ryan Mr. Eugene F. Bie Mr. Clair Andersen Mr. Luther Taylor read a letter dated July 10, 1972 from H. P. Collins and L. K. Collins, owners .of property on U. S. Highway No. 1 in the Village, objecting to -- Bill No. 161. This letter was addressed to the Village Council. Mrs. Rhoda Cole, the owner of vacant property, which would be affected by the distance limitation on restaurants, _ objected to Bill No. 161. On motion of Vice Mayor Cadby, seconded by Councilman MOTION TO Rhodes, all present voting aye, that we postpone setting POSTPONE ' of the Public Hearing for Bill No. 161 until our workshop meeting of August 17, 1972. HEARING ON BILL 161 On motion of Vice Mayor Cadby, seconded by Councilman BILL 162 Martin, all present voting aye, Bill No. 162 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY AMENDING BUILDING HEIGHT REGULATIONS, BUILDING AREA REGULATIONS, YARD SPACE REGULATIONS, OFF-STREET PARKING REGULATIONS AND FLOOR AREA REGU- LATIONS IN THE C-2 ZONING DISTRICT BY IMPOSING THE REGULATIONS APPLICABLE IN ZONING DISTRICT C-1 was placed on first reading and read in full.
