12-28-1972 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, DECEMBER 28, 1972 Present: H. Mallory Privett, Jr., Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Mayor Privett called. the Regular Meeting to order at 8:02 P.M. and asked the 'Clerk to call the roll, all members being present. Councilman Martin gave the invocation and Vice Mayor Cadby led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Vice Mayor Cadby, seconded by;Councilman Martin, all present voting aye, the minutes of Regular Meeting held Thursday, December 14, 1972 were approved as written. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the minutes of Board of Governors meeting held November 15, 1972 were accepted. Councilman Martin left the meeting to make a telephone call at 8:40 p.m. On motion of Councilman Slater, seconded by Councilman Rhodes, all present voting aye, Bill No. 173 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SETTING FORTH LANDSCAPING REQ~7IREMENTS £OR CERTAIN YARD AREAS, OFF-STREET PARKING AND OTHER VEHICULAR USE AREAS FOR NON-RESIbENTIAL PROP- ERTIES WHICH WERE IMPROVED PRIOR TO THE ADOPTION OF ORDINANCE N0. 14-71 ENACTED ON SEPTEMBER 23, 1971 1 was placed on second reading and_read by title alone. Councilman Slater moved that Bill No. 173 be adopted as Ordinance No. 27-92. The motion was seconded by Councilman Rhodes. Councilman Slater moved that subparagraph (2) o.f Bill No. 173 be stricken and that the following words be substituted: ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES ACCEPTANCE OF ' MINUTES BILL 173 PLACED ON 2ND READING MOTION TO ADOPT BILL 173 AS ORD. 27-72 BILL 173 AMENDED (2) Landscaping Requirements. Except ,as provided hereafter, the provisions of Sections 41-18 through 41-20, both inclusive, of this Code shall apply to all non-residential property which was improved prior to the adoption of Ordinance No. 14-71, which adopted Code Sections 41-18 through 41-20, both inclusive, of the \7illage of North Palm Beach Code. The motion was seconded by Councilman Rhodes and all present voted aye. Therefore, Bill No. 173 was adopted as amended as Ordinance No. 27-72. ' Councilman Martin returned to the meeting. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, proposed Resolution No. 46-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING AN ADDITIONAL JUDGE AD LITEM FOR THE MUNICIPAL COURT OF THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as read as Resolution No. 46-72. On motion of Vice Mayor Cadby, seconded by; Councilman Rhodes, all present voting aye, proposed Resolution No. 47-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, CONCERNING A PETITION.. TO CHANGE THE BOUNDARIES BETWEEN THE VILLAGE OF NORTH PALM BEACH AND THE TOWN OF LAKE PARK ON NORTHLAK$ BOULEVARD was read in full and. adopted as mead as Resolution No. 47-72. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, proposed Resolution No. 48-72 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO EMPLOY THE LAW FIRM OF NASON, GILDAN & YEAGER, P.A. TO REPRESENT THE DEFENDANTS, ZONING BOARD OF ADJUSTMENT OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ET AL., IN THAT CERTAIN CAUSE FILED BY ESTON E. MULLINEX AND SANDRA G. MULLINEX, HIS WIFE, IN THE CIRCUIT COURT OF THE FIFTEENTH JUDICIAL CIRCUIT OF FLORIDA, IN AND FOR PALM BEACH COUNTY, CIVIL ACTION, AND SETTING FORTH PROVISIONS FOR PAYMENT OF FEES AND COSTS IN CONNECTION THEREWITH was read in full and adopted. as read as Resolution No. ~F8-72. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, that we award the bid for 220 tons of clay to Chesser and Stri.ekland, Inc., Hollister, Florida, at the rate of $9.00 per ton. Councilman Martin left the meeting at 9:40 p.m. There being no further business to come before .the Council, on motion of Councilman Slater, seconded by Councilman Rhodes, all present voting aye, the meeting was adjourned at 9:45 p.m. BILL 173 ADOPTED AS AMENDED AS ORD. 27-72 RES. 46-72 ADOPTED RES. 47-72 AD-OPTED RES. 48-72 ADOPTED BID FOR CLAY AWARDED TO CHESSER & STRICKLAND ADJOURNMENT Minutes recorded by: Dolores R.
