08-24-1972 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIIl'~ HELD THURSDAY, AUGUST 24, 1972 Present: H. Mallory Privett, Jr., Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman Thomas Yeager, Village Attorney Lawrence J. Robbins, Village Manager Frances A. Fox, Village Treasurer Dolores R. Walker, Village Clerk Mayor Privett called the Regular Meeting to order at 8:05 p.m. and asked the Clerk to call the roll, all members being present. Councilman Rhodes gave the invocation, and Councilman Martin led the Council and the public in the Pledge of Allegiance to the Flag. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, the minutes of .Public Hearing on Bill No. 162 held Thursday, August 10, 1972 were approved as written. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the minutes of Regular Meeting held Thursday, August 10, 1972 were .approved as written. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, the financial statements for the Village and for the North Palm Beach Country Club for the period ending July 31, 1972 were accepted. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, Bill No. 161 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE, IT BEING THE ZONING CODE, BY PROHIBITING THE LOCATION OF RESTAURANTS WITHIN 650 FEET OF ANOTHER RESTAURANT IN THE VILLAGE was tabled. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill. No. 163 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, ' FLORIDA, AMENDING CHAPTER 6 OF THE VILLAGE OF NORTH PALM BEACH CODE, BY ADOPTING BY REFERENCE THE SOUTHERN STANDARD BUILDING CODE, 1969 EDITION WITH 1972 REVISION THERETO, INCLUDING APPENDICES A, B, C, E, F AND H, TOGETHER WITH AMENDMENTS, CORRECTIONS AND ADDITIONS THERETO, AS THE BUILDING CODE FOR THE VILLAGE OP NORTH PALM BEACH ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES ACCEPTANCE OF FINANCIAL STATEMENTS BILL 161 TABLED BILL 163 PLACED ON 2ND READING was placed on second reading and read by title alone. ORD. 16-72 On motion of Vice Mayor Cadby, seconded by Councilman BILL 164 Martin, all present voting aye, Bill No. 164 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING BY REFERENCE THERETO THE SOUTHERN STANDARD GAS CODE, 1969 EDITION WITH 1972 REVISIONS THERETO, AS THE GAS CODE FOR THE VILLAGE OF NORTH PALM BEACH was placed. on second reading and read by title alone. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 164 was adopted as Ordinance No. 17-72. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, that Bill No. 165 entitled: BILL 164 ADOPTED AS ORD. 17-72 BILL 165 POSTPONED AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING BY REFERENCE THERETO THE SOUTHERN STANDARD PLDMBING CODE, 1971 EDITION WITH THE 1972 REVISION THERETO, INCLUDING APPENDIX A THERETO, TOGETHER WITH AMENDMENTS, CORRECTIONS AND ADDITIONS ' THERETO be postponed until our Regular Meeting of September 14, 1972. On motion of Vice Mayor Cadby, seconded by Councilman BILL 167 Martin - 4 - 0, with Councilman Slater abstaining due PLACED ON to the possible conflict because of his occupation - Bill 15T READING No. 167 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE, BY AMENDING THE REAR AND SIDE YARD SETBACK REGULATIONS IN ZONING DISTRICT C-1 TO REQUIRE SINGLE FAMILY AND MULTIPLE FAMILY RESIDENTIAL DWELLING STRUCTURES TO HAVE THE SAME REAR AND SIDE YARD SETBACK REGULATIONS AS IS REQUIRED IN ZONING DISTRICT R-1 AND R-3 RESPECTIVELY, AND PROVIDING EXCEPTIONS THERETO was placed on first reading and read in full. On motion of Vice Mayor Cadby, seconded by Councilman RES. 31-72 Martin, all present voting aye, proposed Resolution No. ADOPTED 31-72 entitled: ' A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBER TO THE NORTH PALM BEACH COUNTRY CLUB BOARD OF GOVERNORS TO REPLACE MRS. NELS MICHELSON WHO RESIGNED was read in full and adopted as read as Resolution No. 31-72. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, proposed Resolution No. 33-72 entitled: RES. 32-72 ADOPTED RES. 33-72 ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO EMPLOY THE LAW FIRM OF NASON, GILDAN & MEAGER, P.A. TO REPRESENT THE DEFENDANTS, VILLAGE OF NORTH PALM BEACH, FLORIDA, H. MALLORY PRIVETT, JR., MAYOR, RONALD B. CADBY, VICE MAYOR, ROBERT W. MARTIN, THOMAS B: RHODES AND ROBERT F. SLATER, ACTING AS AND FOR THE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AND LAWRENCE J. ROBBINS, VILLAGE MANAGER, IN THAT CERTAIN CAUSE FILED BY FRANK M. SMITH, ET AL IN THE UNITED STATES DISTRICT COURT, SOUTHERN DISTRICT OF FLORIDA, CASE N0. 72 1256-CIV-NCR, AND SETTING FORTH PROVISIONS FOR PAYMENT OF FEES AND COSTS IN CONNECTION THEREWITH C J was read in full and adopted as read as Resolution No. 33-72. On motion of Vice Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, that the Mayor be authorized to sign that we agree with the proposed tax distribution schedule in accordance with the letter from Mr. Walter H. Bahneman, County Tax Collector, dated July 31, 1972.
