09-23-1971 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 23, 1971 Present: H. Mallory Privett, Jr „ Mayor Ronald B. Cadby, Vice Mayor Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman Herbert L. Gildan, Village Attorney John D. Hayes, Country Club Manager Lawrence ;J. Robbins, Village Manager Frances A. Fox, Village Treasurer Dolores R. Walker, Village Clerk Mayor Privett called the regular meeting to order at 8:25 p.m. and asks the_Clerk to call the roll, all members being present_.__ Councilman Rhodes g~the invocation and Vice Mayor Cadby led the Council a_nd_the,pub_lic in the Pledge of Allegiance to the Flag. On motion of Vic~S4ayor Cadby, seconded by Councilman Martin, all present voting aye, the minutes of regular meeting held Thursday, September 9, 1971 were approved as written. On motion of Vice Mayor Cadby, seconded by ',Councilman Martin, all present voting aye, the Village and the North Palm Beach Country Club financial statements for they period ending August 31, 1971 were accepted. On motion of Councilman Martin, seconded by Vice Mayor Cadby, all present voting aye, that we authorize the Village Treasurer to transfer up to $10,000.00 from the Council Contingent Account to the North Palm Beach Country Club account, if necessary; such funds to be returned at the end of the fiscal year. On motion of Vice Mayor Cadby, seconded by ,Councilman Slater, all present voting aye, that we accept with regret Mr. HayesT resignation, and that we make it effective as of October 12, 1971, with his verbal confirmation that he concurs. On motion of Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, that we accept the recommendation of the Board of Governors and eliminate the category of house guest greens fees. On motion of Vice Mayor Cadby, seconded by Councilman Slater, all present voting aye, Bill No. 129 entitled: ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 41 OF THE VILLAGE OF NORTH PALM BEACH CODE BY SETTING FORTH REGULATIONS TO IMPROVE THE APPEARANCE OF CERTAIN SETBACK AND ROLL CALL INVOCATION & PLEDGE OF ALLEGIANCE 9/9/71 MINUTES APPROVED VILLAGE & NPBCC FINANCIAL STATE- MENTS FOR 8/31/71 ACCEPTED TRANSFER OF $10,000 FROi~1 COUNCIL CONTIN- GENT ACCT. TO NPBCC ACCT_ MR. HAYES~ RESIGNATION ACCEPTED WITH REGRET. HOUSE GUEST GREENS FEES ELIMINATED AT NPBCC BILL 129 PLACED ON 2ND READING Minutes of Regular Meeting Held Thursday, September 23, 1971 Page 2 YARD AREAS, INCLUDING OFF STREET VEHICLE PARKING AND OPEN LOT SALES AND SERVICE AREAS AND TO PROTECT AND PRESERVE THE APPEARANCE, CHARACTER AND VALUE OF SURROUNDING NEIGHBORHOODS; BY PROVIDING FOR THE INSTALLATION AND MAINTENANCE OF LANDSCAPING FOR SCREENING AND AESTHETIC QUALITIES; BY PROVIDING DETAILS TO ACCOMPLISH THE PURPOSE OF THIS ORDINANCE; AND PROVIDING PENALTIES FOR VIOLATION THEREOF was placed on second reading and read by title alone. On motion of Vice Mayor Cadby, seconded by, Councilman Slater, all present voting aye, Bill No. 129 was adopted as Ordinance No. 14-71. On motion of Vice Mayor Cadby, seconded by.Councilman Martin, all present voting aye, Bill No. 132 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE VILLAGE OF NORTH PALM BEACH CODE BY ESTABLISHING AN ADMINISTRATIVE CODE; DIVIDING THE ADMINISTRATIVE SERVICE OF THE VILLAGE OF NORTH PALM BEACH INTO DEPARTMENTS UNDER THE CHIEF ADMINISTRATOR; PRESCRIBING ADMINISTRATIVE POLICY AND PROCEDURE; PRESCRIBING THE FUNCTION AND DUTIES OF ADMINISTRATIVE UNITS AND OFFICIALS OF THE GOVERNMENT; AND PRESCRIBING PENALTIES FOR THE ' VIOLATION OF ITS PROVISIONS was placed on second reading and read by title alone. On motion o£ Vice Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 132 was. adopted as Ordinance No. 15-71. ' On motion of Vice Mayor Cadby, seconded by .Councilman Slater - 3 to 2, Mayor Privett and Councilman Martin opposed - Bill No. 136 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY DEFINING THE TERMS"ACCESSORY BUILDING' AND "DETACHED FENCE STORAGE AREA" AND SETTING FORTH REGULATIONS CONCERNING THE LOCATION OF DETACHED FENCE STORAGE AREAS was placed on second reading and read by title alone. Vice_Mayor Cadby made a motion that Bill No. 136 be adopted as Ordinance No. 16-71. Motion was seconded by Councilman Rhodes. Mayor Privett passed the gavel to Vice Mayor Cadby and made the following motion: That Bill 136 be amended by adding the following words: "or ten feet in length" between the words "depth" and "longer-." The motion was seconded by Councilman Martin. Mayor Privett and Council- man Martin voted aye, and Vice Mayor Cadby,'Councilman Rhodes and Councilman Slater voted nay; therefore, motion was defeated 3 to 2. Mayor Privett then made a motion to amend Bill No. 136 as Follows: That we add the Following phrase after the word longer: "than 50% of the length o£ the fence.. T` The motion was seconded by Councilman Martin. Mayor BILL 129 ADOPTED AS ORD. 14-71 BILL 132 PLACED ON 2ND READING BILL 132 ADOPTED AS ORD. 15-71 BILL 136 PLACED ON _ 2ND READING MOTION TO ADOPT BILL 136 AS ORD. 16-71 MOTION TO AMEND -BILL 136 DEFEATED Minutes of Regular Meeting Held Thursday, September 23, 1971 Page 3 Privett and Councilman Martin voted aye, and Vice Mayor Cadby, Councilman Rhodes and'Councilman Slater voted nay; therefore, motion was defeated 3 to 2. Vice Mayor Cadby returned the gavel to Mayor Privett. Thereafter Council voted on the main motion which passed BILL 136 3 to 2 - Vice Mayor Cadby, Councilman Rhodes and Council- ADOPTED AS ORD. man Slater voted aye, and Mayor Privett and Councilman 16-71 BY 3 TO Martin voted nay. Therefore, Bill 136 was adopted as 2 VOTE Ordinance No. 16-71 by a 3 to 2 vote. - On motion of Vice Mayor Cadby, seconded by Councilman BILL 138 Slater - 3 to 2, Mayor Privett and Councilman Martin PLACED ON opposed - Bill No. 138 entitled: 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY PERMITTING DETACHED FENCE STORAGE AREAS IN THE R-1 AND R-2 DWELLING DISTRICTS was placed_on second reading and read by title alone. On motion of Vice Mayor Cadby~ seconded by Councilman BILL 138 ADOPTED Slater - 3 to 2, Mayor Privett and Councilman Martin AS ORD. 17-71 opposed - Bill No. 138 was adopted as Ordinance No. BY 3 TO 2 VOTE 17-71. On motion of Vice Mayor Cadby, seconded by Councilman RES. 25-71 ' Martin - 4 to 1, Mayor Privett opposed - proposed ADOPTED Resolution No. 25-71 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, MAKING THE APPOINT~NT OF LAWRENCE J. ROBBINS AS TEMPORARY MANAGER OF THE NORTH PALM BEACH COUNTRY CLUB was read in full and adopted as read as Resolution No. 25-71.
