03-25-1971 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF IvTORTH PALM BEACH, FLORIDA HELD THURSDAY, MARCH 25, 1971 Present: H. Mallory Privett, Jr., Acting Chairman ' Ronald B. Cadby, Councilman Robert W. Martin, Councilman Thomas B. Rhodes, Councilman Robert F. Slater, Councilman -_ Lawrence J. Robbins, Village Manager John D. Hayes, Country Club Manager Herbert L. Gildan, Village Attorney Frances A. Fox, Village Treasurer Dolores R. Walker, Village Clerk Chairman Mallory Privett called the regular meeting to ROLL CALL order at 8:00 p.m. and asked the Clerk to call the roll, all members being present. Councilman Martin gave the invocation and Councilman INVOCATION & Rhodes led the Council and the public in the Pledge of PLEDGE OF Allegiance to the Flag. ALLEGIANCE Chairman Privett stated that the organization of the COUNCIL Council is required by Charter to be done at the next ORGANIZATION regular meeting of the Council following the election of arty Councilman. Therefore, Council proceeded with its organization in accordance with Article. II I, Section ' 6, of the Village Charter. Councilman Cadby nominated H. Mallory Privett, Jr. for H. M. PRIVETT, the office of Mayor of the Village of North Palm Beach. JR. NOMINATED Nomination was seconded by Councilman Martin. FOR MAYOR There being no further nominations for Mayor, Council- R. B. CADBY man Martin nominated Ronald B. Cadby for the office of NOMINATED FOR Vice-Mayor of the Village of North Palm Beach. Nomination VICE-MAYOR was seconded by Councilman Rhodes. There being no further nominations for Vice-Mayor, R. W. MARTIN Councilman Rhodes nominated Robert W. Martin for the NOMINATED FOR office of President Pro Tem of the Village of North PRESIDENT PRO Palm Beach. Nomination was seconded by Councilman TEM Cadby. There being no further nominations for President Pro CLERK ENTERS Tem, on motion of Councilman Martin, seconded by Council- NAMES OF PRIVETT, man Cadby, all present voting-aye, that we put the name CADBY AND MARTIN H. Mallory Privett, Jr. as Mayor, the name Ronald B. ON PROPOSED RES. Cadby as Vice-Mayor and the name Robert W. Martin as N0. 496-71 President Pro Tem on proposed Resolution No. 496-71. On motion of Councilman Rhodes, seconded by Councilman RES. N0. Martin, all present voting aye, proposed Resolution No. 496-71 496-71 entitled: ADOPTED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING CERTAIN OFFICERS FOR SUCH VILLAGE 1 was read in full and adopted as read as Resolution No. 496-71. 1 1 Minutes of Regular Meeting Held Thursday, March 25, 1971 Page 2 Clerk administered oath to faithfully and impartially execute the duties of office, as required by Article III, Section 8, of the Village Charter, to Mayor Privett, Vice-Mayor Cadby and President Pro Tem Martin. These oaths shall be spread upon the minutes of the Council. On motion of Vice-Mayor Cadby, seconded by Councilman Rhodes, all present voting aye, that we deviate from the agenda and take up Statements from the Public at this time. On motion of Vice-Mayor Cadby, seconded by Councilman Slater, all present voting aye, the minutes of regular meeting held Thursday, March 11, 1971; the minutes of special meeting held Tuesday, March 16, 1971; and the minutes of special meeting held Wednesday, March 17, 1971 were approved as written. On motion of Councilman Martin, seconded by Vice-Mayor Cadby, all present voting aye, the Village financial statement for period ending February 28, 1971, and the North Palm Beach Country Club financial. statement for period ending February 28, 1971 were accepted. On motion of Councilman Martin, seconded by Vice-Mayor Cadby, all present voting aye, that we put the North Palm Beach Country Club Manager's Report on the agenda at this time. On motion of Councilman Martin, seconded by Vice-Mayor Cadby, three to two - Councilman Rhodes and Councilman Slater opposed - that we confirm the Board of Governors action in this case and do not refund the membership fee to Mr. Somers. On motion of Councilman Rhodes, seconded by-Vice-Mayor Cadby, all present voting aye, that Mr. Hayes be author- ized to spend .$5,000 from the North Palm Beach Country Club contingency fund for the p~.xrpose of providing shallow wells for the country club. On motion of Councilman Martin, seconded by Councilman' Rhodes, all present voting aye, the Report of Beautifi- cation Committee of February 24, 1971; the minutes of special meeting of the Planning and Zoning Advisory Board held March 8, 1971; and the minutes of Zoning Board of Adjustment meeting held March 9, 1971 were accepted. On motion of Vice-Mayor Cadby, seconded by Councilman Slater, all present voting aye, that the Council adopt the policy for liaison with Village advisory boards_ On motion of Vice-Mayor Cadby, seconded by Councilman Slater, all present voting aye, that we direct the Clerk to attach an official copy of the liaison policy to the minutes of this meeting. Councilman Rhodes made a motion that Bill No. 113 BILL 113 be_adopted as Ordinan~e_ NA. 228-71. Motion was ADOPTED AS ORD. seconded by Councilman Martin. 228-71 Vice-Mayor Cadby made a motion to amend proposed ORD NO. 228-71 Ordinance No. 228-71 by deleting the following words AMENDED in Section 1, Subparagraph (3): "or if there is placed on said premise s. in a conspicuous position near the entrance thereof, a sign bearing the words: 'No TrespassingT, 'No _-_ Peddlers or Agents, 'No AdvertisementT, or any similar notice, indicating in any manner that the occupants of said premises do not desire to be molested or to have their right of privacy disturbed, or to have any such printed materials left upon such premises." _ 1 Motion was seconded by Councilman Martin. All present voted aye; therefore, motion passed unanimously. Councilman Rhodes made a motion to amend proposed Ordinance No. 228-71, Section 1, Subparagraph (3) by striking the words "anyone thereon" and inserting the words "the owner or someone authorized by the owner." Motion was seconded by Councilman Martin. A11 present voted aye; therefore, motion passed unanimously. Thereafter, Council voted on the main motion, which passed 5 - 0. Therefore, proposed Ordinance No. 228-71 was adopted as amended as Ordinance No. 228-71 by unanimous vote of the Council. On motion of Vice-Mayor Cadby, seconded by Councilman Martin, all present voting aye, Bill No. 119 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-17 OF THE VILLAGE OF NORTH PALM BEACH CODE BY CHANGING THE ORDER OF BUSINESS TO BE FOLLOWED AT MEETINGS OF-THE VILLAGE COUNCIL was placed on first reading and read in full. Councilman Martin made a motion that Bill No. 122 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DEANNEXING CERTAIN PROPERTY FROM THE BOUNDARIES OF THE VILLAGE OF NORTH PALM BEACH be placed on first reading and read in full. Motion was seconded by Vice-Mayor Cadby. The motion passed 4 - 0. Councilman Slater disqualified himself and ab- stained from voting according to the provisions of the Charter since it may affect his financial interests. Bill No. 122 was then read in full. ORD. On motion of Councilman Martin, seconded by Vice-Mayor Cadby, all present voting aye, that Bill No. 123 be abolished and that new proposed Bill No. 129 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 45-17 OF THE VILLAGE CODE BY REMOVING CERTAIN PROPERTY FROM R-1 SINGLE FAMILY DWELLING DISTRICT AND RECLASSIFYING SAID PROPERTY AS R-2 MULTIPLE FAMILY DWELLING DISTRICT; BY DIRECTING THE CLERK TO BRING THE OFFICIAL ZONING MAP UP TO DATE; BY PROVIDING FOR THE REPEAL OF ORDINANCES OR CODE PROVISIONS IN CONFLICT HEREWITH AND FOR OTHER PURPOSES ' be placed on first reading and read in full. There will be a public hearing on Bill No. 123, April 15, 1971 at 7:30 p.m. in the Village Hall. On motion of Vice-Mayor Cadby, seconded by Councilman Martin, all present voting aye, proposed Resolution No. 497-71 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, REAPPOINTING CERTAIN VILLAGE OFFICERS was read in full and adopted as read as Resolution No. 497-71. On motion of Councilman Martin, seconded by Councilman Slater, all present voting aye, that we authorize the Manager to go out for bid for additional office equip- ment for the Finance Department. The Councilmen will have the responsibility to=attend meetings of the subject boards during the various months as shown on the below schedule, e- 2. In the event it is impossible for the CounciLnan to attend, it will be his responsibility to arrange for another Councilman to tale his place. 3. The Councilmen will attend regular and special~rrreetings of the boards dv.ring the months shown. 4. The Councilmen will convey special requests from the Council to the boards and report back to the Councilmon-items of special interest. 5. The Village Clerk will send a reminder of the meeting to the Councilmen on the Tuesday preceding the meeting. 6. It will be the responsibility of the chairmen 5f the advisory boards to accomplish the following: f> a. Notification in advance to the appropriate=Councilman of any changes in date or time of the regular meeting of the board. b. Notification in advance of any special meetings c.
