03-16-1971 VC SP-MMINUTES OF SPECIAL MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD TUESDAY, MARCH 16, 1971 i~ L Present: Thomas R. Bell, Mayor Ronald B. Cadby, Councilman H. Mallory Privett, Jr., Councilman Herbert A. Watt, Councilman Herbert L. Gildan, Village Attorney Lawrence J. Robbins, Village Manager Dolores R. Walker, Village Clerk Mayor Bell called the Special Meeting to order at 8:01 a.m. and asked the Clerk to call the roll, all members being present. Village Attorney Gildan stated that the purpose of this Special Meeting was because the business at hand will not carry over until the next Regular Meeting of the Village Council. The law suit of Bankers Life and Casualty Company vs. the Village of North Palm Beacch and others. is scheduled for trial at 9:00 a.m., Wednesday, March 17, 1971. It has been suggested by Judge Emmet Choate that the plain- tiff and defendant parties eliminate those counts and items not material to the dredge and fill permit portion of the law suit referred to as Count No. 1, and in the opinion of Village Attorney Gildan this constituted a valid emergency that could only be handled by the action of the Village Council sitting in special session prior to Wednesday, March 17, 1971. Councilman Privett made a motion that the attorney be authorized to drop our counterclaim for removal_of the fill area of approximately 25 feet by 100 feet, with the stipulation that Bankers Life and Casualty Company drop its Count No. 2 of their suit against the Village. The motion was seconded by Councilman Cadby. All present voted aye; therefore, motion passed unanimously. There being no further business to come before the Council at this Special Meeting, on motion of Council- man Cadby, seconded by Councilman Watt, all present voting aye, the meeting was adjourned at 8:26 a.m. ~x~-4-.---o ~~~ Minutes recorded by: Dolores R.
