01-14-1971 VC REG-MMINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, JANUARY 14, 1971 Present: Thomas F. Lewis, Mayor Thomas R. Bell, Vice-Mayor Ronald B. Cadby, Councilman H. Mallory Privett, Jr., Gaunciiman John D. Hayes, Country Club Manager Lawrence J. Robbins, Village Manager Frances A. Fox, Village Treasurer Herbert L. Gildan, Village Attorney Dolores R. [nialker, Village Clerk Absent: Herbert A. Watt, Councilman Mayor Lewis called the Regular Meeting to order at ROLL CALL 8:15 p.m. and asked the Clerk to call the roll, all members being present except Councilman Watt, who was out of town on Village business. Mayor Lewis gave the invocation, and Vice-Mayor Be11 INVOCATION & led the Council and the public in the Pledge of Allegiance PLEDGE 0€` to the Flag. Minutes of Regular Meeting ___ Held Thursday, January 14, 1971 Page 2 On motion of Councilman Privett, seconded by Vice-Mayor BILL 108 Bell, all present voting aye,-Bill No. 108 ,entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, & READ BY TITLE FLORIDA, ADOPTING AND ENACTING SUPPLEMENT N0. 1 --ALONE TO THE CODE OF ORDINANCES OF THE VILLAGE OF NORTH PALM BEACH; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; AND PROVIDING A PENALTY FOR VIOLATION THEREOF was placed on second reading and read by title alone. On motion of Councilman Cadby, seconded by Councilman BILL 108 Privett, all present voting aye, Bill No. 108 was ADOPTED AS adopted as Ordinance No. 221-71. ORD. 221-71 On motion of Vice-Mayor Be11, seconded by Councilman BILL 106 Privett, all present voting aye, Bi11 No. 106 entitled: PLACED ON 2ND READING & READ AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, BY TITLE ALONE FLORIDA, AMENDING SECTIONS 38-21 AND 38-22 OF THE VILLAGE OF NORTH PALM BEACH CODE BY ADDING THE UTILITY TAX CURRENTLY LEVIED ON THE PURCHASE OF ELECTRICITY, METERED GAS AND BOTTLED GAS (NATURAL LIQUEFIED PETROLEUM GAS OR MANUFACTURED GAS) TO ALSO COVER THE PURCHASE OF FUEL OIL was placed on second reading and read by title alone. Councilman Privett made a motion that Bi11 No. 106 be adopted as Ordinance No. 222-71. Motion was seconded by Councilman Cadby. During the discussion on the motion, Councilman BILL 106 Privett made a motion that Bill No. 106 be amended - AMENDED by changing Section 1'to read as follows: "Section 1. Sections 38-21 and 38-22 of the Village of North Palm Beach Code are hereby amended by adding the words "fuel oil" between the words "electricity" and "metered gas" wherever the phrase "electricity, metered gas and bottled gas (natural liquefied petroleum gas or manufactured gas)" appears in those two sections." Motion was seconded by Vice-Mayor Bell. All present voted aye; therefore, motion passed unanimously. On motion of Councilman Privett, seconded by Councilman BILL 106 Cadby, all present voting aye, Bill No. 10fi was adopted ADOPTED AS as amended as Ordinance No. 222-71. AMENDED AS ORD. 222-71 On motion of Councilman Privett, seconded by Councilman BILL 110 Cadby, all present voting aye, Bill No. 110 entitled: PLACED ON 1ST READING & READ AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, IN FULL FLORIDA, AMENDING CHAPTER 36 OF THE VILLAGE OF NORTH PALM BEACH CODE BY REQUIRING ALL UTILITIES TO BE CONSTRUCTED UNDERGROUND AND PROVIDING EXCEPTIONS THERETO was placed on first reading and read in full. NORTH PALM BEACH CODE, BY IMPOSING A FEE OF FIFTEEN DOLLARS PER YEAR FOR NON-RESIDENT USE OF THE BOAT LAUNCHING FACILITIES AT THE VILLAGE MARINA LOCATED WEST OF ANCHORAGE PARTC IN THE VILLAGE OF NORTH PALM BEACH was placed on first reading and read in full. On motion of Councilman Privett, seconded by Vice-Mayor RES. .482-71 Bell, all present voting aye, proposed Resolution No. ADOPTED 482-71 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, RECOMMENDING TO THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY THAT PROSPERITY FARMS ROAD REMAIN A TWO-LANE HIGHWAY WHERE IT IS LOCATED WITHIN THE LIMITS OF THE VILLAGE OF NORTH PALM BEACH AND ELSEWHERE, EXCEPT AT THE INTERSECTION OF LIGHTHOUSE DRIVE AND PROS- PERITY FARMS ROAD IN THE VILLAGE OF NORTH PALM _ BEACH WHERE THE ROAD SHOULD BE WIDENED TO FACILI- TATE INTERSECTIONAL TRAFFIC - _-- was read in full and adopted as read as Resolution No. 482-71. On motion of Councilman Privett, seconded by Vice-Mayor NAMES TO BE Bell, that the names of Mr. Allen R. Smith and Mr. PLACED ON RES. Mel 0. Siegel be applied to the proposed resolution RE APPT. TO BD. appointing members to the Country Club Board of Governors. OF GOV. The meeting recessed at 10:10 p.m. and reconvened at RECESS 10:16 p.m. __ During the discussion of the above motion, Vice-Mayor MR. PRIVETT`S Be11 moved that Mr. Privett's original motion be amended QRIGINAL MOTION to strike the name of Mr. Siegel from the motion and AM_E__N_DED apply the name of Mr. Geraghty. Motion was seconded by Councilman Cadby. A11 present voted aye; therefore, motion passed unanimously. On motion of Councilman Privett, seconded by Vice-Mayor RES. 483-71 Be11, all present voting aye, that proposed Resolution ADOPTED AS No. 483-71 entitled: AMENDED A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE NORTH PALM BEACH COUNTRY CLUB BOARD OF GOVERNORS AND SETTING FORTH THE TERMS OF OFFICE OF SUCH MEMBERS be adopted with the following-amendment: That November 1, 1970 be changed to January 14, 1971 for the terms indicated that the appointed persons are to serve on the North Palm Beach Country Club Board of Governors. On motion of Councilman Privett, seconded by Councilman RES. 484-71 Cadby, all present voting aye, proposed Resolution No. ADOPTED ~48~F-71 entitled: Minutes of Regular Meeting Held Thursday, January 14, 1971 Page 4 1 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND THE VILLAGE CLERK TO SIGN A DISCLAIMER TO A CERTAIN DRAINAGE EASEMENT BETWEEN LOTS 24 AND 25, BLOCK 38, PLAT N0. 3 02' THE VILLAGE OF NORTH PALM BEACH was read in full and adopted as read as Resolution No. 484-71. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, that reading and con- sideration of proposed Resolution No. 485-71 entitled- A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, PETITIONING THE LEGISLATURE OF THE STATE OF FLORIDA, OPPOSING THE LOCATION OF A NEW STATE PRISON WITHIN THE BOUNDARIES OF PALM BEACH COUNTY, FLORIDA J 1 be tabled. GRAM On motion of Councilman Cadby, seconded by Councilman Privett, all present voting aye, that we award an annual bid to Lumbatis, Inc. for Argentina Bahia sod at $.O~F per square foot and $.0175 for labor. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, that we approve the bid of Florida Power & Light Company for purchase of street lights in the Golfview Subdivision for the total amount of $1,898.00. ANNUAL BID FOR SOD AWARII- EA TO LUMBATIS, INC. BID AWARDED TO FLA. P & L FOR STREET LIGHTS IN GOLFVIEW On motion of Councilman Cadby, seconded by Councilman TRANSFERS FROM Privett, all present voting aye, that we transfer the RES. OPER. FUND items listed on the letter from Callaway, Carpenter TO GEN. FUND & May, dated January 11, 1971, including $3,590.38 as part payment on the irrigation system, which will --- add to a total of $33,750.22, from the Reserve Operation Fund to the General Fund.
