02-11-1971 VC REG-MMINUTES DF REGULI-1R MEETING DF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, FEBRUARY 11, 1971 ~, ~1 Present: Thomas R. Bell, Vice-Mayor -- Ronald B. Cadby, Councilman H. Mallory Privett, Jr., Councilman Herbert A. Watt, Councilman John D. Hayes, Country Club Manager Lawrence J. Robbins, Village Manager Frances A. Fox, Village Treasurer. Herbert L. Gildan, Village Attorney Dolores R. Walker, Village Clerk Absent: Thomas F. Lewis, Mayor Vice-Mayor Bell called the meeting to order at 8:08 p.m. and asked the Clerk to call the roll, all members being present except Mayor Lewis. Councilman Privett gave the invocation and-Councilman Cadby led the Council and the public in the Pledge of Allegiance to the Flag. Village Clerk read letter of resignation from Mayor Thomas F. Lewis, dated January 4, 1971, addressed to Vice-Mayor Bell and Village Clerk Mrs. Walker, in which Mayor Lewis stated his resignation would be- come effective February 11, 1971. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, that we accept the resig- nation of Mayor Tom Lewis with deep and sincere regret. Councilman Herbert A. Watt stated publicly that it is not his intention to file for re-election. He. stated that he enjoyed the seven years he spent on the. Village Council and hoped that he had been helpful in the orderly advance- ment of the community. On motion of Councilman Watt, seconded by Councilman Cadby, all present voting aye, the minutes o~ Regular Meeting held Thursday, January 28, 1971 were approved as written. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, the Village, financial statement for the period ending December 31, 1970 was accepted. On motion of Councilman Cadby, seconded by Councilman Watt, all present voting aye, the minutes of Board of Governors meeting held January 20, 1971, and the minutes of special meeting of Board of Governors held January 27, 1971 were accepted. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, that we deviate from the agenda and take up Item C under Resolutions at this time. On motion of Councilman Privett, seconded by Councilman Watt, all present voting aye, Bill No. 102 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, SETTING FORTH CONSTRUCTION STANDARDS FOR DOCKS, PIERS AND OTHER APPROVED STRUCTURES IN THE WATERWAYS OF THE VILLAGE OF NORTH PALM BEACH was placed on first reading and read in full. BILL 102 PLACED ON 1ST READING & READ IN FULL On motion of Councilman Watt, seconded by Councilman BILL 109 Privett, all present voting aye, Bill-No. 109 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANNEXING CERTAIN PROPERTY LOCATED WITHIN TWO MILES OF THE BOUNDARIES OF SAID MUNICIPALITY TO THE VILLAGE OF NORTH PALM BEACH was placed on second -reading and read by title alone. On motion of Councilman Watt, seconded by Councilman BILL 109 Cadby, all present voting aye, Bill No. 109 was adopted ADOPTED AS as Ordinance No. 224-71. ORD. 224-71 On motion of Councilman Watt, seconded by Councilman Cadby, BILL 112 all present voting aye, Bill No. 112 entitled: PLACED ON 2ND READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANNEXING CERTAIN PROPERTY CONTIGUOUS TO THE -- BOUNDARIES OF SAID MUNICIPALITY TO THE VILLAGE OF NORTH PAT~1 BEACH was placed on second reading and read by title alone. On motion of Councilman Watt, seconded by Councilman BILL 112 Privett, all present voting aye, Bill No. 112 was adopted ADOPTED AS as Ordinance No. 225-71. ORD. 225-71 On motion of Councilman Privett, seconded by Councilman BILL 113 Cadby, all present voting aye, Bill No. 113 entitled: PLACED ON 1ST READING AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 24 OF THE VILLAGE OF NORTH ' PALM BEACH CODE BY PROHIBITING THE DISTRIBUTION OF CERTAIN PRINTED MATERIAL CONTRARY TO THE CONSENT OF THE OWNER OF PRIVATE PREMISES was placed on first reading and read in full. Minutes of Regular Meeting Held Thursday, Feb. 11, 1971 Page 3 On motion of Councilman Cadby, seconded by Councilman Watt, all present voting aye, Bill No. ll5 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY CREATING A NEW ZONING DISTRICT TO BE DESIGNATED R-C-1, RESIDENTIAL-COMMERCIAL DISTRICT was placed on first reading and read in full. There will be a public hearing on Bill No.-115 on March 4, 1971 at 7:30 p.m. in the Council Chambers of Village Hall. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, Bill No. 117 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PAIM BEACH, FLORIDA, AMENDING SECTION 3-34 OF THE VILLAGE OF NORTH PALM BEACH CODE BY ELIMINATING A RESTRICTION ON THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES ON THE DAYS OF A GENERAL OR PRIMARY ELECTION DURING THE HOURS THE POLLS ARE-OPEN was placed on first reading and read in full. On motion of Councilman Privett, seconded by Councilman Cadby, all present voting aye, Bill No. 118 entitled: ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REZONING CERTAIN PROPERTY FROM ZONING DISTRICT R-1 TO ZONING DISTRICT R-C-1'AND BY DIRECTING THE CLERK TO UPDATE THE OFFzCTAr, ZONING MAP was placed on first reading and read in full. There will be a public hearing on Bill No. 11S on March 4, 1971 at 7:45 p.m. in the Council Chambers of Village Hall. On motion of Councilman Cadby, seconded by Councilman Watt, all present voting aye, proposed Resolution No. 487-71 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, URGING THE NAVY DEPARTMENT OF THE UNITED STATES DEPARTMENT OF DEFENSE TO RETAIN AUTEC HEADQUARTERS IN WEST PALM BEACH, FLORIDA ~I U' was read in full and adopted as read as Resolution No. 487-71. Councilman Privett made a motion that proposed Resolution RES. .489-71 No. 489-71 entitled: ADOPTED _ AS A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM AMENDED BEACH, FLORIDA, REQUESTING THE PALM BEACH COUNTY _ DELEGATION TO THE 1971 FLORIDA LEGISLATURE TO PASS A SPECIAL ACT REQUIRING ALL MUNICIPALITIES AND PALM _ BEACH COUNTY TO GIVE NOTICE OF PENDING CHANGES IN ZONING TO ANY OTHER MUNICIPALITY OR OTHER COUNTY, AS THE CASE MAY BE, WHICH HAS PART OF ITS MUNICIPAL OR COUNTY LIMITS LYING WITHIN 1,000 FEET OF THE AREA WHERE REZONING PETITIONS ARE TO BE HEARD be adopted as read. The motion was seconded by Councilman Cadby, Councilman Privett made a motion to amend proposed Resolu- tion No. 489-71 by eliminating the word "whereT' in the title and adding the words "concerning which." The motion was seconded by Councilman Cadby. Council voted on the motion to amend, which passed 4 - 0. Thereafter Council voted on the main motion, which passed 4 - 0. Therefore, proposed Resolution No. 489-71 was adopted as amended as Resolution No. 489-71. On motion of Councilman Cadby, seconded by Councilman Watt, all present voting aye, proposed Resolution No. 490-71 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, DIRECTING THE VILLAGE CLERK TO PUBLISH NOTICE OF THE GENERAL ELECTION TO BE HELD ON MARCH 16, 1971; NAMING THE TIME AND PLACE WHERE SUCH ELECTION SHALL BE HELD; APPOINTING THE ELECTION OFFICIALS FOR THE GENERAL ELECTION AND RUN-OFF ELECTION; DECLARING THE OFFICES TO BE FILLED AT SUCH ELECTION IL J was read in full and adopted as read as Resolution No. 490-71. RES. 490-71 ADOPTED On motion of Councilman Cadby, seconded by Councilman VILLAGE Watt, all present voting aye, the Village df North Palm AUDIT FOR Beach audit for the period ending October 31, 1970 was 10/31/70 accepted. ACCEPTED On motion of Councilman Cadby, seconded by Councilman Watt, all present voting aye, that we award the bid for fencing materials based on the unit price as sub- mitted by Budget Fence.Company of_West Palm Beach in their bid.
