07-23-2015 VC REG-MMINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JULY 23, 2015 Present: Robert A. Gebbia, Mayor David B. Norris, Vice Mayor Doug Bush, President Pro Tem. Darryl C. Aubrey, Sc.D., Councilmember Mark Mullinix, Councilmember James P. Kelly, Village Manager Len Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CALL Mayor Gebbia called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE President Pro Tern Bush gave the invocation and Mayor Gebbia led the public in the Pledge. AWARDS AND RECOGNITION Chief of Police Jenkins commended Captain Robert Furey, who is retiring from the North Palm Beach Police Department after 30 years of service. Chief Jenkins introduced police officers Angela Dallesandro and Andrew Council, who have been promoted to the rank of Captain and Sergeant, respectively. On behalf of the Village Council and Administration, Mayor Gebbia presented a certificate and award to Captain Furey in recognition of his 30 years of dedicated service to North Palm Beach. On behalf of the Village Council and Administration, Mayor Gebbia presented certificates to Captain Dallesandro and Sergeant Council in acknowledgement of their promotions. APPROVAL OF MINUTES The Minutes of the Regular Session held June 25, 2015 were approved as written. STATEMENTS FROM THE PUBLIC Mike Deluca, 130 Gulfstream Road, North Palm Beach, addressed the Council concerning the citation he received approximately six months ago regarding the size of the boat parked at his residence. Mr. Deluca asked if there was still a possibility that the code might be changed. Mr. Kelly suggested that the Council consider declaring a six -month moratorium on enforcing the code provisions concerning parking of boats and recreational vehicles, in order to allow time to research the issue and prepare a recommendation for Council's consideration. Consensus of Council was to place the moratorium on an upcoming agenda. Regarding his Fine Assessment Hearing on August 3, 2015, Mr. Deluca was informed staff would make a recommendation to the Special Magistrate to postpone certification of the fine until the Council makes a decision on whether or not to enact a moratorium. Minutes of Village Council Regular Session held July 23, 2015 Page 2 of 3 PUBLIC HEARING AND SECOND READING OF ORDINANCE 2015 -13 — CODE AMENDMENT — SPECIAL EXCEPTION USES FOR COMMERCIAL DISTRICTS 1 A motion was made by President Pro Tem Bush and seconded by Councilmember Aubrey to / adopt and enact on second reading Ordinance 2015 -13 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE II, "GENERALLY," OF APPENDIX C (CHAPTER 45), "ZONING," OF THE VILLAGE CODE ORDINANCES BY CREATING A NEW SECTION 45 -16.2, "SPECIAL EXCEPTION USES," TO ADOPT PROCEDURES AND STANDARDS FOR REVIEW OF APPLICATIONS FOR SPECIAL EXCEPTION APPROVAL; AMENDING ARTICLE 1, "IN GENERAL," OF CHAPTER 21, "PLANNING AND DEVELOPMENT," OF THE VILLAGE CODE OF ORDINANCES BY AMENDING SECTION 21 -3, "PUBLIC NOTICE REQUIREMENTS FOR DEVELOPMENT APPLICATIONS AND APPROVALS," TO INCLUDE NOTICE REQUIREMENTS FOR APPLICATIONS FOR SPECIAL EXCEPTION APPROVAL; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Gebbia opened the public hearing. There being no comments from the public, Mayor Gebbia closed the public hearing. Thereafter, the motion to adopt and enact Ordinance 2015 -13 on second reading passed unanimously. CONSENT AGENDA APPROVED President Pro Tem Bush moved to approve the consent agenda. Vice Mayor Norris seconded the motion and all present voted aye. The following items were approved: Receive for file Minutes of the Planning Commission meeting held 6/2/15 Receive for file Minutes of the Library Advisory Board meeting held 6/23/15 Receive for file Minutes of the Recreation Advisory Board meeting held 7/14/15 RESOLUTION 2015 -46 — TENTATIVE MILLAGE RATE A motion was made by Councilmember Aubrey and seconded by Vice Mayor Norris to adopt Resolution 2015 -46 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A TENTATIVE MILLAGE RATE OF 7.5700 MILS FOR FISCAL YEAR 2015 -2016; ESTABLISHING A DATE, TIME AND PLACE FOR THE FIRST HEARING ON THE TENTATIVE BUDGET AND PROPOSED MILLAGE RATE; AUTHORIZING THE VILLAGE MANAGER TO SUBMIT THE REQUIRED FORMS TO THE PALM BEACH COUNTY PROPERTY APPRAISER; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Gebbia briefly described the budget process. Mayor Gebbia noted the tentative millage rate is the maximum amount that can be considered and the final millage rate would be lower, once Council reviews and evaluates the proposed budget during its budget workshop meetings. Mr. Kelly recommended a tentative millage rate of 7.5700 mils, which is 10.05% above the rolled -back rate of 6.8789 mils. Mr. Kelly stated the tentative millage rate establishes the maximum millage rate the Village may consider and may always be reduced. Mr. Kelly announced the first Public Hearing on the tentative budget and proposed millage rate would be held Thursday, September 10, 2015 at 7:30 p.m. Thereafter, the motion to adopt Resolution 2015 -46 passed unanimously. Minutes of Village Council Regular Session held July 23, 2015 Page 3 of 3 RESOLUTION 2015 -47 — LICENSE PLATE RECOGNITION (LPR) CAMERAS AND TRAILERS PURCHASE 1 A motion was made by Vice Mayor Norris and seconded by President Pro Tern Bush to adopt / Resolution 2015 -47 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING AND AUTHORIZING THE SOLE SOURCE PURCHASE OF TWO LICENSE PLATE RECOGNITION (LPR) CAMERAS AND PROCESSOR AND TWO MOBILE LPR ROAD WARRIOR SPEED TRAILERS FROM NDI RECOGNITION SYSTEMS; AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO AMEND THE CAPITAL PROJECTS FUND BUDGET TO TRANSFER $74,000.00 FROM THE CAPITAL RESERVE ACCOUNT TO THE IT — MACHINERY AND EQUIPMENT CAPITAL ACCOUNT TO FUND THE PURCHASE; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly described the functions and advantages of license plate recognition (LPR) cameras and explained how they would be used in the Village. Mr. Kelly and Mr. Rubin clarified the reasons for the Florida Department of Transportation's (FDOT) objection to the installation of LPR cameras on FDOT traffic poles. Mr. Kelly reported on plans to address the issue legislatively. Thereafter, the motion to adopt Resolution 2015 -47 passed unanimously. VILLAGE COUNCIL MATTERS /REPORTS Councilmembers discussed their evaluations of the Village Manager. A motion was made by President Pro Tem Bush and seconded by Councilmember Aubrey to grant a 4.5% merit increase to Mr. Kelly. The motion passed unanimously. Mayor Gebbia distributed a draft "Village Manager Performance Evaluation Process" that would be used to provide clear and measurable goals and objectives for judging performance. Mayor Gebbia suggested that at the beginning of the year, Council and the Village Manager would mutually agree on specific goals, objectives, and expectations and would evaluate the manager's performance on that basis at the end of the fiscal year. Mayor Gebbia requested that Council review the handout in preparation for discussion at an upcoming meeting. Mayor Gebbia reported on the recent Palm Beach County League of Cities meeting. Mayor Gebbia commented on the presentation regarding 211 Palm Beach/Treasure Coast, which is a free service that provides callers access to crisis intervention and suicide prevention services, information, assessment, and referral to community services. Mr. Kelly confirmed that a link to the 211 website could be placed on the new Village website. Discussion took place regarding the U.S. Supreme Court ruling that the amount of time a temporary sign may be displayed can't be limited based on its content. Vice Mayor Norris requested that signage at the Country Club comply with our sign code.
