2015-25 Notice of Special ElectionRESOLUTION 2015 -25 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DIRECTING THE VILLAGE CLERK TO PUBLISH NOTICE OF THE SPECIAL ELECTION TO BE HELD ON MAY 12,2015; NAMING THE TIME AND PLACE WHERE SUCH ELECTION SHALL BE HELD; DECLARING THE OFFICE TO BE FILLED AT SUCH ELECTION; REQUESTING THAT THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS CONDUCT THE ELECTION AND DELEGATING CERTAIN DUTIES TO THE SUPERVISOR; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, due to the passing of Councilman William L. Manuel on February 21, 2015, the office of Council member for Group 5 is currently vacant; and WHEREAS, Article III, Section 5(c) of the Village Charter provides that if there are more than 6 months remaining in the unexpired term, the Council shall by a majority vote of the remaining members fill the vacancy on an interim basis and schedule a special election to be held not sooner than 60 days nor more than 90 days following the occurrence of the vacancy; and WHEREAS, there is one office to be filled at the Special Election to be held in the Village on May 12, 2015. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, as follows: Section 1. That a Special Election shall be held, and is hereby declared to be held, in the Village of North Palm Beach, Palm Beach County, Florida, between the hours of 7:00 a.m. and 7:00 p.m. on the 12th day of May, 2015, for the purpose of electing a member to the Village Council to fill such office in Group 5 for the remainder of the term (until the March 2016 general election). Section 2. The Village Clerk is hereby ordered and directed to cause a notice of said election to be published in the Palm Beach Post at least fifteen days prior to said election. Said notice shall be substantially in the following form: NOTICE OF SPECIAL ELECTION MAY 12, 2015 TO ALL QUALIFIED ELECTORS RESIDING IN THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA: By order of the Village Council of the Village of North Palm Beach, Florida, notice is hereby given that a General Election will be held in said Village on the 12th day of May, 2015, for the purpose of electing councilmen for the following offices, to wit: Village Councilmember, Group 5 (term expires March 2016) Said election will be held in the Village of North Palm Beach, and the polling places are designated as North Palm Beach Community Center, Precincts 1314, 1316, 1320, and 1322; Anchorage Activities Building, Precinct 1328; First Unitarian Church, Precincts 1332 and 1334; North Palm Beach Country Club, Precincts 1342 and 1346; Old Port Cove Recreation Room between the North and South Quay Buildings, Precinct 1344; Faith Lutheran Church, Precinct 1350; and Village Hall Council Chambers, Precincts 1348 and 1380. The polls will be open in the voting places from 7:00 a.m. until 7:00 p.m. Page 1 of 2 Notwithstanding the foregoing, should the polling locations change subsequent to the adoption of this Resolution, the Village Clerk is hereby authorized and directed to advertise the correct locations in the notice without the necessity of amending this Resolution. Section 3. The office for which said candidates shall be elected at the Special Election are: Village Councilmember, Group 5 (term expires March 2016) Section 4. The Village Clerk and election officials are hereby directed to arrange for the use of voting machines at said Special Election, and the form of the ballot shall be such as is consistent with the use of voting machines. The Village Clerk shall coordinate and arrange for ballots, including absentee ballots, with the Supervisor of Elections. Section 5. The Village Council hereby requests that the Palm Beach County Supervisor of Elections conduct the Village's Special Election, including runoffs as necessary. The Supervisor of Elections shall conduct a Logic and Accuracy test for the tabulation of all ballots, including absentee ballots, and the Village Clerk (or designee) shall be present during such testing. The Village Council hereby authorizes the Supervisor of Elections to tabulate and canvass all ballots cast during the Special Election, including runoffs. The Village Council authorizes the Supervisor of Elections (or designee) to serve as a member of the municipal canvassing board, along with the Village Clerk (or Deputy Village Clerk) and Village Attorney.
