01-22-2015 VC REG-MC� Present: Absent: ROLL CALL MINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JANUARY 22, 2015 Darryl C. Aubrey, Sc.D., Mayor Robert A. Gebbia, Vice Mayor David B. Norris, President Pro Tern Doug Bush, Councilman James P. Kelly, Village Manager Len Rubin, Village Attorney Melissa Teal, Village Clerk William L. Manuel, Councilman Mayor Aubrey called the meeting to order at 7:30 p.m. All members of Council were present, except Councilman Manuel, who was absent due to illness. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Gebbia gave the invocation and Mayor Aubrey led the public in the Pledge of Allegiance. APPROVAL OF MINUTES The Minutes of the Regular Session held January 8, 2015 were approved as written. FIRST READING OF ORDINANCE 2015 -02 — COMPREHENSIVE PLAN TEXT AMENDMENT FOR MIXED -USE ASSISTED LIVING FACILITIES A motion was made by President Pro Tern Norris and seconded by Vice Mayor Gebbia to adopt on first reading Ordinance 2015 -02 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A TEXT AMENDMENT TO THE FUTURE LAND USE ELEMENT OF THE VILLAGE COMPREHENSIVE PLAN TO PROVIDE FOR MIXED -USE ASSISTED LIVING FACILITIES WITHIN COMMERCIAL PLANNED UNIT DEVELOPMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly noted that at the direction of Council, ordinance language requiring that the residential component comprise a minimum of 50% of the gross floor area was deleted, and language was added requiring that the non - residential component be limited to providing goods and services to residents, their visitors and facility staff. Mayor Aubrey opened the public hearing. There being no comments from the public, Mayor Aubrey closed the public hearing. Thereafter, the motion to adopt Ordinance 2015 -02 on first reading passed with all present voting aye. Councilman Bush seconded the motion and all present voted aye. The following items were approved: Resolution 2015 -11 approving sole source purchase of Globe bunker gear from Bennet Fire Products Company, Inc. at a total cost of $13,927.56 Receive for file Minutes of the General Employees Pension Board meeting held 11/6/14 Receive for file Minutes of the Recreation Advisory Board meeting held 1/13/15 RESOLUTION 2015 -12 — SECOND AMENDMENT TO JANITORIAL SERVICES CONTRACT A motion was made by Councilman Bush and seconded by President Pro Tern Norris to adopt Resolution 2015 -12 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPROVING A SECOND AMENDMENT TO THE CONTRACT FOR JANITORIAL SERVICES AT VILLAGE FACILITIES WITH IMAGE JANITORIAL SERVICES, INC. TO MODIFY THE SCOPE OF SERVICES AND ANNUAL COMPENSATION AND TO EXTEND THE TERM; AUTHORIZING THE MAYOR AND VILLLAGE TO CLERK TO EXECUTE SAME; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly detailed the changes to the contract and noted the expiration date would be extended from June 24, 2015 to September 30, 2015. Thereafter, the motion to adopt Resolution 2015 -12 passed with all present voting aye. RESOLUTION 2015 -13 — FRONT -LOAD SANITATION COLLECTION DUMPSTERS PURCHASE A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA APPROVING THE PURCHASE OF 217 FRONT -LOAD SANITATION COLLECTION DUMPSTERS FROM IRON CONTAINER, LLC UTILIZING PRICING ESTABLISHED BY A CITY OF BOYNTON BEACH CONTRACT; AUTHORIZING THE PURCHASE OF RELATED EQUIPMENT; AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO AMEND THE CAPITAL PROJECTS FUND BUDGET TO TRANSFER $118,200.00 FROM THE CAPITAL RESERVE ACCOUNT TO THE SANITATION — MACHINERY AND EQUIPMENT CAPITAL ACCOUNT; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Kelly reviewed the purchase of 217 front -load sanitation collection dumpsters. Mr. Kelly noted that these dumpsters, in conjunction with the purchase of two front -load sanitation collection trucks approved by Council on October 9, 2014, would allow the existing sanitation collection method to be converted from rear -load to front -load. During discussion, Public Works Director Brian Moree explained that the Village would supply and maintain the dumpsters for Village businesses for a lease fee based on the size of the dumpster. Discussion ensued concerning the timetable for completion and when condominiums would be converted to front -load dumpster use. Mr. Moree anticipated that front -load dumpsters would be used for sanitation collection at multi - family residential properties next year. Thereafter, the motion to adopt Resolution 2015 -13 passed with all present voting aye. Minutes of Village Council Regular Session held January 22, 2015 Page 3 of 3 MOTION — PARTIAL RELEASE OF LIEN A motion was made by Councilman Bush and seconded by Councilman Manuel to approve the execution of a Partial Release of Lien to release property located within the City of Lake Worth from the lien imposed by the Village's Code Enforcement Special Magistrate for violations formerly existing at 620 Eastwind Drive. Mr. Kelly and Mr. Rubin presented the issue. Mr. Kelly clarified that he was not seeking the authority to execute Releases on behalf of the Village, as he felt that authority should remain with the Village Council. Discussion was held concerning the requested Partial Release of Lien. Thereafter, the motion passed with all present voting aye. VILLAGE COUNCIL MATTERS /REPORTS Vice Mayor Gebbia reported attending the ethics and sunshine law presentation sponsored by the League of Cities. Vice Mayor Gebbia reviewed items discussed at the recent meeting of the Lake Worth Lagoon Initiative Steering Committee. VILLAGE MANAGER MATTERS /REPORTS Chief Jenkins presented the Police Department's Annual Report.
