12-12-2013 VC WS-MV Present: ROLL CALL MINUTES OF THE WORKSHOP SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA DECEMBER 12, 2013 William L. Manuel, Mayor Darryl C. Norris, Councilman Doug Bush, Councilman Ed Green, Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk Mayor Manuel called the meeting to order at 8:02 p.m. All members of Council were present. All members of staff were present. SEPARATION REQUIREMENTS BETWEEN RESIDENTIAL AND COMMERCIAL PROPERTIES Mr. Green noted this item came forward at a resident's request that Council consider amending the Code of Ordinances to allow a fence or wall to be installed within the front setback of a residential property that abuts a commercial property. Mr. Green reported that most commercial properties that abut residential properties are separated by both an alleyway and a concrete wall maintained by the Village. Mr. Green advised that Section 27 -64 of the Village Code requires a perimeter landscaping buffer no more than three feet in height from the front building line to the edge of the property for any commercial properties abutting other properties. Mr. Green stated that presently Section 45 -36(D) of the Village Code prohibits any fence and /or wall to be erected within the front yard setback and the street line for residential and commercial properties. Mr. Green noted the landscaping code for residential properties does not restrict the height of hedge material planted within the front building setback with the exception of maintaining the required sight triangle. Community Development Director Chuck Huff distributed photos of residential property adjoining commercial property at 2694 Conroy Drive and 2705 Honey Road. Mr. Huff noted that the streets annexed into the Village in 1995 have approximately five residences that abut commercial properties. Mr. Huff stated there is a four -foot concrete block wall between most of the residential and commercial properties in this area. Mr. Huff stated the affected resident has requested to be allowed to have a six -foot barrier between his property and the adjacent commercial property. Discussion took place regarding the sight triangle and the property line in relation to the sidewalk and road right -of -way. Mr. Huff noted that sidewalks in this area are placed six feet from the road, within a 15 -foot buffer. It was noted that the proposed code amendment should stipulate that the fence is located on the side boundary /property line. This item was forwarded to the next Regular Session agenda.
