05-10-1990 VC REG-MMINUTES OF REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, MAY 10, 1990 fl 1 Present: V. A. Marks, M.D., Mayor Jerry G. Gardner, Vice Mayor Judy M. Pierman, President Pro Tem Manny Grinn, Councilman Al Moore, Councilman Dennis W. Kelly, village Manager George W. Baldwin, Village Attorney Dolores R. Walker, Village Clerk ROLL CALL Mayor Marks called the Regular Session to order at 7:30 p.m. All members of the Council and the staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Gardner gave the invocation and Mayor Marks led the Council and the public in the Pledge of Allegiance to the Flag. APPROVAL OF MIZdUTE3 The Minutes of Regular Session held Thursday, April 26, 1990 were approved as written. The Minutes of Recessed Regular Session of April 26, 1990 Reconvened May 1, 1990 were approved as corrected. ACCEPTANCE OE MINUTES The following minutes were accepted as written: Minutes of Recreation Rdvisory Board Meeting held April 10, 1990 Minutes of Public Hearing of Planning Commission held May 1, 1990 Minutes of Planning Commission Meeting held May 1, 1990 The following Minutes were accepted as corrected: Minutes of Board of Adjustment Meeting held September 26, 1989 Minutes of Police and Fire Pension Board Meeting held April 6, 1990 The following minutes were removed from the agenda: Minutes of Country Club Study Committee Meeting held April 5, 1990 i RECOMMENDATIONS OF ADVISORY BOARDS President Pro Tem Pierman moved to accept the recommendation of the Recreation Advisory Board that Council reconsider membership pro- ration for tennis for first-time members for the period up to renewal time. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Marks, Vice Mayor Gardner, President Pro Tem Pierman and Councilman Grinn voting aye and Councilman Moore voting nay. Councilman Grinn moved for pro-ration on a quarterly basis, depending upon what quarter they are coming in, and a one time only basis. The motion was seconded by President Pro Tem Pierman. Vice Mayor Gardner moved to amend the motion as follows: that the Minutes of Regular Session Held Thursday, May 10, 1990 Page 2 pro-ration be based on a monthly basis rather than a quarterly basis. The motion was seconded by Councilman Grinn and passed 4-1, with Mayor Marks, Vice Mayor Gardner, Councilman Moore and Councilman Grinn voting aye and President Pro Tem Pierman voting nay. Thereafter Council voted on the main motion, as amended, which passed unanimously. Councilman Grinn moved to approve .the recommendation of the Planning Commission that Council consider amendments to the Subdivision ordinance, Appendix B of the Village Code. The motion was seconded by vice Mayor Gardner and all present voted aye. 596 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 9-90 vice Mayor Gardner moved that Bill No. 596 entitled: AN ORDINANCE OF THE VILLAGE OE NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET. FOR FISCAL YEAR 1989-90 FOR PUBLIC SERVICES TO PREPARE EQUIPMENT ROOM FOR ANI-ALI SERVICE (911 SYSTEM) be placed on second reading and read by title alone. The motion was seconded by President Pro Tem Pierman and all present voted aye. President Pro Tem Pierman moved to adopt Bill No. 596 as Ordinance No. 9-90. The motion was seconded by Vice Mayor Gardner and all present voted aye. BILL 597 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 10-90 President Pro Tem Pierman moved that Bill No. 597 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH COUNTRY CLUB FUND BUDGET FOR FISCAL YEAR 1989-90 BY APPROPRIATION TRANSFER FROM THE COUNTRY CLUB CONTINGENCY FOR DINING ROOM CHAIRS AND TABLES be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Marks, Vice Mayor Gardner, President Pro Tem Pierman and Councilman Grinn voting aye and Councilman Moore voting nay. President Pro Tem Pierman moved to adopt Bill No. 597 as Ordinance No. 10-90. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Marks, Vice Mayor Gardner, President Pro Tem Pierman and Councilman Grinn voting aye and Councilman Moore voting nay. 598 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 11-90 Councilman Moore moved that Bill No. 598 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE NO. 69-61 OF THE VILLAGE WHICH PROVIDED FOR ISSUANCE OF RECREATIONAL FACILITIES BONDS BY REPEALING SECTION 3 THEREOF WHICH PROVIDED FOR A REVENUE FUND AND RESERVE OPERATION FUND; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Gardner and passed 4-1, with Mayor Marks, Vice Mayor Gardner, Councilman Moore and Councilman Grinn voting aye and President Pro Tem Pierman voting nay. The motion was seconded by Vice Mayor Gardner and all present voted aye. BILL 599 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 12-90 Councilman Moore moved that Bill No. 599 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH COUNTRY CLUB FUND BUDGET FOR FISCAL YEAR 1989-90 TO APPROPRIATE FUNDS FOR EMPLOYEES BENEFIT HEALTH PLAN be placed on second reading and read by title alone. The motion was seconded by Vice Mayor Gardner and all present voted aye. Councilman Moore moved to adopt Bill No. 599 as Ordinance No. 12- 90. BILL 600 PLACED ON SECOND READING & ADOPTED AS ORDINANCE NO. 13-90 Councilman Moore moved that Bill No. 600 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THS NORTH PALM BEACH GENERAL FUND BUDGET FOR FISCAL YEAR 1989-90 TO APPROPRIATE FUNDS FOR EMPLOYEES BENEFIT HEALTH PLAN be placed on second reading and read by title alone. The motion was seconded by President Pro Tem Pierman and all present voted aye. Councilman Moore moved to adopt Bill No. 600 as Ordinance No. 13- 90. The motion was seconded by President Pro Tem Pierman and all present voted aye. RESOLUTION NO. 13-90 ADOPTED Councilman Grinn nominated Bernard C. Capone for appointment to the Code Enforcement Board. There being no further nominations, Mr. Capone was appointed to the Code Enforcement Board, and his name was placed on Resolution No. 13-90. Councilman Grinn moved that Resolution No. 13=90 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OE NORTH PALM BEACH, FLORIDA, APPOINTING A MEMBER TO THS CODS ENFORCEMENT BOARD be adopted. The motion was seconded by Councilman Moore and all present voted aye. RESOLUTION NO. 14-90 ADOPTED Councilman Moore moved that Resolution No. 14-90 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, STRONGLY OPPOSING THS PROPOSED TWO PERCENT (2%) SALES TA% ON MEALS IN ALL RESTAURANTS WHICH SERVE ALCOHOLIC BEVERAGES TO FUND A CONVENTION CENTER AUTHORITY IN PALM BEACH COUNTY; OPPOSING THE FORMATION OF A NEW SPECIAL DISTRICT TO PROMOTE A CONVENTION CENTER IN PALM BEACH COUNTY, OR, IN THE ALTERNATIVE, URGING THAT SPECIAL PROJECTS SUCH AS THE PROPOSED COUNTY CIVIC CENTER BE FINANCED WHOLLY BY RENT AND OTHER CHARGES TO THE ULTIMATE USERS OF THOSE FACILITIES; DIRECTING THE VILLAGE CLERK TO SUBMIT COPIES OF THIS RESOLUTION TO THE LEGISLATIVE DELEGATION OE PALM BEACH COUNTY, THE PALM BEACH COUNTY MUNICIPAL LEAGUE, THS FLORIDA LEAGUE OF CITIES, AND THE Minutes of Regular session Held Thursday, May 10, 1990 Page 4 BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY; AND ' PROVIDING FOR AN EFFECTIVE DATE be adopted.
