2001-06 Fee Increases for P, Z, & Admin FunctionsORDINANCE NO. 06-2001 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING VARIOUS SECTIONS OF THE CODE OF ORDINANCES OF THE VILLAGE BY ESTABLISHING AND SETTING FORTH FEE INCREASES FOR VARIOUS PLANNING, ZONING AND ADMINISTRATIVE FUNCTIONS OF THE VILLAGE OF NORTH PALM BEACH; AMENDING SECTION 7-19, APPLICATION FEES, OF ARTICLE II, FILLING PERMIT, OF CHAPTER 7, BULKHEAD LINES; AMENDING SUBSECTION (c) OF SECTION 21-1, SAME -FILING FEES AND COSTS FOR CHANGES OF ARTICLE I OF CHAPTER 21, PLANNING AND DEVELOPMENT; AMENDING SUBSECTION (c) OF SECTION 21-2, FILING FEES AND COSTS FOR VOLUNTARY ANNEXATION OF LAND, OF ARTICLE I OF CHAPTER 21, PLANNING AND DEVELOPMENT; AMENDING SUBSECTION (3), FEES, OF SECTION 36-10, PRELIMINARY PLAT PROCEDURE, OF ARTICLE II, PROCEDURES FOR SUBDIVISION PLAT APPROVAL, OF APPENDIX B - SUBDIVISIONS; AMENDING SUBSECTION (2), SUBMISSION AND REVIEW OF CONSTRUCTION PLANS, OF SECTION 36- 12, CONSTRUCTION PLANS PROCEDURE, OF ARTICLE II, PROCEDURES FOR SUBDIVISION PLAT APPROVAL, OF APPENDIX B -SUBDIVISIONS; AMENDING SUBSECTION (6), FEES, OF SECTION 36-38.1, LAND CLEARING; VEGETATION AND WILDLIFE PROTECTION AND PRESERVATION, OF ARTICLE V OF APPENDIX B -SUBDIVISIONS; AMENDING SUBSECTION 1 OF SECTION 45-49, APPLICATIONS FOR REZONING, ETC. OF ARTICLE VI, AMENDMENTS -FEES; WAITING PERIODS OF APPENDIX C, ZONING; AMENDING SUBSECTION 1 OF SECTION 45-50, APPLICATION FOR VARIANCES, OF ARTICLE VI, AMENDMENTS - FEES; WAITING PERIODS OF APPENDIX C -ZONING; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section ] . Section 7-19, application fees, of Article II, Filling Permit, of Chapter 7, Bulkhead Lines, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 7-19. Application fees. • Each application for a permit required by this article submitted to the Village Clerk shall be accompanied by a deposit of the estimated costs of the Village in processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising and cost of review by the Village engineer prior to final consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant. Each change in plans and specifications subsequent to the issuance of a permit shall be the subject of a new or supplemental application and a like fee shall be paid upon the filing of such application as was paid in the case of the original application." Section 2. Subsection (c) of Section 21-1, same -filing fees and costs for changes, of Article I of Chapter 21, Planning and Development, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 21-1. Same -Filing fees and costs for changes. (c) Fees; application. All petitions to amend the village Comprehensive plan shall be done by application to the village Council. The application to the village council may be made by any owner of property located within the village. Such application shall be filed with the building department of the village, which shall transmit the same, together with all legal descriptions, ownership information, requested change to the comprehensive plan, etc., to the village council. Any such application must be accompanied by a filing fee of three hundred dollars ($300.00) together with a deposit of the estimated costs of the Village in processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising and cost of review by the Village engineer prior to final consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant.." Section 3. Subsection (c) of Section 21-2, Filing fees and costs for voluntary annexation of land, of Article I of Chapter 21, Planning and Development, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 21-2. Filing fees and costs for voluntary annexation of land. (c) Fees; application. All applications for voluntary annexation of land to the • village shall be done by application to the village council. The application to the village council may be made by any property owner of property contiguous to the village. Such application shall be filed with the building • department of the village, which shall transmit the same, together with all legal descriptions, ownership information, etc., to the village council. Any such application must be accompanied by a filing fee of two hundred dollars ($200.00) together with a deposit of the estimated costs of the Village in processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising and cost of review by the Village engineer prior to final consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant." Section 4. Subsection (3), Fees, of Section 36-10, Preliminary Plat Procedure, of Article II, Procedures for Subdivision Plat Approval, of Appendix B - Subdivisions, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 36-10. Preliminary plat procedure. (3) Fees. A filing fee of three hundred dollars ($300.00) shall be paid to the village by the subdivider at the time of filing the application together with a deposit of the estimated costs of the Village in processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising and cost of review by the Village engineer prior to final consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant." Section 5 Subsection (2), Submission and Review of Construction Plans, of Section 36-12, Construction Plans Procedure, of Article II, Procedures for Subdivision Plat Approval, of Appendix B, Subdivisions, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 36-12. Construction plans procedure. (2) Submission and review of construction plans. The subdivider shall submit four (4) sets of prints approved by all interested agencies of the completed construction plans and the approved preliminary plat to the department of public services along with a filing fee of three hundred dollars ($300.00) together with a deposit of the estimated costs of the Village in processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising and cost of review by the Village engineer prior to final • consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant. Following review, if the construction plans are consistent with the approved preliminary plat and comply with all standards and specifications, the village engineer shall notify the subdivider and the department of public services of construction plan approval. If the construction plans are not consistent with the approval preliminary plat or do not comply with all standards and specifications, the village engineer shall notify the subdivider and the department of public services: (a) Conditional construction plan approval, subject to any necessary modifications which shall be indicated on the plans or attach to it in writing; or (b) Disapproval of the construction plans or any portion thereof, indicating in writing the reasons for such disapproval." Section 6. Subsection (6), Fees, of Section 36-38.1, Land Clearing; Vegetation and Wildlife Protection and Preservation, of Article V of Appendix B -Subdivisions, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 36-38.1. Land clearing; vegetation and wildlife protection and preservation. (ti) Fees. The charge for the implementation of this Section shall be two hundred dollars ($200.00) per acre or fraction thereof" Section 7. Subsection (1) of Section 45-49, Applications for Rezoning, etc. of Article VI, Amendments -Fees; Waiting Periods, of Appendix C-Zoning, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 45-49. Applications for rezoning, etc. (1) All applications for rezoning and all applications to amend,supplement, modify or repeal the boundaries, districts, regulations or restrictions established by this chapter shall be done by application to the planning commission of the village. The application to the planning commission tnay be made by any property owner or tenant or by a governmental office, . department, board or bureau. Such applications shall be filed with the building department of the village, which shall transmit the same, together 4 with all the plans, specifications, application blank and other papers • pertaining to the application, to the planning commission. Any such application, except by a governmental agency, must be accompanied by a filing fee of three hundred dollars ($300.00) together with a deposit of the estimated cost of the Village processing the application. Upon the Village determining the actual costs, applicants shall pay the balance, if any, in full of such costs including advertising prior to final consideration of the application. If the deposit exceeds actual costs, the balance shall be refunded to applicant." Section 8. Subsection (1) of Section 45-50, Application for Variances, of Article V I, Amendments -Fees; Waiting Periods of Appendix C -Zoning, of the Code of Ordinances of the Village is hereby amended to read as follows: "Section 45-50. Application for variances. (1) All applications for variances to regulations or restrictions established by this ordinance shall be done by application to the board of adjustment of the village. The application to the board of adjustment may be made by any property owner or tenant or by a governmental office, department, board or bureau. Such applications shall be filed with the building inspector of the village, who shall transmit the same, together with all the plans, specifications, application blank and other papers pertaining to the application, to the board of adjustment. Any such application, except by a governmental agency, must be accompanied by a filing fee of two hundred dollars ($200.00)." Section 9 . If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Couri to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 10. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 11.
