2001-05 Cantilevered Canvas Awnings ExceptionORDINANCE 05-2001 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE DEFINITION OF "FRONT, SIDE AND REAR LINE OF A BUILDING" OF SECTION 45-2, DEFINITIONS, OF ARTICLE I OF APPENDIX C, ZONING, OF THE CODE OF ORDINANCES OF THE VILLAGE TO PROVIDE AN EXCEPTION BY ALLOWING CANTILEVERED CANVAS AWNINGS TO EXTEND NO MORE THAN EIGHT (8) FEET INTO THE REQUIRED FRONT, SIDE OR REAR SETBACK AND SHALL BE SET BACK TWO (2) FEET FROM THE SIDE PROPERTY LINE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The definition of "front, side and rear line of a building" of Section 45-2, Definitions, of Article I of Appendix C, Zoning of the Code of Ordinances of the Village is hereby amended to read as follows: "Front, side and rear line of a building shall be deemed and construed to include both the main portion of such structure and all projections therefrom, including any garage, carport or an extended roof beyond the normal eave or cornice forming a cover or roof over an entrance to such dwelling. Any awnings or shutters supported by vertical posts, columns or pipes shall also constitute the building line. The building line shall not include the eaves of such structures nor any open terraces, stoops, steps, or planting boxes which do not extend more than four (4) feet above the level of the yard grade. Exception. Cantilevered canvas awnings may extend no more than eight (8) feet into the required front, side or rear setback and shall be set back two (2) feet from the side property line." Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. • • Section 4. This Ordinance shall take effect immediately upon passage.
