2001-04 Amends Definition for Private DockORDINANCE 04-2001 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM • BEACH, FLORIDA, AMENDING THE DEFINITION FOR PRIVATE DOCK, PIER, MOORING BUOY AND FLOATING ANCHOR CONTAINED WITHIN SECTION 5-81, DEFINITIONS, OF DIVISION 4, DOCKS AND PIERS, OF ARTICLE III OF CHAPTER 5, BOATS, DOCKS AND WATERWAYS, OF THE CODE OF ORDINANCES OF THE VILLAGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The definition for private dock, pier, mooring buoy and floating anchor contained within Section 5-81, Definitions, of Division 4, Docks and Piers, of Article III of Chapter 5, Boats, Docks and Waterways, of the Code of Ordinances of the Village is hereby amended to read as follows: "Private dock, pier, mooring buoy and floating anchor mean those that shall only be used by the occupant and his family and shall be constructed only in R-1 and R-2 Zoning Districts. A private dock, pier, mooring buoy or floating anchor shall not be rented or leased." Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall take effect immediately upon passage.
