07-11-2013 VC REG-MMINUTES OF THE REGULAR SESSION VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA JULY 11, 2013 Present: William L. Manuel, Mayor Darryl C. Aubrey, Sc.D., Vice Mayor Robert A. Gebbia, President Pro Tem David B. Norris, Councilman Doug Bush, Councilman Ed Green, Village Manager Leonard Rubin, Village Attorney Melissa Teal; Village Clerk ROLL CALL Mayor Manuel called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Councilman Norris gave the invocation and Mayor Manuel led the public in the Pledge of Allegiance. APPROVAL OF MINUTES The Minutes of the Regular Session held June 27, 2013 were approved as written. SECOND READING AND ENACTMENT OF ORDINANCE 2013 -10 — BUDGET AMENDMENT FOR VETERANS MEMORIAL PARK A motion was made by Councilman Bush and seconded by Vice Mayor Aubrey to adopt and enact on second reading Ordinance 2013 -10 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE ADOPTED GENERAL FUND BUDGET FOR FISCAL YEAR 2012 -2013 TO APPROPRIATE $400,000.00 FROM THE RECREATION DEVELOPER FEES ACCOUNT TO FUND THE CONSTRUCTION OF VETERANS MEMORIAL PARK; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Green noted that Section 36 -23 of the Village Code of Ordinances authorizes the use of developer fees for parks and recreational purposes. Mr. Green reported the estimated cost of the project at $400,000, including approximately 8.5% contingency. Mr. Green advised that the budget amendment to appropriate funds for the project must be accomplished by ordinance. Mayor Manuel opened the public hearing. There being no comments from the public, Mayor Manuel closed the public hearing. Harry Padula, Executive Vice President of MVP Contractors, Inc., the lowest bidder on the project, addressed the Council concerning his past park construction experience with Padula and Wadsworth Construction. A list of park projects in Palm Beach and Broward counties was distributed. Mr. Padula advised that he would personally oversee construction of Veterans Memorial Park. Thereafter, the motion to adopt and enact Ordinance 2013 -10 on second reading passed unanimously. Councilman Norris seconded the (> motion and all present voted aye. The following items were approved: Resolution 2013 -35, amending Resolution 2013 -34 to adopt a new contract for the sole source purchase of a Sports Cluster Green Lighting System from Musco Sports Lighting LLC, for Osborne Park utilizing grant funds Receive for file Minutes of the Recreation Advisory Board meeting held 6/11/2013 RESOLUTION 2013 -36 — VETERANS MEMORIAL PARK PROJECT BID AWARD A motion was made by Councilman Bush and seconded by President Pro Tern Gebbia to adopt Resolution 2013 -36 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA ACCEPTING THE BID SUBMITTED BY M.V.P. CONTRACTORS, INC. FOR THE CONSTRUCTION OF VETERANS MEMORIAL PARK AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A CONTRACT RELATING TO SUCH SERVICES; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Green reported that the lowest bid received for construction of Veterans Memorial Park was $268,237.71 from MVP Contractors, Inc. Mr. Green and Community Development Director Chuck Huff detailed project changes, including elimination of parallel parking on Eastwind Drive, that are expected to reduce the cost of the project by approximately $13,000. Thereafter, the motion to adopt Resolution 2013 -36 passed unanimously. RESOLUTION 2013 -37 — MARKET RESEARCH SERVICES CONTRACT A motion was made by Councilman Bush and seconded by President Pro Tem Gebbia to adopt Resolution 2013 -37 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA ACCEPTING THE PROPOSAL SUBMITTED BY BENDIXEN & AMANDI INTERNATIONAL, INC. FOR MARKET RESEARCH SERVICES AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A CONTRACT RELATING TO SUCH SERVICES; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Green discussed the proposal received from Bendixen and Amandi International, Inc. to provide market analysis services to the Village. Mr. Green recommended selecting Option B, which utilizes Village support services, and conducting four focus groups for a total cost of $31,000. Mr. Green reviewed the services to be provided by the Village and their anticipated cost. Mr. Green advised that work on the project would not begin until after October, in order to include seasonal residents in the research, and contractual services are contingent upon appropriation of the required funds in the Fiscal Year 2014 General Fund Budget. Erin St. Onge - Carpenter, Project Manager and Senior Research Consultant, Bendixen and Amandi International, Inc. was present to answer questions concerning the proposal. Discussion ensued regarding Council input as part of the stakeholder interview process, as well as the cash incentives to be offered to focus group participants. Thereafter, the motion to adopt Resolution 2013 -37 passed unanimously. Minutes of Village Council Regular Session held July 11, 2013 Page 3 of 3 MAYOR AND COUNCIL MATTERS /REPORTS Discussion took place concerning the request for a Council representative to the Palm Beach County Issues Forum regarding the matter of FEMA flood maps. Mayor Manuel volunteered to serve in this capacity; however, he suggested that the representative be designated by position rather than by name, so that should this issue continue past his term, the next Mayor would serve as the Council's representative to the Issues Forum. A motion was made by President Pro Tem Gebbia, seconded by Councilman Bush, and passed unanimously, to designate the Mayor of North Palm Beach to serve as the Village's elected representative on the Issues Forum.
