1999-11 Amends Boats, Docks, Waterways CodeORDINANCE NO. 11-99 AN ORDINANCE OF THE VII,LAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING VARIOUS SECTIONS OF CHAPTER 5, BOATS, DOCKS AND WATERWAYS, OF THE CODE OF ORDINANCES OF THE VIl,LAGE; AMENDING THE DEFINITION OF WATERWAY IN SECTION 5-1, DEFINITIONS; AMENDING SECTION 5-9, MOORING AT PRIVATE DOCKS WITHOUT PERMISSION, TO INCLUDE PROHIBITIONS AS TO MOORING OF BOATS AT PUBLIC SEA WALLS, DOCKS OR BEACHES; AMENDING SUB-SECTION (7) OF SECTION 5-85, REGULATIONS GOVERNING CONSTRUCTION IN LAKE WORTH AND ATLANTIC OCEAN, TO PROVIDF~ CONSTRUCTION REQUIItEMENT5 FOR DOCKS; PROVIDING FOR SEVERABII,ITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, • FLORIDA: Section I. Section 5-1, Definitions, of Chapter 5, Boats, Docks and Waterways, of the Code of Ordinances of the Village of North Palm Beach is hereby amended to read as follows: "Waterway means any waters, waterway, lake, river, tributary, canal, lagoon or connecting waters within the boundaries of the Village." Section 2. Section 5-9, Mooring at Private Docks without Permission, of Chapter 5, Boats, Docks and Waterways of the Code of Ordinances of the Village of North Palm Beach is hereby amended to read as follows: "Section 5-9. Mooring at private docks without permission. No person shall moor a boat at a private or public seawall or dock or beach if upon . private or public property within the Village without the permission of the owner or • public entity thereof" Section 3. Sub-section (7) of Section 5-85, Regulations governing construction in Lake Worth and Atlantic Ocean, of Chapter 5, Boats, Docks and Waterways, of the Code of Ordinances of the Village of North Palm Beach is hereby amended to read as follows: "(7) All piers and docks shall be constructed with all major components including piling; beams, decks, etc., constructed of reinforced concrete. Piers shall have a maximum width often (10) feet, and a minimum width of six (6) feet." Section 4. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is • • for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 6. This Ordinance shall take effect immediately upon passage.
