ORDINANCE NO. 04-99
AN ORDINANCE OF THE VILLAGE COUNCII. OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, AMENDING VARIOUS SECTIONS OF ARTICLE
II, COUNTRY CLUB ADM1IdISTRATIVEBQARD, OF CHAPTER 9, COUNTRY
CLUB, OF THE CODE OF ORDINANCES OF THE VILLAGE; AMENDING THE
TITLE AND SECTION 9-16 BY CHANGING THE NAME OF THE COUNTRY
CLUB ADMINISTRATIVE BOARD TO COUNTRY CLUB ADVISORY BOARD;
AMENDING SECTION 9-18 (REMOVAL) TO PROVIDE FOR REMOVAL OF
A MEMBER UPON FAILURE TO ATTEND TWO SUCCESSIVE REGULAR
MEETINGS; AMENDING SECTION 9-20 (MEETINGS) TO PROVIDE THAT
THE BOARD SHALL MEET AT LEAST ONE TIIvIE PER MONTH; AMENDING
SECTION 9-21 (a) TO PROVIDE THAT THE BOARD SHALL RECOMMEND
POLICIES TO THE VILLAGE COUNCIL AND THAT THE DUTIES OF THE
BOARD ARE TO BE SET FORTH BY RESOLUTION; PROVIDING THAT THE
COUNTRY CLUB ADMINISTRATOR SHALL HAVE DAILY MANAGEMENT
AND ADMINISTRATION OF THE COUNTRY CLUB AND REPORT TO THE
VILLAGE MANAGER; AMENDING SECTION 9-21 (b) TO PROVIDE THAT
THE COUNTRY CLUB ADMINISTRATOR SHALL SERVE AS THE VILLAGE
• MANAGER'S REPRESENTATIVE TO THE BOARD; AMENDING SECTION
9-2] (d) TO PROVIDE THAT THE COUNTRY CLUB BUDGET SHALL BE
PREPARED AND PROCESSED AS OTHER DEPARTMENTAL BUDGETS;
REPEALING SECTION 9-21 (e), PURCHASE ORDERS, AND SECTION 9-2] (~,
EVALUATIbN OF CLUB ADMINISTRATOR; REPEALING SECTION 9-22,
VILLAGE MANAGER; PROVIDING FOR SEVERABILITY; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORT)-I PALM BEACH,
FLORIDA:
Section 1. The title of Article II and Section 9-16 of Article II, Administrative
Board of Chapter 9, Country Club, of the Code of Ordinances of the Village is hereby amended to
read as follows:
"Artidle II. Advisory Board
• Section 9-16 Created.
• A country club advisory board (hereinafter referred to as the board) for the village is
hereby created."
i 2. Section 9-18, removal, of Article II, Advisory Board, of Chapter 9,
Country Club, of the Code of Ordinances of the Village is hereby amended to read as follows:
"Section 9-18. Removal.
Members of the board shall serve at the pleasure of the Village Council and maybe
removed at any time with or without cause. If any member fails to attend two (2)
successive regular meetings without a board's excused absence, the Board shall
declare the member's office vacant and the Village Council shall promptly fill such
vacancy for the unexpired term of office."
i 3. Section 9-20, Meetings, of Article II, Advisory Board, of Chapter 9,
Country Club, of the Code of Ordinances of the Village is hereby amended to read as follows:
"Section 9-20. Meeti~7gs.
• The board shall schedule at least one regular meeting per month. In addition, the
chairman may call special meetings and special meetings may be called by written
notice signed by at least four (4) members of the board. Minutes shall be kept of all
meetings. Notice of all meetings shall be posted in accordance with the procedures
estabhished by the Village Council. All meetings shall be open to the public. The
attorney for the Village may give legal assistance to the board as required. The Board
shall enact or adopt rules for the conduct of its meeting. All members shall be
apprised of the applicability of the "sunshine law" to the Board and its members."
Section 4. Section 9-21(a), Duties, of Article II, Advisory Board, of Chapter 9,
Country Club, of the Code of Ordinances of the Village is hereby amended to read as follows:
"(a) Management and administration policies.
The Board shall have such duties as set forth by the Village Council by Resolution.
The Board shall advise and recommend policies, programs and activities to the Village
Council as they relate to the use of the country club facilities. The board in its
recommendations for the country club shall not discriminate between club members
and village resident non-members which would favor the club members' accessibility
to club facilities.
• The country club administrator shall provide for the daily management, administration
and operation of the country club and shall report to the Village Manager."
Section 5. Section 9-21(b), Country Club Administrator, of Article II, Advisory
• Board, of Chapter 9, Country Club, of the Code of Ordinances of the Village is hereby amended to
read as follows:
"(b) Cotrrrtry Club Admniistrator.
The Country Club Administrator shall serve as the Village Manager's representative
to the Country Club Administrative Board."
i n 6 Section 9-21(d), Capital improvement programs, of Article II, Advisory
Board, of Chapter 9, Country Club, of the Code of Ordinances of the Village is hereby retitled and
amended to read as follows:
"(d) Country Club Budget.
The country club budget shall be prepared and processed as other departmental
budgets."
• i n 7. Section 9-21 (e), Purchase Orders, and Section 9-21 (f), Evaluation of
Club Administrator, of Article II, Advisory Board, of Chapter 9, Country Club, of the Code of
Ordinances of the Village are hereby rescinded and repealed.
i ~n 8. Section 9-22, Village Manager, of Article II, Country Club Advisory
Board, of Chapter 9, Country Club, of the Code of Ordinances of the Village is hereby rescinded and
repealed.
Section 9. If any section, paragraph, sentence, clause, phrase or word of this
Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding
shall not affect the remainder of this Ordinance.
Section ]0. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
• Section 11. This Ordinance shall take effect immediately upon passage.
