1998-13 Amends Code on Docks & PiersORDINANCE 13-98 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE DEFINITION FOR PRIVATE DOCK IN SECTION 5-81, DEFINITIONS, OF DIVISION 4, DOCKS AND PIERS, OF ARTICLE III OF CHAPTER 5 OF THE CODE OF ORDINANCES OF THE VILLAGE; ADDING A SUBSECTION (12) TO SECTION 5-85 TO PROVIDE FOR MOORING BUOYS AND FLOATING ANCHORS IN LAKE WORTH AND THE ATLANTIC OCEAN; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 5-81, Definitions, of Division 4, Docks and Piers, of Article III of Chapter 5 of the Code of Ordinances of the Village is amended by changing the definition for private dock to read as follows: • "Private Dock, pier, mooring buoy and floating anchor mean those that shall only be used by the owner and his family and shall be constructed only in R-1 and R-2 Zoning Districts. A private dock, pier, mooring buoy or floating anchor shall not be rented or leased." Section 2. Section 5-85 of Division 4, Docks and Piers, of Article III of Chapter 5 of the Code of Ordinances of the Village is amended by adding asub-section (12) to read as follows: "(12) Mooring buoys and floating anchors shall be placed a maximum of seventy (70) feet from the face of the bulkhead or the shore." Section 3. If any section, paragraph, sentence, clause, phrase or word of this ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall • not affect the remainder of this Ordinance. Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. • Section 5. This Ordinance shall take effect immediately upon passage.
