Definitions to Zoning CodeAdds Commercial Definitions to Zoning Coden U ORDINANCE NO. 04-98 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 45-2, DEFINITIONS, OF ARTICLE I OF APPENDIX C, ZONING, OF THE CODE OF ORDINANCES OF THE VILLAGE BY ADDING DEFINITIONS THERETO FOR THE TERMS TRANSIENT COMMERCIAL, RETAIL COMMERCIAL, NON--RETAIL COMMERCIAL AND MIXED-USE COMMERCIAL; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: • Section 1. Section 45-2, Definitions, of Article I of Appendix C, Zoning, of the Code of Ordinances of the Village, is hereby amended by adding Definitions thereto for the terms transient commercial, retail commercial, non-retail commercial and mixed-use commercial, and to read as follows: Transient Commercial - Any one, or a combination of the following businesses oriented to serving either Village residents or the motoring public (i.e. in transit through or visiting the area); (1) The sale of fuel, convenience goods and/or minor vehicular repair services; (2) hotel and/or motel accommodations; (3) restaurant facilities; (4) florist, tobacco store and stand, and hobbies, toys and games. Retail Commercial - Any business classified as a "retail trade" establishment using the Standard Industrial Code (S.I.C.) system, provided that such business is • permitted by the Village Code of Ordinances. Non-Retail Commercial - Any business classified as other than "retail trade" using the Standard Industrial Code (S.I.C.) System, provided that such business is permitted by the Village Code of Ordinances. Mixed-Use Commercial - A combination of retail commercial and non-retail commercial businesses where non-retail tenants comprise fifty percent (50~) or more of the gross floor area. Any combination of retail and non-retail businesses where the retail component comprises fifty percent (SOg) or more of the gross floor area shall be classified as a retail commercial facility." Section 2. If any section, paragraph, sentence, clause, J phrase or word of this ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall take effect immediately upon passage.
