1998-01 Amends Neighborhood Comm. ZoningAmends Neighborhood Comm. Zoning ORDINANCE NO. 01-98 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 45-33, C-1 NEIGHBORHOOD COMMERCIAL DISTRICT, OF ARTICLE III OF APPENDIX C, ZONING, OF THE CODE OF ORDINANCES OF THE VILLAGE BY ADDING A GENERAL DESCRIPTION OF THE DISTRICT; AMENDING SUBSECTION A, USES PERMITTED; AMENDING SUBSECTION C, BUILDING AREA REGULATIONS; AMENDING SUBSECTION D, YARD SPACE REGULATIONS; AMENDING PARAGRAPH 1 OF SUBSECTION E, OFF- STREET PARKING REGULATIONS; REPEALING PARAGRAPH 1 OF SUBSECTION F, FLOOR AREA REGULATIONS; AMENDING SUBSECTION G, CONDITIONS FOR PERMITTED USES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 45-33, C-1 Neighborhood Commercial District, of Article III of Appendix C, Zoning, of the Code of Ordinances of the Village is amended by adding a general description of the District at the inception of the Section as follows: "General Description. This Neighborhood Commercial District is established to provide that the principal use of land is devoted to Neighborhood and Transient uses and to encourage the development of these locations for such uses and in such a manner as to minimize congestion and interference with other land uses." • Section 2. Subsection A, Uses Permitted, of Section 45- 33, C-1 Neighborhood Commercial District, of Article III of • Appendix C, Zoning, of the Code of Ordinances of the Village is hereby amended to read as follows: "A. Uses Permitted. Within any C-1 Neighborhood Commercial District, no building structure, land or water shall be used, except for one (1) or more of the following uses: 1. Any use permitted in the C-lA Limited Commercial District. 2. Any retail business or commercial use including neighborhood commercial use that meets the daily living needs of Village Residents and which does not involve the manufacturing or processing of products; provided, however, automobile repair shops are not a permitted use except as an accessory use to an automotive service station or retail automobile tire store. 3. Transient commercial uses serving either the motoring public or Village residents including hotels and motels, conference and retreat facilities, filling stations and restaurants, excluding those with a drive-through. 4. Personal service establishments, including, but not limited to, banks, barbershops, bowling alleys, beauty salons, medical and dental clinics, professional and other offices, funeral homes, shoe repair shops, laundry pickup stations and self- service laundries, furniture display stores and drugstores. 5. Mobile home park. 6. Adult entertainment establishments. 7. Religious worship or related religious activities.~~ Section 3. Subsection C of Section 45-33, C-1 Neighborhood Commercial District, of Article III of Appendix C, Zoning of the Code of Ordinances of the Village is retitled to read • 2 • "Building and Floor Area Regulations" and is hereby amended to read as follows: "Building and Floor Area Regulations. An individual retail business or commercial use shall not exceed 50,000 square feet of floor area on the first floor; this provision shall not apply to grocery stores, food stores or facilities for use for religious worship or related religious uses including retreats, conferences, school or other educational uses, convent, rectory or other living facilities, administration or similar facilities owned or operated by religious groups or religious- related activities." Section 4. Subsection D, yard space regulations, of Section 45-33, C-1 Neighborhood Commercial District, of Article III of Appendix C, Zoning, of the Code of Ordinances of the Village is • hereby amended to read as follows: "D Yard space regulations. There shall be a front yard of not less than fifty (50) feet measured from the street line to the front building line, except along both sides of U.S. 1, no setback less than one hundred (100) feet in depth measured from the front building line shall be provided. For a distance of one (1) block on streets intersecting U.S. 1, measured from the right-of-way line of said U.S. 1, side yards of at least twenty-five (25) feet in depth shall be provided." Section 5. Paragraph 1 of Subsection E, Off-street parking regulations, of Section 45-33, C-1 Neighborhood Commercial District, of Article III of Appendix C, Zoning, of the Code of Ordinances of the Village is amended to read as follows: "1. Same as for the C-lA limited commercial district for churches, motels, hotels, time-share units and • restaurants." 3 Section 6. Paragraph 1 of Subsection F, Floor area regulations, is hereby repealed. Section 7. Subsection G, conditions for permitted uses, of Section 45-33, C-1 Neighborhood Commercial District, of Article III of Appendix C, Zoning, of the Code of Ordinances of the Village is hereby amended to read as follows: "G. Conditions for permitted uses. 1. A car wash and car waxing business whether in conjunction with a filling station or as an independent enterprise shall be allowed to utilize an awning structure or structures which shall be located in the rear yard with a minimum five-foot • setback and within the building aide lines extended. 2. All activities, sales and storage of goods must be conducted entirely within completely enclosed buildings with permanent nonmoving outside walls. 3. No outside sidewalk or parking lot storage or display of merchandise will be permitted." Section 8. If any section, paragraph, sentence, clause, phrase or word of this ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 9. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 10. This Ordinance shall take effect immediately • 4 • upon passage.
