AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING THE DEFINITION OF LOS (INTERIM) FOR
CAPITAL ROAD FACILITIES IN SECTION 21-44 OF ARTICLE IV.,
CONCURRENCY MANAGEMENT, OF CHAPTER 21 OF THE CODE OF ORDINANCES OF
THE VILLAGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL
OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. The definition of LOS (Interim) for capital
• road facilities in Section 21-44 of Article IV., Concurrency
Management, of Chapter 21 of the Code of Ordinances of the Village
is hereby amended to read as follows:
"LOS for capital road facilities: The Average Annual
Daily/Peak Hour LOS Standards, consistent with the
Florida Department of Transportation minimum
acceptable operating levels of service standards, shall
be as follows:
(1) County Road A-1-A-D/D;
(2) Prosperity Farms Road - D/D;
(3) Highway No. 1 and Northlake Boulevard - D/D;
and
(4) Lighthouse Drive -D/D
The evaluation of current and proposed levels of service
on functionally grouped roadways shall be based upon
• Level-of-Service D traffic volumes in Tables 4-1 and
4-2 of the Village Comprehensive Plan."

Section 2. If any section, paragraph, sentence, clause,
phrase or word of this Ordinance is for any reason held by a Court
to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 3. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 4. This Ordinance shall take effect immediately
upon passage.
