2008-06 Unauthorized Lodging & Camping• ORDINANCE 2008-06 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 19, "OFFENSES AND MISCELLANEOUS PROVISIONS," OF ARTICLE I, "IN GENERAL," OF THE VILLAGE CODE OF ORDINANCES TO ADOPT A NEW SECTION 19-11, "UNAUTHORIZED LODGING AND CAMPING," TO RESTRICT LODGING IN SPECIFIED AREAS NOT INTENDED FOR SUCH PURPOSES; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village has discovered persons establishing temporary living quarters in publicly and privately-owned spaces not intended for such purposes, such as within vehicles, underneath bridges, within vacant buildings, and within existing garages, sheds and meter rooms; and WHEREAS, such spaces lack any amenities for lodging, including, but by no means limited to, sanitary facilities, and even if only utilized on a temporary basis, their use for lodging poses a threat to the public health, safety and welfare; and WHEREAS, the Village Council determines that the adoption of an ordinance prohibiting lodging in such spaces is in the best interests of the Village's residents and citizens. • NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals aze ratified as true and correct and aze incorporated herein. Section 2. The Village Council hereby adopts a new Section 19-11 of Article I, "In General," of Chapter 19, "Offenses and Miscellaneous Provisions," of the Village Code of Ordinances to read as follows (additional language is underlinedl: Sec. 19-11. Unauthorized lodging and camaine. It shall be unlawful for any person within the Village to lodge for any length of time within sheds, garages, meter morns, unoccupied buildings and vehicles or within any other conveyance or structure not intended for lodging. It shall also be unlawful to lodge or camp for any length of time on any~ublic nroperty not authorized for this puroose or on private nronertv without the permission and consent of the property owner. Section 3. The provisions of this Ordinance shall become and be made a part of the Code of the Village ofNorth Palm Beach, Florida. • Section 4. If any section, pazagraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Page 1 oft • Section 5. All ordinances or parts of ordinances and resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6.
