ORDINANCE NO. 15-91
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SECTION 28-1 OF CHAPTER 28, USE OF RIGHTS-
OF-WAY FOR UTILITIES, OF THE CODE ORDINANCES OF THE VILLAGE TO
PROVIDE THAT CHAPTER 28 DOES NOT APPLY TO CABLE TELEVISION SYSTEMS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,

FLORIDA:
Section 1. Section 28-1 of Chapter 28, Use of Rights-of-Way
for Utilities, of the Code of Ordinances of the Village is hereby
amended to read as follows:
"Sec. 28-1. Rules and regulations adopted.
The Village hereby prescribes and adopts the rules and
regulations [set out in this chapter) with reference to
the placing and maintaining along, across or on any road
under the Village's jurisdiction any electrical
transmission, telephone, or telegraph lines, pole lines,
poles, railways, ditches, sewers, water, heat, or gas mains,
pipelines, fences, gasoline tanks and pumps, or other
structures, hereinafter referred to as the '~utility'~. The
provisions of Chapter 28 do not apply to cable television
systems or cable television franchises."
Section 2. If any section, paragraph, sentence, clause,
phrase or word of this Ordinance is for any reason held by a Court
to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance,
Section 3. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 4. This Ordinance shall take effect immediately upon
passage.
