A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF

NORTH PALM BEACH, FLORIDA, RATIFYING A THIRD ADDENDUM
AMENDING ARTICLE ' 31 OF THE COLLECTIVE BARGAINING
AGREEMENT WITH THE PALM BEACH COUNTY POLICE BENEVOLENT
ASSOCIATION RELATING TO WAGES FOR BARGAINING UNIT
'MEMBERS AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO
EXECUTE THE ADDENDUM; PROVIDING . FOR CONFLICTS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Articles 31 and 37 of the existing Collective Bargaining Agreement ("CBA")
between the Village and the Palm Beach County Police Benevolent Association("PBA")provide
for reopened negotiations relating to wages; and
WHEREAS, the Village and the PBA have engaged in collective bargaining negotiations and
have agreed upon an amendment to Article 31, as set forth in the Third Addendum to the CBA,
and the Third Addendum has been ratified by the collective bargaining unit; and
WHEREAS, the Village Council determines that the ratification of the Third Addendum to the
CBA is in the best interests of the Village and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. The Village Council hereby ratifies the Third Addendum to the 2010-13
Collective Bargaining Agreement between the Village and the Palm Beach County Police
Benevolent Association, a copy of which is attached hereto and incorporated herein, and
authorizes the Mayor and Village Clerk to execute the Third Addendum on behalf of the Village.
Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to
the extent of such conflict.
Section 4. This Resolution shall take effect retroactive to October 1, 2012.

ADDENDUM
TO 2010-2013 COLLECTIVE BARGAINING AGREEMENT
(WAGE RE-OPENER 2011)
This Addendum to the Collective Bargaining Agreement is entered into between
the VILLAGE OF NORTH PALM BEACH (the "VILLAGE") and PALM BEACH
COUNTY POLICE BENEVOLENT ASSOCIATION, INC. ("PBA") for the purpose of
modifying an existing Collective Bargaining Agreement between the VILLAGE and the
PBA.
WHEREAS, the VILLAGE and PBA are parties to a three year Collective
Bargaining Agreement the term of which ends September 30, 2013; and
WHEREAS, Articles 31 and 37 of the Collective Bargaining Agreement make
provision for reopened negotiations of Article 31, wages, and
WHEREAS, the parties have engaged in reopened collective bargaining for the
third and final year of the Agreement and have reached a tentative agreement as
hereinafter described.
NOW THEREFORE, the Parties agree as follows:
1. The foregoing whereas clauses are true and correct.
2. There are no pending or threatened grievances regarding monetary issues.
3. Paragraph 1 of Article 31, Wages,is amended as follows:
Effective October 1, 2012 and only for fiscal year 2012-13, each
employee, on the employee's anniversary date or date of promotion, may
advance one step in the pay plan, last amended for fiscal year 2010-2011
and attached hereto as Exhibit A, subject to performance as stated in
Section 2. The step plan will not carry over beyond September 30, 2013
unless.provided for in a subsequent Collective Bargaining Agreement or
Addendum.
4. Paragraphs 3 and 4 of Article 31 have occurred and are therefore deleted.
5. All other provisions of Article 31 remain as stated.

Pursuant to Florida Statute 447.309, the VILLAGE's Chief Executive Officer and the
UNION's Bargaining Agent hereby confirm that the foregoing represents the Final
Addendum to the 2010-2013 Collective Bargaining Agreement reached by the Village
and Union negotiators through collective bargaining.
This Addendum shall not be binding it has been ratified by the Village Council and
by the employees who are members of the bargaining unit.
