AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SUBSECTION L (1) OF SECTION 45-36, GENERAL
PROVISIONS, OF ARTICLE III OF APPENDIX C-ZONING, OF THE CODE OF
ORDINANCES OF THE VILLAGE AMENDING THE REQUIRED DISTANCE BETWEEN
GASOLINE, OIL FILLING STATIONS AND SERVICE STATIONS WITHIN THE
VILLAGE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. Subsection L of Section 45-36 General
• Provisions, of Article III of Appendix C-Zoning of the Code of
Ordinances of the Village of North Palm Beach is hereby amended to
read as follows:
"L No gasoline or oil filling stations and no service
station shall be erected within five hundred (500) feet
of any church, hospital, school or other similar
institution where large numbers of pedestrians
congregate, nor within 500 feet of the location in said
Village of another gasoline or oil filling station or
service station.
The method of measurement that shall apply in such cases
shall be by measurement of the airline distance made or
taken from the nearest boundary of the lot or premises
where such proposed station would be located to such
building or structure used as a church, hospital, school
or other similar institution to the boundary of the lot
or premises where the existing station is erected.
Section 2. All Ordinances or parts of Ordinances iii
conflict herewith are hereby repealed.
• Section 3. This Ordinance shall take effect immediately
• upon passage.
