1997-02 Amends TCM PUD to Allow Gas Stations
ORDINANCE NO. 02'97
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2 OF
ORDINANCE NO. 33-95 WHICH CREATED A PLANNED UNIT
DEVELOPMENT UPON LANDS WITHIN THE C-3 REGIONAL BUSINESS
DISTRICT LOCATED AT THE SOUTHWEST CORNER OF NORTHLAKE
BOULEVARD AND U.S.HIGHWAY I (FORMERLY KNOWN AS THE TWIN
CITY MALL) FOR THE PURPOSE OF APPROVING AN ADDITIONAL
LAND USE OF AN AUTOMOBILE SERVICE STATION; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND,
PROVIDING FOR AN EFFECTIVE DATE.
• WHEREAS, Subsection (10) of Section 45-34.1, C-3 Regional
Business District, (as amended) permits the additional land use of
automobile service stations when approved in response to a specific
PUD application; and
WHEREAS, the developer of the said PUD has requested the
additional land use of an automobile service station.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. Section 2 of Ordinance Number 33-95 is hereby
amended to read as follows:
"Section 2. The uses permitted on the subject real
• property shall be those described in Section 45-34.1 of the Code of
Ord.nances of the Village with the acknowledgement that
• supermarkets and convenience stores are recognized as permitted
retail uses and fast food restaurants are not differentiated from
other types of restaurants. An additional permitted use is a
single automobile service station, not involving automobile repairs
or maintenance, inciuding ancillary uses of convenience store and
car wash."
Section 2 If any section, paragraph, sentence, clause,
phrase or word of this Ordinance is for any reason held by a Court
to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 3 All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
• Section This Ordinance shall take effect immediately upon
passage.
