AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE V, "SIGNS AND
OUTDOOR DISPLAYS," OF CHAPTER 6, "BUILDINGS AND BUILDING
REGULATIONS," OF THE VILLAGE CODE OF ORDINANCES BY
AMENDING SECTION 6-115 TO INCREASE THE MAXIMUM HEIGHT OF
FLAG POLES WITHIN SPECIFIED ZONING DISTRICTS AND THE
MAXIMUM SIZE OF FLAGS; PROVIDING FOR NON-CONFORMING
STATUS; PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Village Council determines that the existing regulations governing the height of
flag poles and the size of flags within the Village are unduly restrictive and wishes to amend the
Village Sign Code to increase the maximum height for flag poles within high-density residential
and commercial zoning districts; and
WHEREAS, the Village Council wishes to grant all existing flag poles within the Village non-
conforming status in accordance with Article VII ofAppendix C (Zoning) ofthe Village Code of
Ordinances; and
• WHEREAS, the Village Council determines that the adoption of this Ordinance is in the interests
of the public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are hereby ratified and incorporated herein.
Section 2. The Village Council hereby amends Article V, "Signs and Outdoor Displays," of
Chapter 6, "Buildings and Building Regulations," of the Village Code of Ordinances by
amending Section 6-115 to read as (additional lanpuaee is underlined and deleted language is

Sec. 6-115. Permitted permanent accessory signs.
(F) Flags.
(1) Number. Not more than three (3) flags or insignias of governmental,
religious, charitable, fraternal or other organizations may be permanently
• displayed on any one parcel of land.

• (2) Size. The maximum distance from top to bottom of any flag or flags shall
be try thirty (29 ~ percent of the total height of the flag pole, or in
the absence of a flag pole, tivetrty thirty (~$ ~ percent of the distance
from the top ofthe flag or insignia to the ground. The maximum height of
a flag pole within the R-1 single-family dwelling district and the R-2
multiple-family dwelling district shall be twenty (20) feet. The maximum
height of a flagpole within the R-3 apartment dwelling district and all
non-residential zoning districts shall be thirty-five Ll feet.
Section 3. All flag poles installed prior to the effective date of this Ordinance that do not
comply with the provisions of this Ordinance shall be considered non-conforming structures and
shall be governed by Article VII of Appendix C (Zoning) of the Village Code of Ordinances
irrespective of whether such flag poles exceeded the maximum height when installed.
Section 4. The provisions of this Ordinance shall become and be made a part of the Code of
Ordinances ofthe Village ofNorth Palm Beach.
Section 5. If any section, pazagraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void,
such holding shall not affect the remainder of this Ordinance.
Section 6. All ordinances or parts of ordinances or resolutions or parts of resolutions in
• conflict herewith aze hereby repealed to the extent of such conflict.
Section 7. This Ordinance shall take effect immediately upon adoption.
