ORDINANCE NO. 36-95
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SUBSECTIONS (5) AND (B) OF SECTION 5-84 OF
DIVISION 4, DOCKS AND PIERS, OF ARTICLE III, CONSTRUCTION
REQUIREMENTS, OF CHAPTER 5, BOATS, DOCKS AND WATERWAYS, OF THE CODE
OF ORDINANCES OF THE VILLAGE; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILL,AGS COUNCIL OF NORTH PALM BEACH,
' FLORIDA:
Section 1. Subsection (5) of Section 5-84 of Division 4,
Docks and Piers, of Article IiI, Construction Requirements, of
Chapter 5, Boats, Docks and Waterways, is hereby amended to read as
follows:
"(5) Piers not exceeding six (6) feet in width may extend
waterside a maximum of fifteen (15) feet in lagoons, twenty (20)
feet in the North Palm Beach Waterway and Prosperity Harbor,
twenty-five (25) feet in West Lake and North Lake and not more than
twenty-five percent (250) of the waterway width of the Earman
River; provided however, that, a pier may extend waterside a
maximum of fifty-five (55) feet when connected with a commercial
marina operation in a commercial zoned piece of property so long as
said construction leaves a minimum clear water distance of forty

(40) feet between the pier and any opposite bulkhead or water
structure which may be constructed in accordance with this chapter.
Piers located in the Earman River may be constructed with "L" or
"T" heads provided the maximum allowable length waterside is
reduced by twelve (12) feet. No pier shall be located closer to
the side .property line extended than its extension waterside."
Section 2. Subsection (8) of Section 5-84 of Division 4,
Docks and Piers, of Article III, Construction Requirements, of
Chapter 5, Boats, Docks and Waterways, is hereby amended to read as
' follows:
"8) In the Earman River, dolphin poles, wave breaks,
mooring posts, mooring buoys or floating anchors shall be placed
not more than twenty-five percent (25g) of the waterway width from
the bulkhead or the shore. Wave breaks shall be allowed only at
the entrance to Lake Worth."
Section 3 All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 4 This Ordinance shall take effect immediately
upon passage.

East, Palm Beach County, Florida, being more particularly described as follows:
Begin at the Southeast corner of said Southwest Quarter of Section 17; thence Northerly,
along the North-South quarter section line of said Section 17, a distance of 1517.8 feet, more
or lass to a point on the Easterly prolongation of the North line of Lot 30, according to the Plat
of Kelsey Acres, as recorded In Plat Book 22, Page 16, Public Records of Palm Beach
County, Florida; thence Westerly, along said prolongation and North line a distance of 140
feet to the Northwest comer of Bald Lot 30; thence Southerly, along the West line of said Lot
30 a distance of 190.91 feet to a point on the North line of the Plat of Lake Park Manor, as
recorded In Plat Book 24, Page 91, Public Records of Palm Beach County, Florida; thence
