ORDINANCE NO. 20-95
AN ORDINANCE OF THE VILLAGE COUNCIL OF THS VILLAGE OF NORTH PALM
BEACH, FLORIDA, AMENDING SUBSECTION N OF SECTION 45-36, OF ARTICLE
III, OF APPENDIX C-ZONING RELATING TO LOCATION OF BUSINHSS FOR
RETAIL SALES OF ALCOHOLIC BEVERAGES; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,

FLORIDA:
Section 1. Subsection N of Section 45-36, of Article III
of Appendix C-Zoning of the Code of Ordinances of the Village is
hereby amended to read as follows:
"N. Location of business for retail sales of alcoholic
beverages.
(i) No licensed retail sales of alcoholic beverages
shall be carried on where the proposed place of
business is within one thousand (1,000) feet of
a church, public or private school, hospital,
park or playground, or a place of business of
another licensed retail seller of alcoholic
beverages.
(2) The measurement provided above for one thousand
(1,000) feet shall be made or taken from the
main front entrance or entrances of such church,
public or private school, hospital, park or
playground, or a place of business of another
licensed retail seller of alcoholic beverages,
to the main front entrance of the applicant's
proposed place of business along the route of
ordinary pedestrian traffic.
t (3) The restrictions of section 45-36 N (1) shall
not apply to the sale of beer, ale or wine at
retail, not to be consumed on the premises.
(4) The restrictions of section 45-36 N (1) shall
not apply to any bona fide restaurant as defined
and licensed under Florida Statutes as a
restaurant with full kitchen facilities,
regardless of size or seating capacity,
where alcoholic beverages are served
solely as an accessory use to the restaurant and
only when such restaurant is open for the sale
and service of food; .provided, however, that the
provisions of this subparagraph (4) shall not
permit a license to be issued to a restaurant
that sells alcoholic beverages within One
Thousand (1,000) feet of a church, public or
private school, hospital, public park or public
playground.
(5) Nothing in Section 45-36 N (1) shall prohibit
' the conduct of licensed retail sales of
alcoholic beverages within one thousand (1,000)
feet of the North Palm Beach Country
Club."
Section 2. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 3. This Ordinance shall take effect immediately
upon passage.
