A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, RATIFYING A MEMORANDUM OF
UNDERSTANDING AMENDING ARTICLE 35 OF THE COLLECTIVE
BARGAINING AGREEMENT WITH THE FEDERATION OF PUBLIC
EMPLOYEES RELATING TO WAGES FOR BARGAINING UNIT MEMBERS
AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE
THE MEMORANDUM OF UNDERSTANDING; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Articles 35 and 39 of the existing Collective Bargaining Agreement ( "CBA ") between
the Village and the Federation of Public Employees ( "FPE ") provide for reopened negotiations
relating to wages; and
WHEREAS, the Village and the FPE have engaged in collective bargaining negotiations and have
agreed upon an amendment to Article 35, as set forth in the Memorandum of Understanding
Amending the CBA, and the Memorandum of Understanding has been ratified by the collective
bargaining unit; and
WHEREAS, the Village Council determines that the ratification of the Memorandum of
Understanding Amending the CBA is in the best interests of the Village and its residents.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. The Village Council hereby ratifies the Memorandum of Understanding Amending
2010 -13 Collective Bargaining Agreement between the Village and the Federation of Public
Employees, a copy of which is attached hereto and incorporated herein, and authorizes the Mayor
and Village Clerk to execute the Memorandum of Understanding on behalf of the Village.
Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the
extent of such conflict.
Section 4. This Resolution shall take effect immediately upon adoption.

MEMORANDUM OF UNDERSTANDING
AMENDING 2010 -2013 COLLECTIVE BARGAINING AGREEMENT
(WAGE RE- OPENER 2011)
This Memorandum of Understanding is entered into this q? % day of
2012, by and between the VILLAGE OF NORTH PALM BEACH (the "VI LAGE ")
and FEDERATION OF PUBLIC EMPLOYEES ( "FPE ") for the purpose of modifying an
existing Collective Bargaining Agreement between the VILLAGE and the FPE.
WHEREAS, the VILLAGE and FPE are parties to a Collective Bargaining
Agreement which runs for the term 10 /1 /10 to 9/30/13; and
WHEREAS, Articles 35 and 39 of the Collective Bargaining Agreement make
provision for reopened negotiations of Article 35, Wages, and
WHEREAS, the parties have engaged in Collective Bargaining and have reached
a tentative agreement as hereinafter described.
NOW THEREFORE, the parties agree as follows:
The foregoing whereas clauses are true and correct.
2. Section 1 of Article 35, Wages, is amended as follows:
Year 1 (10 /1 /10- 9/30/11) - 0 -5% increase based on performance
Year 2 (10 /1 /11- 9/30/12) - 0 -5% increase based on performance
Year 3 (10/1/12- 9/30/13) - 0 -5% increase based on performance
In the first pay period in December 2012 each bargaining unit
employee will receive $150.00 additional compensation in
his /her paycheck. This monetary benefit is non - reoccurring.
Section 3 of Article 35 is amended to increase the $900.00 lump
sum payment to $1000.00 and the $1200.00 lump sum payment
to $1300.00, both subject to the performance standards
provided in Section 3.
3. All other provisions of Article 35 remain as stated.
4. Pursuant to Florida Statute 447.309, the VILLAGE's Chief Executive
Officer and the UNION's Bargaining Agent hereby confirm that the
foregoing represents the Memorandum of Understanding amending the
2010 -2013 Collective Bargaining Agreement reached by the Village and
Union negotiators through collective bargaining.
5. This Memorandum of Understanding shall not be binding until it has been
ratified by the Village Council and by the employees who are members of
the bargaining unit.
