1994-23 Amends PUD Harbour Point Marina - 24 Townhomes ORDINANCE No. 23x94 1 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING ORDINANCE N0. 6-94 WHICH CREATF,D A PLANNF,D UNIT DEVELOPMENT KNOWN AS "HARBOUR POINT MARINA" BY APPROVING THE DEVELOPMENT OF TWENTY-FOUR (24) TOWNHOMES ON 3.420 ACRES DESIGNATED AS PARCEL "D" IN ACCORDANCE WITH THAT CERTAIN PLAN CONSISTING OF ONE (1) SHEET PREPARED BY GBSH ARCHITECTS, INC. (UNDATED) ATTACHED AND MADE A PART HEREOF; PROVIDING FOR CONVERSION OF TWENTY-FOUR (24) COMMERCIAL BOAT SLIPS TO PRIVATE SLIPS TO BE OWNED AND MAINTAINED BY THE OWNERS OF PARCEL "D"; PROVIDING FOR SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm II ~~ Beach, Florida, does hereby amend Ordinance No. 6-94 which created a Planned Unit Development known as "Harbour Point Marina" by approving the development of twenty-four (24) townhomes on 3.420 acres designated as Parr.el "D" in accordance with that. certain plan consisting of one (1) sheet prepared by GBSH Architects, Inc. (undated) attached and made a part. hereof. Section 2. The Village Council of the Village of North Palm Beach, Florida, does further amend Ordinance 6-94 to provide for the conversion of twenty-four (24) commercial boat slips to private slips to be owned and maintained by the owners of Parcel "D". Section 3. The following special conditions are to be complied with by the developer: R. A five (5) foot public sidewalk shall be constructed on Monet Road contiguous to Parcel D; and B. There shall. he no leasing of private slips or dockage rights to any person except the owner thereof, and no person shall be permitted to use the slip or dockage rights except the owner of the particular lot, tract or portion of tract abutting the docking tract. No livaboards shall be allowed in any slip or dock tract appurtenant to any residential lot, tract or portion of tract. No business shall be operated from any docking tract appurtenant to a residential lot or tract. The restrictions contained herein shall be set forth in the master declaration of covenants and restrictions and recorded in the Public Records of Palm Beach County, Florida. Section 9. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 5. This Ordinance shall take effect immediately upon passage.
