2007-20 Golf Advisory Board• ORDINANCE 2007-20 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, REPEALING ARTICLE II, "ADVISORY BOARD," OF CHAPTER 9, "COUNTRY CLUB," OF THE VILLAGE CODE OF ORDINANCES AND DISSOLVING THE COUNTRY CLUB ADVISORY BOARD; ENACTING A NEW ARTICLE II OF CHAPTER 9 ENTITLED "GOLF ADVISORY BOARD;" PROVIDING FOR THE CREATION, MEMBERSHIP, TERMS, MEETINGS AND DUTIES OF THE GOLF ADVISORY BOARD; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, during the course of the past two yeazs, the Village Council has transferred administrative and operational oversight for the country club pool and tennis operations to the Village Parks and Recreation Department; and WHEREAS, due to such changes, the Village Council believes it necessary to dissolve the existing Country Club Advisory Board and create a new Golf Advisory Boazd more narrowly focused on golf operations at the Country Club; and WHEREAS, the Village Council has determined that the adoption of this Ordinance is in the best interests of the health, safety and welfare of the Village and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing `whereas" clauses are hereby ratified as true and are incorporated herein. Section 2. The Village Council hereby repeals Article II, "Advisory Board" of Chapter 9, "Country Club," of the Village Code of Ordinances in its entirety. The Country Club Advisory Board is hereby dissolved as ofthe effective date ofthis ordinance. Section 3. The Village council hereby adopts a new Article II, "Golf Advisory Boazd," of Chapter 9, "Country Club," ofthe Village Code of Ordinances to read as follows (new language is underlinedl: ARTICLE II. GOLF ADVISORY BOARD Sec.9-16. Creation. The villaee council hereby creates a Qolf advisory board to serve in an advisory capacity. Unless otherwise provided in this section, the advisory board shall overate in accordance with section 2-1 of the villa eg code. Page 1 of 3 • Sec. 9-17. Composition and terms. ~ Composition. The village council shall appoint five regulaz m_e_mbers and two alternate members to serve on the advisory boazd. The council shall appoint one advisory board member from the village men's golf association and one advisory board member from the village women's golf association. As to the remaining regular members. one shall be non-resident golf member of the country club and one shall be a resident golf member of the country club. bLl Terms. Upon initial appointment of the advisory boazd members, the two association representatives shall serve until April 30. 2009. Thereafter. these members shall serve terms of oneyeaz. Upon initial appointment of the advisory boazd members, the three remaining regular members shall serve until April 30. 2010. Thereafter, these members shall serve terms of two years. f~ Upon initial appointment of the advisory board members, th_e_ two alternate members shall serve until April 30, 2009. Thereafter, • these members shall serve terms of one veaz. Anv appointment to fill any vacancy of a advisory boazd member shall be for the remainder of the unexpired term. j~ O~cers. At the first organizational meeting, the advisory board shall elect a chairoerson vice-chairperson and a secretary from among its members to serve until Mav 2009. Thereafter. officers shall be selected as provided in section 2-1(j) ofthis code. Sec.9-18. Meetings. The advisory boazd shall schedule at least one (1) regular meeting~er month. In addition special meetings may be called by the chairperson or by written notice signed by three (3) regular members byproviding at least fort ei hg t (48) hours' notice. Sec.9-19. Duties. The advisory boazd shall be advisory only and shall have no final authority with respect to the country club golf operations. The duties of the golf advisory boazd shall be established by resolution of the village council. • Section 4. The provisions of this Ordinance shall become and be made a part of the Code of the Village ofNorth Palm Beach, Florida. Page 2 of 3 • Section 5. If any section, pazagraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 6. All ordinances or parts of ordinances and resolutions or parts of resolutions in conflict herewith aze hereby repealed to the extent of such conflict. Section 7.
