AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH,
' FLORIDA, AMENDING CHAPTER 12 OF THE VILLAGE OF NORTH PALM
BEACH CODE, THE FIRE PREVENTION CODE FOR THE VILLAGE, BY
ADOPTING BY REFERENCE THERETO THE STANDARD FIRE PREVENTION
CODE, 1991 EDITION, AND THE LIFE SAFETY CODE, 1988 EDITION,
AS PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION
AND SETTING FORTH AMENDMENTS TO SAID STANDARD FIRE PREVENTION
CODE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA:
Section 1. That Section 12-16 of the Village of North
Palm Beach Code is hereby amended to read as follows:
"Sec. 12-16. ADOPTED BY REFERENCE-------Under the
authority of The Florida Statutes, the Village of North
' Palm Beach hereby adopts by reference thereto the
Standard Fire Prevention Code, 1991 Edition, and the
Life Safety Code, 1988 Edition, as published by the
National Fire Protection Association as the Fire
Prevention Code for the Village. There has been for at
least ten days last past and shall be during the time
that this code is in effect, three copies of each code
and recommended amendments kept available for public
use, inspection and examination."
Section 2. That Section 12-17 of the Village of North
Palm Beach Code is hereby amended to read as follows:
The following amendments and additions are hereby made
to the Fire Prevention Coda adopted by Section 12-16 of
this code:
Add new Section 101.3.5 as follows:
101.3.5 Maintenance. All buildings or structures both
existing and new, and all parts thereof, shall be
maintained in a safe condition. All devices or
safeguards which are required by this Code shall be
maintained in good working order. The owner, or his
' designated agent, shall be responsible for the
maintenance of buildings and structures.

Am~rn'. Section 101.4 to read as follows:
101.4 FIRE DIVISION
There is hereby. established a division of the Public
' Safety Department to be called the Fire Division and the
person in charge shall be known as the Fire Official and
Fire Chief.
Amend Section 103 to read as follows:
103 - PERMITS
A person, firm or corporation shall not maintain, store
or handle materials, or conduct processes which produce
conditions hazardous to life or property, or install
equipment used in connection with such activities
without first obtaining a permit from the Fire Official.
103.1 - PERMIT APPLICATION
103.1.1 When Required. Any owner, authorized agent, or
contractor who desires to maintain, store or handle
materials or to conduct processes as described in this
Code shall first make application to the Fire Official
and obtain the required permit as authorized in Chapter
4.
' 103.1.2 Information Required. Each application for a
permit, with the required fee, shall be filed with the
Fire Official on a form furnished for that purpose, and
shall contain a general description of the operation or
occupancy and its location and any other information as
may be required by the Fire Official. The application
shall be signed by the owner or his authorized agent.
103.1.3 Time Limitations. An application for a permit
for any proposed work shall be deemed to have been
abandoned 6 months after the date of filing for the
application, unless before then a permit has been
issued. One or more extensions of time for periods of
not more than 90 days each may be allowed by the Fire
Official for the application, provided the extension is
requested in writing and justifiable cause is
demonstrated.
103.2 - ISSUING PERMITS
103.2.1 Action On Permits. The Fire Official shall act
upon an application for a permit without unreasonable or
unnecessary delay. If the Fire Official is satisfied
that the use described in an application for a permit
' and.the drawings Filed therewith conform to the
requirements of this Code and other pertinent laws and
ordinances, he shall issue a permit to the applicant.

1G3.2.2 Refusal To issue Permit. If the application
foz ~ permit describes a use which does not conform to
the requirements of this Code or other pertinent laws or
ordinances, the Fire Official shall not issue a permit,
' but shall return the application to the applicant with
his refusal to issue such permit. Such refusal shall,
when requested, be in writing and shall contain the
reason(s) for refusal.
103.3 - CONDITIONS OF THE PERMIT
103.3.1 Permit Intent. A permit issued shall be
construed to be a license to proceed with the work and
shall not be construed as authority to violate, cancel,
alter, or set aside any of the provisions of this Code,
nor shall such issuance of a permit prevent the Fire
Official from thereafter requiring a correction of
errors in plans or in construction, or of violations of
this Code. Every permit issued shall become invalid
unless the use authorized by such permit is commenced
within 6 months after its issuance, or if the use
authorized by such permit is suspended or abandoned for
a period of 6 months after the time the use is
commenced. One or more extensions of time, for periods
not more than 90 days each, may be allowed for the
permit provided the extension is requested in writing
and justifiable cause is demonstrated. Such extensions
shall be in writing by the Fire Official.
' Amend Section,l05.1 to read as follows:
105.1 - APPOINTMENT
There is hereby established a board to be called the
Fire Prevention Board of Adjustments and Appeals. The
said Board shall be appointed by the Village Council.
The Construction Board of Adjustments and Appeals
established by Chapter 6 of the Village Code shall act
as the Fire Prevention Board of Adjustments and Appeals.
Add new Section 501.2.1 to read as follows:
501.2.1 Barbecue Grills and Similar Cooking Utensils
with which open flames may be used to heat or prepare
food or from which open flames may occur during the
cooking process shall not be used on any balconies or
porches of multi-family buildings excepting two (2)
family dwellings. .They shall be used only outside of
and at a minimum of ten (10) feet distance from the
nearest building.

• Azer.d Section 603.18.4 to read as follows:
603.18.4 Automatic fire alarm systems and all alarms
with monitor control valves and flow switches for fire
protection and fire alarm equipment shall be tested at
' least once every three months. A log of the tests shall
be kept by the inspection agency. The log shall be on
the premises and available for examination.
Section 3. This Ordinance shall take effect immediately
upon passage.
