2012-38 Old Port Cove South Marina PUD Amendment RESOLUTION 2012-38 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF • NORTH PALM BEACH, FLORIDA APPROVING A MINOR AMENDMENT TO THE OLD PORT COVE SOUTH MARINA PLANNED UNIT DEVELOPMENT TO PROVIDE FOR THE INSTALLATION OF THREE TEMPORARY TRAILERS DURING CONSTRUCTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, through the enactment of Ordinance No. 2011-20 on November 10, 2011 ("PUD Ordinance"), the Village Council approved the Old Port Cove South Marina Planned Unit Development ("PUD"); and WHEREAS, Section 9 of the PUD Ordinance provides that the Village Council may approve minor modifications to the PUD by resolution without the necessity of review by the Planning Commission, advertisement or public hearing; and WHEREAS, the Property Owners, Old Port Cove Holdings, Inc. and Old Port Cove Equities, Inc., are requesting a modification to the PUD to allow for the installation of three temporary trailers during the construction process; and WHEREAS, the Village Council determines that the request meets the definition of a minor amendment to the PUD and that the adoption of this Resolution is in the best interests of the residents and citizens of the Village of North Palm Beach. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and incorporated herein. Section 2. As authorized by Section 9 of Ordinance No. 2010-22, the Village Council hereby approves a minor modification to the Old Port Cove South Planned Unit Development to allow for the installation of three temporary construction trailers (office trailer, shower trailer and bathroom trailer) during construction activities. The trailers shall be placed to the north and northwest of the Boater's Building as depicted in the permit application submitted to the Village's Community Development Department. The temporary trailers shall be removed by October 31, 2012 or the issuance of Certificates of Occupancy for the Yacht Club Building and Boater's Building, whichever first occurs. Section 3.
