1991-03 Public Sites & Open Spaces' ORDINANCE NO. 3-91
AN ORDINANCE OF THS VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMBNDING SECTION 36-23 ENTITLED "PUBLIC SITES AND OPEN SPACES" OR
ARTICLE III OF APPENDIX B-SUBDIVISION OF THS CODS OF ORDINANCES OF
THB VILLAGE BY ADDING A PARAGRAPH THBRSTO PROVIDING THAT A CASH
CONTRIBUTION IN LIEU OF LAND SHALL BS PLACED IN A SPECIALLY
DESIGNATED FUND WITH EXPENDITURES OF SAID FUNDS TO BE UTILIZED
SOLELY FOR ACQUISITION OF IMPROVED AND UNIMPROVED LAND FOR PARKS
AND RECREATION AND FOR CONSTRUCTION OF CAPITAL FACILITIES ON LANDS
OWNED AND UTILIZED BY THE VILLAGE FOR PARKS AND RECREATION;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THB VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. Section 36-23 entitled "Public sites and open
Spaces" of Article III of Appendix B-Subdivisions of the Code of
Ordinances of the Village is hereby amended by addition of the
following paragraph:
"if the Village Council elects to require a Developer to
pay in cash an amount equal to the fair market value of
the required land, such cash contribution shall be placed
' in a specially designated fund with expenditures of said
funds to be utilized solely for acquisition of improved
and unimproved land for parka and recreation and for
construction of capital facilities on lands owned and
utilized by the Village for parks and recreation."
Section 2. All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
Section 3. This Ordinance shall take effect immediately upon
passage.
