1990-37 Waste Disposal ChargesORDINANCE NO. 37-90 AN ORDINANCE OF THB VILLAGE OF NORTH PALM BEACH, FLORIDA, ESTABLISHING WASTE DISPOSAL CHARGES FOR COMMERCIAL PROPERTY; PROHIBITING PRIVATE REMOVAL OF WASTE WITH EXCEPTIONS; WASTE ' DISPOSAL FEES DUE REGARDLESS OF VACANCY OR NON-USE OF PROPERTY; WASTE DISPOSAL BILLING PROCEDURES; SEVSRABILITY CLAUSE AND EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Chapter 14 of the Village of North Palm Beach Code is hereby amended by adding thereto Section 14-30, which said section shall read as follows: Sec. 14-30 Commercial use property waste disposal fees and collection procedures (1) For purposes of this ordinance commercial use property shall include all property parcels in the Village upon which a building exists with the exception of residential use property, Village owned property and other property used for governmental purposes. ' (2) Monthly disposal fees for garbage and trash collected by the Village Department of Public Services shall be charged as herein provided, except as otherwise stated. 0 to 3 - 30 gallon cans ; 26.00/month 4 to 6 - 30 gallon cans ~ 52.00/month 7 and more - 30 gallon cans ;117.00/month Minimum monthly charge ; 26.00/month (3) Waste disposal fees shall be due and payable to the Village yearly in advance on 1 October of each year regardless of occupancy or use of the property charged. The fees shall be billed to the property owner of record as shown on the Palm Beach County tax rolls. Failure to pay the fees when due may result in the discontinuance of the waste removal service and/or the placing of a lien by the Village Council in the amount of the fees due against the property to which service is available. (4) The collection of garbage and trash by a private person, firm, or corporation hired for such purpose is prohibited except where dumpsters of greater than two (2) cubic yard capacity are used. Section 2. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not effect other provisions or applications of the ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared severable. ~..~. o~.,e..,_....
