1990-35 Docks & PiersORDINANCE N0.35-90 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA AMENDING CHAPTER 5, BOATS, DOCKS AND WATERWAYS; ARTICLE 3, CONSTRUCTION REQUIREMENTS; DIVISION 4, DOCKS AND PIERS, OF THE VILLAGE OF NORTH PALId BEACH CODE, TO MODIFY THE REQUIRED CONFIGURATION OF PIERS AND WAVE BREAKS IN LAKE WORTH AND TO ' CHANGE CERTAIN TECHNICAL AND ENGINEERING CONSTRUCTION AND DESIGN REQUIREMENTS OF MARINE STRUCTURES IN VILLAGE WATERWAYS BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. That Section 5-81 of the Village Code is amended by changing the definition of Private Dock to read as follows: Private Dock shall mean one which shall only be used by the owner and his family and shall be constructed only in R-1 and R-2 zoning districts. A private dock shall not be rented or leased. Section 2. amended to read That Section as follows: 5-83 (b) of the Village Code is (b) Decking shall be placed elevation. The main deck at the minim of a dock or pier feet above mean um sea level. of three and five-tenths (3.5) The steps from th bulkhead cap sha ll not exceed e ground or seven (7) inches for each step. Section 3. as follows That Section 5-83 (e) (i) is amended to read : (1) Piling a. Mittimum bottom penetration is to be six (6) feet. b. Concrete piling is to be minimum eight (8) inch by eight (8) inch or eight (8) inch diameter reinforced with four (4) number 5 rods with number two hoops eight (8) inches on center. c. Wood piling is to be minimum ten (10) inch butt diameter and the treatment shall conform to AWPB MP1, MP2 or MP4. Pile cutoff shall be treated in accordance with AWPA M4. d. All piling are to be set a maximum of ten (10) feet on center for timber deck construction. Section 4. That Section 5-83 (e) (2). is amended to read as follows: (2) Stringers and bracing. Stringers and. bracing, if ' lumber „ shall be a minimum two (2) inch by eight (8) inch. Section 5. That Section 5-83 (e) (3), is amended to read as follows: (3) Decking. Decking, if lumber, shall be a minimum two (z) inch by six (5) inch. dockord _ 1 - rev9.13.90 Section 6. That Section 5-83 (i) (1) is amended to read as follows: (1) Bottom penetration is to be a minimum of six (6) feet. Section 7. That Section 5-85 (5) is amended to read as follows: ' (5) Piers may be constructed with "L" heads or "T" heads of fifty (50) feet. A finger pier shall not exceed twenty two (22) feet in length and shall be a maximum of six (6) feet and a minimum of three (3) feet 1n width. Section 8. That Section 5-85 (11) is amended to read as follows: (11) Free standing wave breaks shall not be permitted. Section 9. This ordinance shall take effect immediately upon passage.
