02-23-2012 VC WS-M MINUTES OF THE WORKSHOP SESSION • VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA FEBRUARY 23, 2012 Present: Darryl C. Aubrey, Sc.D., Mayor David B. Norris, Vice Mayor William L. Manuel, President Pm Tern Robert A. Gebbia, Councilman Edward M. Eissey, Ph.D., Councilman Jimmy Knight, Interim Village Manager Leonard Rubin, Village Attorney Melissa Teal, Village Clerk ROLL CALL Mayor Aubrey called the meeting to order at 9:02 p.m. All members of Council were present. All members of staff were present. CODE ENFORCEMENT—MECHANICAL EQUIPMENT Council considered an amendment to Appendix C, Zoning, of the Code of Ordinances, to add a definition for mechanical equipment and regulate the placement of such equipment in the R-1 and R-2 zoning districts. Mr. Knight reported that there are no regulations specifying the location for mechanical equipment in the R-1 or R-2 zoning districts. Mr. Knight advised that a draft ordinance was presented to the Planning Commission at its February meeting and the Planning Commission's recommendations have been incorporated into the proposed ordinance. Mr. Knight noted the Planning Commission would hold a public hearing and final review of the ordinance at its March meeting, prior to first reading of the ordinance by Council. During discussion, Village Planner Jodi Nentwick reported that presently, mechanical equipment could be located on the side or rear property line. It was suggested that a requirement be added to make mechanical equipment subject to the property setbacks. Mr. Rubin advised specifying a certain distance from the property line or the structure, because some houses are built out to the setback. Council consensus was that mechanical equipment should not be allowed on the property line. Mr. Rubin will add language to the proposed ordinance to address this issue. Council will consider the ordinance on first reading at its March 8, 2012 Regular Session.
