2012-07 Second Addendum to IAFF Collective Bargaining Agreement RESOLUTION 2012-07 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, RATIFYING A SECOND ADDENDUM AMENDING ARTICLE 14 OF THE COLLECTIVE BARGAINING AGREEMENT WITH THE PROFESSIONAL FIREFIGHTERS/PARAMEDICS OF PALM BEACH COUNTY, LOCAL 2928, RELATING TO PAID VACATIONS FOR BARGAINING UNIT MEMBERS AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE THE SECOND ADDENDUM; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Village Audit revealed an inconsistency between the vacation accrual rates being applied to members of the collective bargaining unit pursuant to Village policy and the accrual rates set forth in Article 14 of the existing Collective Bargaining Agreement ("CBA") between the Village and The Professional Firefighters/Paramedics of Palm Beach County, Local 2928 ("IAFF"); and WHEREAS, Village Administration has offered to conform the provisions of Article 14 to the more beneficial accrual calculation provided by Village Policy, and the IAFF wishes to accept this offer through the ratification of a Second Addendum to the CBA; and WHEREAS, the Village Council determines that the ratification of a Second Addendum to the CBA is in the best interests of the Village and its residents. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein. Section 2. The Village Council hereby ratifies the Second Addendum to the 2010-13 Collective Bargaining Agreement between the Village and The Professional Firefighters/Paramedics of Palm Beach County, Local 2928, a copy of which is attached hereto and incorporated herein, and authorizes the Mayor and Village Clerk to execute the Second Addendum on behalf of the Village. Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 4. This Resolution shall take effect immediately upon adoption. C4Ajij-tr MAYOR kt A LST: ��.a y �s / we__ VILLAGE CLERK 44 SECOND ADDENDUM TO 2010-2013 COLLECTIVE BARGAINING AGREEMENT ARTICLE 14-PAID VACATIONS This Second Addendum to the Collective Bargaining Agreement is entered into this 21 day of OQ c.er►,lef, 2011, by and between the VILLAGE OF NORTH PALM BEACH (the "VILLAGE") and THE PROFESSIONAL FIREFIGHTERS/PARAMEDICS OF PALM BEACH COUNTY, LOCAL 2928 (the "IAFF") for the purpose of modifying an existing Collective Bargaining Agreement between the VILLAGE and the IAFF. WHEREAS, the VILLAGE and IAFF are parties to a Collective Bargaining Agreement, ratified by the Village on October 28, 2010 and the employees of the Bargaining Unit on November 9, 2010; and WHEREAS, Article 14, Paid Vacations makes provision for the calculation of Vacation based upon length of service, and WHEREAS, a recent audit of vacation accruals by the Village has revealed an inconsistency between the accrual rates provided in Article 14 and the accrual rate provided under Village policy; the later providing a more generous benefit than the Collective Bargaining Agreement, and WHEREAS, the Village's audit reveals that employees in the Bargaining Unit have accrued under the Village Policy (calculated by month and not year) rather than the less beneficial provision of the Collective Bargaining Agreement, and WHEREAS, the VILLAGE offers to conform the benefit provided under the Collective Bargaining Agreement to the more beneficial accrual provision of the Village Policy and the Union accepts the offer. NOW THEREFORE, the parties agree as follows: 1. The accrual schedule in Section 1 of Article 14, Paid Vacations of the Collective Bargaining Agreement is amended as follows: 40 HOUR EMPLOYEES LENGTH OF SERVICE DAYS OsF VACATION 0-59 months 80 hours 60-119 months 120 hours 120 and over 160 hours Page 1 of 3 I C:\Users\MMayo\Documents\SecondAddendumtoCBA112211v2.doc 24 HOUR EMPLOYEES AND PARAMEDICS LENGTH OF SERVICE DAYS OF VACATION 0-59 months 120 hours 60-119 months 168 hours 120 months and over 240 hours 2. All of the others provisions of Article 14 Paid Vacations not in conflict with the foregoing change remain unchanged. This Addendum shall not be binding until it has been ratified by the Village Council and by the employees who are members of the bargaining unit.
