2012-04 Amending Res. 2011-22 Notice of Election RESOLUTION 2012-04 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DIRECTING THE VILLAGE CLERK TO • PUBLISH NOTICE OF THE GENERAL ELECTION TO BE HELD ON MARCH 13, 2012; NAMING THE TIME AND PLACE WHERE SUCH ELECTION SHALL BE HELD; DECLARING THE OFFICES TO BE FILLED AT SUCH ELECTION; REQUESTING THAT THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS CONDUCT THE ELECTION AND DELEGATING CERTAIN DUTIES TO THE SUPERVISOR; REPEALING RESOLUTION 2011-52; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the Village provides for a General Election to be held on the second Tuesday in March, 2012; and WHEREAS, on December 8, 2011, the Village Council adopted Resolution 2011-52, providing for notice of the General Election and specifying the three offices for which candidates shall be elected;and WHEREAS, subsequent to the adoption of Resolution 2011-52, the Village received the resignation of Village Councilman T.R. Hernacki effective January 3, 2012, thereby creating a vacancy for the Group 2 seat on the Village Council; and WHEREAS, in accordance with Article III, Section 5 of the Village Charter, the Village Council is required to place the Group 2 seat on the next General Election ballot to elect a Councilman to fill the remainder of the unexpired term; and WHEREAS, in light of the foregoing, there are currently four offices to be filled at the General Election to be held in the Village on March 13, 2012. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, as follows: Section 1. That a General Election shall be held, and is hereby declared to be held, in the Village of North Palm Beach, Palm Beach County, Florida, between the hours of 7:00 a.m. and 7:00 p.m. on the 13th day of March, 2012, for the purpose of electing members to the Village Council to fill such offices in Groups 1, 3, and 5 for a period of two years each and to full such office in Group 2 for a period of one year. Section 2. The Village Clerk is hereby ordered and directed to cause a notice of said election to be published in the Palm Beach Post at least fifteen days prior to said election. Said notice shall be substantially in the following form: NOTICE OF GENERAL ELECTION MARCH 13, 2012 TO ALL QUALIFIED ELECTORS RESIDING IN THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA: By order of the Village Council of the Village of North Palm Beach, Florida, notice is hereby given that a General Election will be held in said Village on the 13th day of March, 2012, for the • purpose of electing councilmen for the following offices, to wit: Village Councilman, Group 1 (2-year term) Village Councilman, Group 2 (1-year term) Village Councilman, Group 3 (2-year term) Village Councilman, Group 5 (2-year term) Page 1 of 2 Said election will be held in the Village of North Palm Beach, and the polling places are designated as North Palm Beach Community Center, Precincts 1145, 1146, 1147, 1155, 1158, and 1166; North Palm Beach Country Club, Precincts 1148, 1150, 1151; Old Port Cove Recreation Room between the North and South Quay Buildings, Precinct 1152; Faith Lutheran Church, Precinct 1154; • and Village Hall Council Chambers, Precincts 1168 and 1186. The polls will be open in the voting places from 7:00 a.m. until 7:00 p.m. Notwithstanding the foregoing, should the polling locations change subsequent to the adoption of this Resolution, the Village Clerk is hereby authorized and directed to advertise the correct locations in the notice without the necessity of amending this Resolution. Section 3. The offices for which said candidates shall be elected at the General Election are: Village Councilman, Group 1 (2-year term) Village Councilman, Group 2 (1-year term) Village Councilman, Group 3 (2-year term) Village Councilman,Group 5 (2-year term) Section 4. The Village Clerk and election officials are hereby directed to arrange for the use of voting machines at said General Election, and the form of the ballot shall be such as is consistent with the use of voting machines. The Village Clerk shall coordinate and arrange for ballots, including absentee ballots, with the Supervisor of Elections. Section 5. The Village Council hereby requests that the Palm Beach County Supervisor of Elections conduct the Village's General Election, including runoffs as necessary. The Supervisor of Elections shall conduct a Logic and Accuracy test for the tabulation of all ballots, including absentee ballots, and the Village Clerk (or designee) shall be present during such testing. The Village Council hereby authorizes the Supervisor of Elections to tabulate and canvass all ballots cast during the General Election, including runoffs. The Village Council authorizes the Supervisor of Elections (or designee) to serve as a member of the municipal canvassing board, along with the Village Clerk(or Deputy Village Clerk) and Village Attorney. Section 6. The Village Council hereby repeals Resolution 2011-52 in its entirety. Section 7. This Resolution shall take effect immediately upon adoption.
