Ordinance 1987-003 Adopts Fire Prevention Code 1985 EditionORDINANCE N0. 3-87 AN ORDINANCE OF THE VILLAGE OF NORTH 1 PALM BEACH, FLORIDA, AMENDING CHAPTER 12 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE FIRE PREVENTION CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD FIRE PREVENTION CODE, 1985 EDITION, AND SETTING FORTH AMENDMENTS TO SAID STANDARD FIRE PREVENTION CODE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF 1JORTH PALM BEACH, FLORIDA: Settlan 1. That Section 12-I6 of the Village of North Palm Beach Code is hereby amended to read as follows: "SEL /7-~~- A!?DPIEQ BY RFFFRFNrF------- Under the authority of The Florida Statutes, the Village of North Palm Beach hereby adopts by reference thereto the Standard Fire Prevention Code, 1985 Edition, as the Fire Prevention Code for the Village. There has been for at least ten days Last past and shall be during the time that this code is in effect, three copies of such code and recommended amendments kept available far public use, inspection and examination." SerFinn 2. That Section 12-17 of the Village of North Palm Beach Cade is hereby amended to read as faliows: The following amendments and additions are hereby made to the Fire Prevention Cade adopted by Section 12-16 of this code: CI) Add new Section 101.3.4 as follows: 1 101.3.4 Maintenance. All buildings or structures both existing and new, and all parts theregf, shall be maintained in a safe condition. Atl devices or safeguards which are required by this Cade shall be maintained In good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings and structures. C2) Amend Section 101.4 to read as follows: 101.4 FIRE DIVISION There is hereby established a department -1- to be called the Fire Division and the person In charge shall be Known as the Fire Official and Fire Chief. 1 1 C3) Amend Section 102.1 to read as failows~ 102.1 - RIOHT OF EMRY 102.1.1 Whenever necessary to make an inspection to enforce any of the provisions of this Code, or whenever the Fire Official has reasonable cause to believe that there exists in any building or upon any premises any condition or code violation which makes such building or premises unsafe, dangerous or hazardous, the Fire Official ma>• enter such building or premises at all reasonable times to inspect the same or to perform an>• duty imposed upon the Fire Official by this Code, provided that if such building or premises is occupied, he shall first present proper credentials and request entry. If such building or premises is unoccupied, he shall first maKe reasonable effort to locate the owner or other persons having charge or control of the building or premises and request entry. I4 such entry is refused, the Fire Official shall have recourse to every remedy provided by law to secure entry. 102.1.2 When the Fire Official shall have first obtained a proper inspection warrant or other remedy provided by law to secure entry, no owner or occupant or any other persons having charge, care or control of any building or premises shall fail or neglect, after proper request is made as herein provided, to promptly permit entry therein by the Fire Official for the purpose of inspection and examination pursuant to this Code. (4> Amend Section 103 to read as follows 103 - PERMITS 1 A person, firm or corporation shall not maintain, store ar handle materials, or conduct processes which produce conditions hazardous to life or property, or install equipment used in connection with such activities without first obtaining a permit from the Fire Official. 103.1 - PERMIT APPLICATION 103.1.1 When Required. Any owner, authorized agent, or contractor who desires to maintain, store or handle a.terials or to conduct processes as ascribed fn this Code shall first make ~plication to the Fire Official and -2- obtain the required permit as authorized in Ghapter 4. J n .___J ._ J 103.1.2 Information Required. Each application for a permit, with the required fee, shall be filed with the Fire Official on a form furnished for that purpose, and shall contain a general description of the operation or occupancy and its location and any other information as may be required by the Fire Official. The application shall be signed by the owner or his authorized agent. 103.1.3 Time Limitations. An application for a permit for any proposed work shall be deemed to have been abandoned 6 months after the date of filing for the application, unless before then a permit has been issued. One ar more extensions of time for periods of not more than 90 days each may be allowed by the Fire Official for the application, provided the extension is requested in writing and Justifiable cause is demonstrated. 103.2 - ISSUING PERMITS 103.2.1 Acton On Permits. The Fire Official shall act upon an application for a permit without unreasonable or unnecessary delay. If the Fire Official is satisfied that the use described in an application far a permit and the drawings filed therewith conform to the requirements of this Code and other pertinent laws and ordinances, he shall issue a permit to the applicant. 103.2.2 Refusal To Issue Permit. If the application for a permit describes a use which does not conform to the requirements of this Code or other pertinent laws or ordinances, the Fire Official shall not issue a permit, but shall return the application to the applicant with his refusal to issue such permit. Such refusal shall, when requested, be in writing and shall contain the reason(s) for refusal. 103.3 - CONDITIONS OF THE PERMIT 103.3.1 Permit Intent. A permit issued shall be construed to be a license to proceed with the worK and shall not be construed a5 authority to violate, cancel, alter, or set aside any of the provisions of this Code, nor shall such issuance of a permit prevent the Fire Official from thereafter requiring a correction of errors in plans or in construction, or of violations of this Code. Every permit Issued shall become invalid unless the use authorized by such permit is commenced within 6 months after -3- 1 its issuance, or if the use authorized by such permit is suspended or abandoned for a period of 6 months after the time the use is commenced. One or more extensions of time, for periods not more than 90 days each, may be allowed for the permit provided the extension is requested in writing and justifiable cause is demonstrated. Such extensions shall be in writing by the Fire Official. C5) Amend Section 105.1 to read as (allows: 105.1 -APPOINTMENT There is hereby established a board to be called the Fire Prevention Board of Adjustments and Appeals. The Bald Board shall be appointed by the Village Council. The Contractors Board established by Ghapter 6 of the Village Code shall act as the Fire Prevention Board of Adjustments and Appeals. C6) Add new Section 501.2.1 to read as follows: 501.2.1 Barbeque Grills and Similar Cooking Utensils with which open flames may be used to heat or prepare food or from which open flames may occur during the cooKing process shall not be used on any balconies or porches of multi-family buildings excepting two C2) family dwellings. They shall be used only outside of and at a minimum of ten C10) feet distance from the nearest building. (7) Amend Section 603.18.4 to read as follows: 603.18.4 Automatic fire alarm systems and all alarms with monitor control valves and flow switches for fire protection and fire alarm equipment shall be tested at least once every three months. A log of the tests shall be kept by the inspection agency. The log shall be on the premises and available for examination. CS> Add new Section 603.iS.7 to read as follows: 603.16.7 The smoke removal and control systems in buildings with an atrium shall be tested by an approved inspection agency or by the owner or his representative when so approved. Such inspections shall be made every six months and a log of the tests shall be kept by the inspection agency.
