08-25-1992 VC SP WS-MMINUTES OF SPECIAL WORKSHOP OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD TUESDAY, AUGUST 25, 1992 Present: Judy M. Pierman, Mayor V . A . Marks , M . D . , President Pro Tem Tom Valente, Councilman Dennis W. Kelly, Village Manager Absent: ROLL CALL Thomas F. Kelsey, Vice Mayor Gail Vastola, Councilman Mayor Pierman called the meeting to order at 7:03 p.m. All members of Council were present except Vice Mayor Kelsey and Councilman Vastola. Staff present was Dennis Kelly, Village Manager. A comparative analysis was made between the Country Club Administrative Board draft contracts and the current contracts. ,~ The consensus of Council determined that the Professionals' should remain independent contractors, and pay increases should not exceed those given to other Village employees. Discussion was held concerning the Village employees who sell merchandise in the various Pro Shops. The Village Manager was directed to check into the legality of this practice. Stronger language should be included in the contracts establishing responsibility of the Professionals to be consultants to the Village regarding maintenance of their respective facilities, and shall bear responsibility in ensuring that proper repairs are made and facilities properly maintained. Discussion took place concerning the Country Club Administrative Board's recommendation concerning an 800/20% split of net profits from Golf instruction and Pool instruction. This recommendation was not accepted, due to its impracticality. The Village Manager was directed to obtain clarification from the Village Attorney regarding Section 2.B. (Swim Instruction) of the current contract with Pool Manager Dick Cavanah, and clearer definition of the term "non-instructional". .r The Village Manager requested that Mr. Baldwin review Section 2.B. and 2.C. of the Pool Manager's contract, as it relates to the setting of fees by Cavanah and the Administrative Board outside the budgetary process. Additionally, Mr. Kelly will ask for legal interpretation of "aquatic" events as opposed to "special" events Minutes of Special Workshop Held Tuesday, August 25, 1992 in Section 2.C. The language of Special/Social Events also needs clarification. Brief discussion was held concerning establishment of a fee for all non-members who use Club facilities, with the proceeds going to the Village. The Village Manager was directed to investigate current policies concerning this. Section 3 B. and 3 C. of the contracts are to be reviewed by the Village Attorney to determine if procedures for collecting the Village's revenues are adequate. The Village Manager suggested that, in lieu of an 800/20$ split in net profits, the monthly lease amount could be increased to $300 or $350, as a means of gaining revenue; or a cost based on square foot usage of indoor facilities would be an alternative in arriving at a monthly lease amount. The Council agreed that the lease amount for each Professional ,,,~ should be $300.00 per month, but would like the square footage figures as a comparison. Mr. Kelly stated that the term "facility" as stated in both the proposed and current contracts is very broad, and may need specific definition. Mayor Pierman requested that the Village Attorney define this. It was agreed that the duration of the contracts shall continue to be one year. The contracts will be reviewed and clarified by the Village Attorney and brought back before the Council.
