Ordinance 1986-019 Adopts National Electrical Code 1984 Edition~,- r ORDINANCE N0. 19-86 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 11 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE ELECTRICAL CODE FOR TfIE VILLAGE, BY ADOPTING BY REFERENCE TFIERETO TFIE NATIONAL ELECTRIC CODE, 1984 EDITION, AND SETTING FORTH AMENDMENTS TO SAID NATIONAL ELECTRIC CODE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 11-11 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 11-11. ADOPTED BY REFERENCE---Under the authority of Section 553.73, Florida Statutes, the Village of North Palm Beach hereby adopts by reference thereto the National Electric Code, 1984 Edition, and the recanmended amendments of the Building Code Advisory board of Palm Beach County, as the electrical code for the Village. There has been for at least ten days last past and shall be during the time that this code is in effect, three copies of such code and recommended amendments kept available for public use, inspection and examination." Section 2. Section 11-12 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 11-12. AMENDMENTS CORRECTIONS AND ADDITIONS---The fo1-T~owing aT mend-meets, corrections an a bons to the recommended amendments of the Building Code Advisory Board of Palm Beach County are hereby made and adopted, said amendments, corrections and additions being set fprth herein with reference to and prefaced by the section number and title of said amendments, as follows: 80-6 c)(3) - SCHEDULE OF PERMIT FEES. R a.,~r1uSt ~9f?, S ' .c ARTICLE 80 - NATIONAL ELI~;CTRIC CUUE 1984 Edition is created to read ARTICLE 80 - ADMINISTRATION Section 90-1 Title and Scope ARTICLE 80 - ADMINISTRATION 80-1 Title and Scope (a) Title. 7'he provisions embraced within the following chapters and sections shall. constitute and he known and cited as "Electrical Code." (b) Code Remedial. Tlris code is hereby declared to be remedial and shall be construed to secure the beneficial. interest and purpose thereof, which are health, sanitation, general .public safety and welfare; by regulating installation and maintenance of all electrical equipment. (c) Scope. The provisions of this code shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and/or appurtenances, thereto. By nothing contained in this section or elsewhere in this code is it to be construed that a permit shall be required under this code for any work involved in the erection, installation, repairinq, remodeling and maintenance of elevators, dumbwaiters and moving stairways. Such exception shall not, however, extend to work on conductors and eyuipment and motors for supplying power to the control panels of each elevator, dumbwaiter elevators or moving stairway. (d) Maintenance. All electrical systems, both existing and new, and all parts thereof, shall be maintained in a safe condition. All devices or safeguards which are required by this code shall be maintained in good working order. The maintenance of electri- cal systems shall be the responsibility of the owner or t}reir designated agent. _ (e) Service Egui~ment_ It shall be unlawful for any person to disconnect, alter or tamper with any service eyuipment; such as service drop, conductors, meters or protective devices owned by a municipal, county or state agency; a company or corporation holdfng a franchise for electrical current for 1 :._ /- , BO-1 light, heat and power in the county, except duly authorized agents, licensees or employees of such company or corporation. (f) Definitions. INDUSTRIAL PLANT ELECTRICAL MAINTENANCE SUPERVISOR. A person regularly employed in an industrial plant to perform electrical work solely on behalf of their employer and only upon the premises of their employer's industrial plant, qualified by training and technical knowledge to plan, lay-out and super- vise electrical work permitted to be done under annual industrial permits. Must be certified as a Master Electrician or an Electrical Contractor. INDUSTRIAL PLANT MAINTENANCE ELECTRICIAN. A person regularly employed in an industrial plant to perform electrical work solely on behalf of their employer and upon the premises of their employer's industrial plant and under the supervision of an industrial plant electrical maintenance supervisor. Must be a journeyman electrician. ELECTRICIAN. Is a person who is engaged in the electrical trade or business and who is qualified under the terms and provisions of this code. ELECTRICIAN APPRENTICE. Is a person who is engaged in learning the electrical trade by working with and under the supervision of a journeyman electrician who holds a valid certificate of compentency and who shall be held responsible for the work of such an apprentice. JOURNEYMAN ELECTRICIAN. Is a person qualified by experience and/or education to perform work in the electrical trade. Must be certified by the Palm Beach County Construction Industry Licensing Board. MAINTENANCE: ELECTRICIAN. A person who possesses the qualifications prescribed in this Section for a "journeyman electrician", but who must be regularly employed to maintain and make minor repairs to the electrical wiring, apparatus and equipment which is installed, contained, and used upon premises or in the buildings owned, occupied, or controlled by the person by whom the maintenance electrician is` employed. MASTER ELECTRICIAN. A person who possesses the necessary qualifications, training and technical knowledge to plan, lay-out and supervise the in- stallation of electrical wiring,, apparatus or equip- ment for light., heat or power as covered by the terms and provisions of this Article. 2 ~. ~ 80-2 Organization 8(1-2, 80-3 (a) Electrical Inspection Division. There is hereby established a division to be called the Electrical Inspection Division, with the Building Department which shall be in charge of the Official so legally designed by the local governing body. (b) Inspectors. The Building Official, with the approval of the Chief Appointing Authority, may appoint suctr number of officers, inspectors, assis- tants and other employees as shall be authorized from time to time. No person shall be appointed as inspector of electrical systems who has not had at least five (5) years experience as an electrical inspector, master electrician, journeyman, electri- cian, engineer, or as a superintendent or foreman in charge of electrical constructions. The inspector appointed shall. be certified within twelve (12) months of appointment by the Building Officials Association of Florida. (c) )testrictiona on Employees. An officer or employee connected with the department, except one whose only connection is as a member of. the board established by this code shall not be financially interested in the furnishing of labor, material or appliances f:or the construction, alteration, or maintenance o[ electrical installations or in tire making of plans or of specifications therefore; unless they are the owner of suctr building. Such officer or employee . shall not engage in any work which is inconsistent with their duties or with the interest of the department. (d) Board of Adiustment and Appeals. The Board of Adjustment and Appeals, as established by Section 111, of tyre Standard Building Code, shall hear all appeals concerning the interpretation and enforce- ment of this code. 80-3 Powers and Duties of the Electrical Inspector (a) Right of Entry The Building Official shall enforce the provisions of this code and may enter any build- ing, structure or {remises to perform any duty imposed by this code. (b) Stop Work Orders. Upon notice from the Building, Official that work on any electrical installation that is being done contrary to the provisions oC this code or in a dangerous or unsafe manner, such work shall be immediately stopped. Such notice shall be in writing, stating the reason therefore, and shall. be given to the owner of such property or ., 80-3 to their agent, or the person doing the work, and shall state the conditions under which the work may be resumed. Where any emergency exists, oral notice given by the Building Official shall be sufficient followed by notice in writing within forty-eight (48) hours. (c) Revocation of Permits. The Building Official may revoke a permit or approval issued under the provi- sions of this act in case there has been any false statement or misrepresentations as to the material fact in the application or plans on which the permit or approval was based. In all cases permit fees shall not be refunded. (d) Unsafe Installations. All electrical installations regardless of type, which constitute an undue hazard to human life, health or welfare are hereby declared illegal and shall be abated by repair and rehabili- tation or by demolition in accordance with the procedure as outlined in Section 103.4, "Unsafe Buildings", of the Standard Building Code. (e) Reguirements Not Covered by Code. Any requirement necessary for the safety, strength or stability of an existing or proposed electrical installation, or for the safety of the occupants of a building or structure, not specifically covered by this code, shall be determined by the Electrical Inspector, subject to the approval of the Building Official. (f) Alternate Materials and Alternate Methods of lnstallations. Alternate materials and alternate methods of installations shall be approved in ac- cordance with this Section by the Building Official. See Section 103.6, of the Standard Building Code for product control requirements. (y) F.xisting Premises. In existing buildings or premises in which electrical installations are to he altered, repaired or renovated, the Building Offi- cial has discreCionary power to permit deviation from the provisions of this Code, provided that such a proposal to deviate is first submitted for proper determination in order that health and safety re- quirements, as they pertain to electrical installa- tions, shall be observed. (h) Evidence of Compliance. The Buildinq Official shall require sufficient evidence to enable a judgement as to whether proposed alternate meets the requirements of this code for safety and health. (i) Tests. When there is sufficient evidence to sub- stantiate claims for alternates, the Building Offi- 4 ,t 80-3, 80-4 cial may require tests of compliance as proof to be made by an approved agency at the expense of the applicant. Tests shall be made in accordance with generally recognized standards; however, in the absence of such standards, the Building Official shall specify the test procedure. Tests may be required to be repeated, if at any time there is reason to believe that an alternate no longer conforms to the requirements on which its approval was based. (j) Liability. Any officer or employee, or member of any board, charged with the enforcement of this code, acting for the governing body in discharge of their duties, shall not thereby render themselves liable personally and they are hereby relieved from all~•personal liability for any damage that may occur to persons or property as a result of any act required or permitted in the discharge of their duties. Any suite brought against any officer or employee because of such act performed by them in the enforcement of any provision of this code, shall be defended by the agency until the final termina- tion of the proceedings. Any suit brouyht against any former employee of any agency Inr actions, said employee may gave taken in the discharge of their duties while employed by said agency, will he de- fended by the agency. 80-4 Application for Permit (a) When Required. Upon written request to the Building Official, any industrial plant shall be issued an annual permit for electrical work, but only to the extent of permitting reasonable alterations, additions or extensions to existing installations of wiring apparatus or equipment installed, con- tained, or used upon premises or in buildings owned or occupied by the person to whom such an annual industrial permit is issued. Such altera- tions, additions or extensions must be of. a minor character and shall. be confined to any existing branch circuits and fixtures, apparatus or equip- ment connected thereto, but shall not include the installation or replacement of service con- 5 J t 80-4 ductors, service equipment or subfeed circuits up to the final center of distribution. No altera- tions, additions or extensions shall be made which would place an overload upon the service conductors, subfeed or branchfeed service con- ductors, or overload the protective devices through which electrical eneryy is applied. 2. The payment of an annual fee of one hundred dol- lars ($100.00) for each calendar year, and permit fees computed monthly according to the fee sche- dule in Section 80-7. 3. 7`he regular employment of one or more full time electricians, competent iu the safe installation, extension, maintenance and repair of industrial electrical systems and equipment, as required by 'Section 80-1. 4. The right of the Building Official to check the premises of the permit holder at a reasonable time, unless prohibited by government reyulation. 5. 7'tre performance of all work shall comply with the applicable provisions of this code. (c) Form. Each application for a permit with the required fee shall be filed with the Building Official on a form furnished for that purpose, and strall contain a general description of the proposed work and its location. The application shall be signed by the owner or their authorized agent. (d) Drawings gird Specifications. Two (2) sets of plans and specifications, with a complete description of all proposed electrical work, shall be submitted to the Buildiny Official at the same time application is made for a building permit, if any. The plans must he legibly drawn or printed to a definite scale, one (].) floor plan being sufficient if it can be made to show all. the proposed electrical work; otherwise, two (2) or more plans shall be submitted. The plans shall denote calculations for total connected load, the total floor area, the square feet of the Buildiny under consideration, the point to which the service connection is to be made, the size of service and t)re subfeed wires, the location of service switches and center of distribution and the arrangement of circuits showing the number of outlets connected thereto. The plan8, it found in order, must be stamped, reviewed for code compliance by the Building Official or a duly authorized assistant, prior to the electrical permit being obtained, and before any electrical work can be commenced. 6 ,F 80-4, 80-5 (d) Copies of all blueprints and drawings of this nature cont. must be filed in the Building Department for safe-keeping and future reference, if required. The installation of wiring, apparatus or equipment for light, heat or power within or attached to any building or premises, whether for private or public use, must be accomplished strictly in accordance with the plans and specifications submitted. Any changes or omissions in t)re wiring system shown on the plans must first be reviewed for code compliance by the Building Official and such review noted in writing. All drawings and specifications and accompanying data shall bear the name, signature and addYOSS of the designer. (e) Examination of Drawin s. The Building Official shall exam ne or cause to he examined each application for a permit and the drawings and specifications which may be filed therewith, and shall ascertain by such examination whether the in- stallation indicated and described is in accordance with the requirements of this code and all other pertinent laws or ordinances. 80-5 Permits (a) Action on Application. 1. If the Building Official is satisfied that the work described in an application for permit and the drawings and specifications which may be filed therewith conform to the requirements of this code and other pertinent laws and ordinances, a permit shall be issued to the applicant. 7 , fi0-5 2. if Chc application for permit and the drawings and specifications which may be filed therewith describe work which doers not conform to the re- quirements of this code or other pertinent laws or ordinances, the Building Official shall not issue a permit but shall return the drawings to the applicant with the refusal to issue such a permit. Such refusal, shall when requested, be by letter and shall contain the reasons therefore. (b) Conditions of the Permit. Ttre Building Official shall act upon an application for a permit with plans as filed, or as amended, without unreasonable or unnecessary delay. A permit issued shall be construed to be a license to proceed with the work and shall not be construed ae authority to violate, cancel, alter or set aside any of the provisions oC this code, nor shall such issuance of a permit prevent the Building Official from thereafter requiring a correction of errors in plans or in construction or of violations of this code. Permits may be issued subject to either of the fol- lowing conditions: 1. Every permit issued shall become null and void unless the work authorized by such permit is commenced within six (6) months after its is- suance, or if work authorized by such permit is suspended or abandoned for a period of six (6) months after the time the work is commenced; provided that. for cause, one or more extensions of time for )>eriods noL exceeding ninety (90) days each may be allowed and each such extension s)rall be in writing by the Building Official. 2. Prior to issuing the permit, the Building Offi- cial and the applicant may establish a maximum time schedule for completion of logical phases of. construction under the permit. Such schedule shall take into eftect )tistorical data of the governmental agency, for construction of similar structures within the limits of the agency. Failure of permit holder to pursue construction under the permit in accordance with the maximum time schedule shall be prima facie evidence that ttre building project has not been commenced, or has been suspended or abandoned. Such prima facie evidence shall be in addition to any other evidence that construction under the permit has not been commenced or has been suspended or abandoned under the permit. 8 . -~ 80-5,80-6 Should the permit for any reason become null and void prior to the work being commenced, it may be subsequently commenced or recommenced and a new permit shall be obtained. A null and void permit may be renewed for a prorated amount of the original fee, provided the proposed work con- forms with all requirements, ordinances, rules and regulations effective at the time of such renewal. In every case, a courtesy notice shall be mailed by the Building Official to the permit holder advising that said permit is null and void. 3. A journeyman or master electrician shall actively supervise on the site electrical work. 60-6 (c) qualifications of Applicant. Application for permits will be accepted only from contractors currently licensed in their respective field and for whom no revocation or suspension of license is existing except that a sole owner may make application for permit. and perform the work in connection with t)re construction, maintenance, alterations, or repair of a single family residence or two (2) family residence for their own use and occupancy and not intended for sale. Such licensed contractor or sole owner shall be held responsible to the Building Official for the proper supervision and conduct for all work covered thereof. Fees (a) General.. A permit shall not be valid until the fees prescribed in this section have been paid, nor shall an amendment to a permit be approved until the addi- tional fees, if any, shall have been paid. (b> Failure to Obtain a Permit. if any person commences any work on an installation before obtaining the necessary permit from the Building Official, the permit fee shall be doubled. (c) Schedule of Permit Fees. 1. Gf:NI?)(AI.: No permit shall be issued until the fee prescribed under this section shall have been' paid. Nor shall an artiendment to a permit be ap- proved until the additional fee, if any, due to the additional work, shall have been paid. No refund of permit fees will be allowed after thirty (30) days from date of issue of permit. 9 ~,~ 80-6, 80•-7 2. R1?COKUS: The building Official shall keep a permanent and accurate account oP all permit Cees and other monies collected, the names of all persons upon whose account the same was paid and the date and amount thereof. 3. SCHF.UULF. OF PERMIT FEES: On all electrical work requiring a permit as set forth in 80.5, fees shall be paid as required at the time of tiling application in accordance with the fee schedule, established by authority Craving jurisdiction. A REINSPF.CTION FEE of $10.00 may bo charged for each reinspection made due to the rejection of work, or due to the fact that work was not ready at the time specified in the request for inspection, or failure to call for inspection. Payment o[ such fee must be made prior to the reinspection. Plan Filing Fee. Thirty percent (306) of esti- mated permit fee upon filing. T)educt amount from actual fee if permit is obtained within four (4) months from approval date: if not, permit fee is kept. Mayor Working Drawing Review Fee. One hundred dollars ($100.00) deducted from permit fee if permit is obtained within eight (B) months from submission date. Major l~'ee Changes After Flans are Approved and Permit ISSUed. 4'wo hundred and fifty dollars ( 250.00) fee, but in no case more than ttre original permit fee. Major Plan Rechecking lee. Second (2nd) and additional check lists ten percent (106) of permit Eee for checking service each time rechecked. 80-7 Inspections (a) General 1. Before issuing a permit, the Building Official or authorized agent may examine or cause to be exa- mined, any building or site at or in which the work is to be done. All electrical work shall be inspected from time to time during and upon completion of the work for which a permit is issued. A record shall be made of every such examination and inspection, and of all violations of code. 10 ~' 80-7, 60-8 2. The electrical inspector or authorized agent, upon proper notification from the permit holder, shall make the following inspection of electrical work, together with such other inspections as may be necessary, and shall review for code compli- ance that portion of the electrical work of the stages listed below, or shall notify the permit holder, or agent, wherein the same fails to comply with the requirements of the code. a. FIRST INSPECTION. After all the wiring has been run and the panel has been installed and made up, or wire and circuits properly tagged --- with the number of outlets, before it has been covered, other than to provide required mechanical protection, the inspector shall examine same. He shall. make such observations and measure- ments, together with testa, as may be required Lo determine whether the work complies witty the code. Where wiring or circuits have been tagged, in lieu of panel make-up, the tags shall remain until the panel has been finally made up and inspected and approved by the inspector. Inspector may waive the test re- quirements, provided the electrical contrac- tor shows proof to the inspector that installation will comply with code. 3. The Building Official shall make, or cause to be made a final inspection of all electrical work in buildings upon completion thereof, prior to the issuance of the Certificate of Occupancy. 4. No owner or agent shall allow any new building to be occupied by any person until after the elec- trical work in said building shall have been ap- proved by the Building Official. No equipment regulated by this Code shall be connected to the power supply and placed in normal operation until it complies with all applicable requirements of this code and a final inspection approval has been issued. The servicing utility company shall not connect the power supply until notified by the Building Official. 80-8 Violations and Penalties Any person, firm or corporation who shall violate a provision of this code, or fail to comply therewith, 11 ,s , 80-9 80-8, 80-9, 210-1, 210-5, 210-50 or with any of the requirements thereof, shall be guilty of misdemeanor. Fach such person shall be deemed guilty of a separate offence for each and every day or portion thereof during which any violation of any of the provisions of this code is committed or continued, and upon conviction of any such violation, such person shall be punished by a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00), or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Validity If any section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this code. ARTICLE 210 - BItANCII CIRCUITS 210-1 210-5 Scope The provisions of this Article apply to branch circuits supplying lighting or appliance loads or combinations of both. Where motors or motor-opera- ted appliances are connected to any branch circuit that also supplies lighting or other appliance loads, the provisions of both this Article and Article 430 shall apply. Article 430 applies where a branch circuit supplies motor loads only. Branct~ circuits shall be plainly marked at the overcurrent protective device so they can be quickly and positively identified. Color Code for Branch Circuits (c) Ungrounded Conductors Color Code. Ungrounded conductors operating at voltages not exceeding 150 volts at ground, shall be identified by an outer covering or marking at termination or splice of black, red or blue. Ungrounded conductors operating at voltages exceed- ing 150 volts to ground shall be identified by an outer covering or marking at termination or splice of brown, purple or yellow. C. All receptacles shall be in- stalled at accessible locations and this accessibi- lity shall be maintained regardless of wall tixtures or other modifications. (e) All air conditioning and heating components installed on a roof or in an attic shall have an accessible disconnect switch and a 120 volt A/C grounding type convenience outlet convenient to the general equipment area. 210-52 Dwelling Unit Receptacle Outlets (g) in each brahch circuit panel board of any one and two family dwelling units, there shall be a minimum of two (2) extra spaces for fuse holders or breakers for future use. An empty raceway terminating in an accessible attic or an empty raceway terminating in an accessible place either under the floor or to tt~e exterior of the building above finish grade shall be installed. 210-70 Lighting Outlets Required (c) In an attic, a light controlled by a switch located at the required passageway opening shall be provided. ARTICLE 215 - FEEDERS 215-4 Feeders With Common Neutral (b) All feeder conductors to panels shall be installed in an approved raceway. ARTICLE 220 - BRANCFI-CIRCUI'T' AND FEEDER CALCULATIONS 220-2 Computation of Branch Circuits (b) Lighting Load for Listed Occupancies and Computa- tion of Branch Circuits. In residences a 15A circu t may have eLght (8) general lighting outlets and a 20A circuit may have ten (10) general lighting outlets. , 220-3 Branch Circuits Required (b) Small Appliance Branch Circuits - Dwelling Unit 1. A small appliance circuit shall not feed more than four (4) receptacles. 13 rr 230-43, 230-70, 300-4, 310-2 (e) Appliance Branch Circuits - Dwelling Occupancies Air conditioners, refrigerators, dishwastrers, garbage disposals, microwave ovens, or appliances rated at or above 750 watts or 1/4 horsepower must have a separate circuit. ARTICLE 230 - SERVICF,S 230-43 230-70 Wiring Methods for 600 Volts or Less Service entrance conductors shall be installed in accordance with the applicable requirements of this code. All service entrance conductors shall be installed in an approved raceway such as rigid conduit, aluminum conduit, intermediate metal conduit, K.M.'I'. and rigid non-metallic conduit, busway, cable bus, auxiliary yutters and wireways, cable tray or mineral insulated cable. An electri- cal mast must be rigid or intermediate metal con- duit and shall be a minimum two inch (2") trade size or more in diameter when used as a support mast for service drops. General (Add to existing Article) If eight feet (8') or more of service entrance conductors are located inside the building as determined by Section 230-44, a disconnect must be installed at the meter. AR'T'ICLE 300 - WIRING METHODS 300-4 Protection Against Physical Damage (d) In concealed locations where E.M.T., P.V.C. or F.N.T. laid in notches will not lateC be visible, steel protection plate, a minimum of one sixteenttr (1/16") thick shall be installed prior to the application of wall, ceiling or floor finish.
